6464 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6565 SECTION 1. NEW LAW A new section of law not to be
6666 codified in the Oklahoma Statutes reads as follow s:
6767 The Legislature finds and declares the following:
6868 A. Domestic abuse, stalking, dating violence, sexual assault,
6969 human trafficking, and related abuse are life -threatening issues

9898 B. Abuse survivors often lack resources, options, and
9999 meaningful support when establishing independence from an abuser,
100100 including the barriers of financial insecurity and limited access to
101101 reliable means to maintain essential connections with family , social
102102 safety networks, employers, and support services. Abuse survivors
103103 may share a car title with an abusive partner, and safe access to an
104104 automobile can be a lifeline for an abuse survivor.
105105 C. Abusive partners increasingly use technological and
106106 communication tools to exercise control over, monitor, and abuse
107107 their victims. Cases of technology-enabled stalking and abuse
108108 involving vehicles are increasing as automakers include app -
109109 connected remote access and digital features. Through these apps,
110110 abusive partners are tracking, surveilling, and intimidating abuse
111111 survivors through location -tracking and remote-control functions to
112112 turn on the ignition, adjust the vehicle 's climate, lock doors, turn
113113 off electric charging, honk the horn, record video foota ge and
114114 audio, and use other means of electronically or remotely controlling
115115 the vehicle. Tracking can be viewed in real time, or location
116116 history records can be accessed and reviewed at a later time.
117117 D. Tracking often occurs unbeknownst to an abuse victi m, who
118118 may be unaware that the vehicle is app -connected or that an abusive
119119 partner has remote access through such technologies as mobile phone

147147 manufactured into vehicles.
148148 E. Safeguards within vehicle design and remote access can
149149 prevent future abuse, including requiring app-connected and tracking
150150 notifications to be designed to provide knowledge of who has
151151 vehicular access.
152152 F. According to privacy researchers and as reported in the New
153153 York Times, modern vehicles have been called smartphones with wheels
154154 because they are Internet-connected and have myriad methods of data
155155 collection, from cameras and seat weight sensors to records of how
156156 hard you brake and corner. Most drivers do not realize how much
157157 information their cars are collecting and who has access to it.
158158 G. Under the federal Safe Connections Act of 2022, survivors of
159159 domestic abuse are empowered to protect themselves and their loved
160160 ones by requiring telecommunications providers, upon re quest, to
161161 separate their mobile phone accounts from the accounts of their
162162 abusers, but the law does not extend to vehicular technology.
163163 H. It is the intent of this act to end stalking and abuse by
164164 abusive partners who can access connected vehicle service.
165165 SECTION 2. NEW LAW A new section of law to be codifie d
166166 in the Oklahoma Statutes as Section 1901 of Title 47, unless there

195195 1. "Account holder" means a person who is a party to or a user
196196 of services provided under a contract for connected vehicle service
197197 with a covered provider, and includes, but is not limited to, a
198198 subscriber, customer, or registered user ;
199199 2. "Connected vehicle location access " is a type of connected
200200 vehicle service that allows a person who is outside of a vehicle,
201201 excluding a covered provider or vehicle cellular data provider, to
202202 view or track the location of the vehicle, including, but not
203203 limited to, a location determined by a Global Positioning System
204204 (GPS), whether through the Internet, an app-based technology, or any
205205 other remote wireless connectivity technology ;
206206 3. "Connected vehicle service " means any capability provided by
207207 or on behalf of a vehicle manufacturer that enables a person,
208208 excluding a covered provider or vehicle cellular data provider, to
209209 remotely obtain data from, or send commands to, a vehicle, which may
210210 be accomplished through a software application that is designed to
211211 be operated on a mobile device ;
212212 4. "Connected vehicle service account " means an account or
213213 other means by which a person enrolls in or obtains access to a
214214 connected vehicle service ;
215215 5. "Connected vehicle service request " means a request by a
216216 driver to terminate a person's access to connected vehicle service ;

