4040 An Act relating to criminal procedure; defining
4141 terms; prohibiting government entities from seeking
4242 and courts from issuing reve rse-location or reverse-
4343 keyword court orders; making records or information
4444 from reverse-location or reverse-keyword requests
4545 inadmissible in proceedings; providing an exception;
4646 requiring notification of violations; allowing
4747 aggrieved persons to institute civil actions;
4848 establishing requirements for assessing punitive
4949 damages; authorizing the award of court costs and
5050 reasonable attorney fees; providing for codification;

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new section of law to be codified
5858 in the Oklahoma Statutes as Section 1242 of Title 22, unless there
5959 is created a duplication in numbering, reads as follows:
6060 A. For the purposes of this section:
6161 1. "Government entity" means any department, agency, or
6262 political subdivision of this state or any individual acting for or
6363 on behalf of the state or a political subdivision;
6464 2. "Reverse-keyword court order" means any court order,
6565 including a search warrant, or subpoena compelling the disclosure of

9292 records or information identifying any person who electronically
9393 searched for a particular word, phrase, or website, or who visited a
9494 particular website through a link generated by such a search,
9595 regardless of whether or not the order is limited to a specific
9696 geographic area or time frame;
9797 3. "Reverse-keyword request" means any request, in the absence
9898 of a court order, by any government entity for the voluntary
9999 provision of records or information identifying any pe rson who
100100 electronically searched for a particular word, phrase, or website,
101101 or who visited a particular website through a link generated by such
102102 a search, regardless of whether the request is limited to a specific
103103 geographic area or time frame. Such reque sts shall include offers
104104 to purchase such records or information;
105105 4. "Reverse-location court order " means any court order,
106106 including a search warrant, or subpoena compelling the disclosure of
107107 records or information pertaining to the location of unspecifie d
108108 electronic devices or the unnamed users or owners of such devices,
109109 for which the scope extends to an unknown number of electronic
110110 devices present in a given geographic area at a given time, whether
111111 such location is measured via Global Positioning System (GPS)
112112 coordinates, cell tower connectivity, Wi -Fi positioning, or any
113113 other form of location detection; and
114114 5. "Reverse-location request" means any request, in the absence
115115 of a court order, by any government entity for the voluntary

142142 provision of records o r information pertaining to the location of
143143 unspecified electronic devices or the unnamed users or owners of
144144 such devices, for which the scope extends to an unknown number of
145145 electronic devices present in a given geographic area at a given
146146 time, whether such location is measured via Global Positioning
147147 System (GPS) coordinates, cell tower connectivity, Wi -Fi
148148 positioning, or any other form of location detection. Such requests
149149 shall include offers to purchase such records or information.
150150 B. 1. No government entity shall seek a reverse -location court
151151 order or a reverse-keyword court order from any court.
152152 2. No government entity shall seek, secure, obtain, borrow,
153153 purchase, or review any information or data obtained through a
154154 reverse-location court order or a reverse-keyword court order.
155155 3. No court subject to the laws of this state s hall issue a
156156 reverse-location court order or a reverse -keyword court order.
157157 4. No person or entity in this state as a result of any law,
158158 regulation, or agreement adopted by this state or any political
159159 subdivision shall be obligated to comply with a reverse -location
160160 court order or a reverse -keyword court order issued by this state, a
161161 political subdivision of this state, any other state, or a political
162162 subdivision of any other stat e.
163163 5. No court or political subdivision of this state shall
164164 support, assist, or enforce a reverse -location court order or a
165165 reverse-keyword court order issued by this state or a political

192192 subdivision of this state, any other state, or a political
193193 subdivision of any other state.
194194 C. 1. No government entity shall make a reverse -location
195195 request or a reverse -keyword request.
196196 2. No government entity shall seek, secure, obtain, borrow,
197197 purchase, or review any information or data obtained through a
198198 reverse-location request or a reverse -keyword request.
199199 3. No government entity shall see k the assistance of any
200200 political subdivision of the federal government or any other state
201201 in obtaining information or data from a reverse -location court
202202 order, reverse-keyword court order, reverse-location request, or
203203 reverse-keyword request if the government entity would be barred
204204 from directly seeking such information under the provisions of this
205205 section.
206206 D. 1. Except as proof of a violation of this section, no
207207 record or information obtained, accessed, or otherwise secured in
208208 violation of this section, nor evidence derived from such record or
209209 information, shall be admissible in any criminal, civil, or
210210 administrative proceeding, or any other type of proceeding.
211211 2. For the purposes of this section, a record, information, or
212212 evidence is derived from a reverse -location court order, reverse -
213213 keyword court order, reverse -location request, or reverse -keyword
214214 request when the government entity would not have originally
215215 possessed the information or evidence but for the violative court

242242 order or request, and regard less of any claim that the record,
243243 information, or evidence is attenuated from the unlawful order or
244244 request, would inevitably have been discovered, or was subsequently
245245 reobtained through other means.
246246 E. 1. Any person whose name or other identifying information
247247 was obtained by a government entity in violation of this section:
248248 a. shall be notified of the violation, in writing, by the
249249 government entity who committed the violation and of
250250 the legal recourse available to that person pursuant
251251 to subparagraph b of paragraph 1 of this subsection
252252 and paragraph 3 of this subsection, and
253253 b. may institute a civil action against such government
254254 entity for any of the following:
255255 (1) One Thousand Dollars ($1,000.00) per violation or
256256 actual damages, whichever is greater,
257257 (2) punitive damages,
258258 (3) injunctive or declaratory relief, or
259259 (4) any other relief the court deems proper.
260260 2. In assessing the amount of punitive damages, the court shall
261261 consider:
262262 a. the number of people whose information was disclosed,
263263 b. whether the violation directly or indirectly targeted
264264 persons engaged in the exercise of activities

291291 protected by the Constitution of the United States or
292292 the Constitution of Oklahoma, and
293293 c. the persistence of violations by the particular
294294 government entity.
295295 3. In any action brought under this section, the court may
296296 award court costs and reasonable attorney fees to a prevailing
297297 plaintiff.
298298 SECTION 2. This act shall become effect ive November 1, 2025.
