41	41	Nutrition Enhancement Act; defining terms; requiring
42	42	corn masa flour conta in certain amounts of folic
43	43	acid; requiring wet corn masa product contain certain
44	44	amounts of folic acid; requiring nutritional
45	45	labeling; requiring manufacture labeling; providing
46	46	exceptions; providing for codification; and providing

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 1 -1145 of Title 63, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	This act shall be known and may be cited as the " Corn Masa
57	57	Nutrition Enhancement Act ".
58	58	SECTION 2. NEW LAW A new section of law to be codified
59	59	in the Oklahoma Statutes as Section 1-1145.1 of Title 63, unless
60	60	there is created a duplication in numbering, reads as follows:
61	61	A. As used in this section:
62	62	1. "Corn masa flour", also commonly known as masa harina, means
63	63	a dry flour-type product made from corn that has been treated with

90	90	slaked lime or otherwise undergoes a process kn own as
91	91	nixtamalization;
92	92	2. "Snack foods" means pre -packaged food items typically
93	93	intended for immediate consumption, characterized by small or
94	94	single-serving portions, and designed primarily for consumption
95	95	between meals. This includes, but is not limite d to, products such
96	96	as chips, crisps, or extruded snack products, often sold
97	97	individually or in small bags or containers. Snack foods shall not
98	98	include bulk-packaged corn masa products or other items commonly
99	99	used as primary ingredients in meal preparatio n, such as tortillas;
100	100	and
101	101	3. "Wet corn masa product " means food manufactured by using an
102	102	alkali solution with corn kernels to transform them into nixtamal.
103	103	Wet corn masa product does not include products made with corn masa
104	104	flour.
105	105	B. 1. Commencing January 1, 2026, corn masa flour
106	106	manufactured, sold, delivered, distributed, held, offered for sale,
107	107	or used as an ingredient in the manufacture of a food product shall
108	108	contain folic acid at a level of seven-tenths (0.7) milligrams of
109	109	folic acid per pound of c orn masa flour within an acceptable
110	110	industry standard deviation of error.
111	111	2. Commencing January 1, 2026, wet corn masa product
112	112	manufactured, sold, delivered, distributed, held, offered for sale,
113	113	or used as an ingredient in the manufacture of a food produc t shall

140	140	contain folic acid at a level of four-tenths (0.4) milligrams of
141	141	folic acid per pound of end product within an acceptable industry
142	142	standard of deviation of error.
143	143	C. Commencing January 1, 2026, corn masa flour or a wet corn
144	144	masa product shall incl ude both of the following:
145	145	1. A declaration of folic acid on the nutrition label in
146	146	accordance with applicable federal law, including, but not limited
147	147	to, 21 C.F.R., Section 101.9; and
148	148	2. A declaration that the product contains corn masa flour or
149	149	was manufactured through a wet corn masa manufacturing process.
150	150	D. 1. A person or entity may manufacture, sell, deliver,
151	151	distribute, hold, offer for sale, or use as an ingredient in the
152	152	manufacture of products corn masa flour that does not meet the
153	153	requirements of paragraph 1 of subsection B of this section, if they
154	154	meet the definition of, or are suppliers to, any of the following:
155	155	a. a cottage food operation,
156	156	b. a food facility, or
157	157	c. a small-volume operator.
158	158	2. This section shall not apply to snack foods.
159	159	SECTION 3. This act shall become effective November 1, 2025.