244244 6. "Covered provider" means a vehicle manufacturer or an entity
245245 acting on behalf of the vehicle manufacturer that provides connected
246246 vehicle service.
247247 SECTION 3. NEW LAW A new section of law to be codified
248248 in the Oklahoma Statutes as Section 1902 of Title 47, unless there
249249 is created a duplication in numbering, reads as follows:
250250 A vehicle with connected vehicle service shall clearly indicate
251251 to a person who is inside the vehicle when a person who is outside
252252 the vehicle has accessed either of the following:
253253 1. Connected vehicle service ; or
254254 2. Connected vehicle location access.
255255 SECTION 4. NEW LAW A new section of law to be codified
256256 in the Oklahoma Statutes as Section 1903 of Title 47, unless there
257257 is created a duplication in numbering, reads as follows:
258258 The provisions of this act are severable. If any provision of
259259 this act or its application is held invalid, that invalidity shall
260260 not affect other provisions or applications that can be given effect
261261 without the invalid provision or app lication.
262262 SECTION 5. NEW LAW A new section of law to be codified
263263 in the Oklahoma Statutes as Section 1904 of Title 47, unless there

265265 This act does not apply to vehicles owned or operated by a

293293 SECTION 6. NEW LAW A new section of law to be codified
294294 in the Oklahoma Statutes as Section 1905 of Title 47, unless there

296296 A covered provider or any officer, director, employee, vendor,
297297 or agent of a covered provider shall not be subject to liability for
298298 any claims deriving from an action taken in compliance with this
299299 act.
300300 SECTION 7. NEW LAW A new section of law to be codified
301301 in the Oklahoma Statutes as Section 1906 of Title 47, unless there
302302 is created a duplication in numbering, reads as follows:
303303 A. A covered provider shall provide a process tha t includes a
304304 prominent and clearly visible link entitled "HOW TO DISCONNECT
305305 REMOTE VEHICLE ACCESS" on its Internet website to complete both of
306306 the following transactions:
307307 1. Submit a connected vehicle service request ; and
308308 2. Obtain a new connected vehicl e service account.
309309 B. A covered provider shall ensure that all communications
310310 provided pursuant to this act are clear, concise, and written in
311311 accessible language. It is imperative that drivers, particularly
312312 those who are abuse survivors, receive support and clear guidance
313313 throughout the process for submitting a connected vehicle service
314314 request or obtaining a new connected vehicle service account.

341341 SECTION 8. NEW LAW A new section of law to be codified
342342 in the Oklahoma Statutes as S ection 1907 of Title 47, unless there
343343 is created a duplication in numbering, reads as follows:
344344 To enhance transparency and communication, the process to submit
345345 a connected vehicle service request or obtain a new connected
346346 vehicle service account shall be e fficient, secure, user -friendly,
347347 and include all of the following features:
348348 1. Upon submission of a connected vehicle service request or
349349 request to obtain a new connected vehicle service account, the
350350 covered provider shall automatically send a confirmatio n email to
351351 the driver, acknowledging the receipt of the request. This email
352352 shall contain a reference number for the request and an outline of
353353 the subsequent steps in the process ;
354354 2. Upon completing the review of the request, the covered
355355 provider shall inform the driver of the action taken, including, as
356356 applicable, whether a pers on's access to connected vehicle service
357357 has been terminated, or if additional information or proof of legal
358358 possession of the vehicle is needed. This alert shall clearly state
359359 any relevant details or further actions required from the driver to
360360 complete a successful connected vehicle service request ; and
361361 3. If a connected vehicle service request is approved, the
362362 covered provider shall provide the driver with a clear explanation
363363 and guidance on how to create their own connected vehicle service
364364 account, if applicable, to ensure that the driver can maintain

391391 control over the connected vehicle service once another person 's
392392 access to connected vehicle service has been terminated.
393393 SECTION 9. NEW LAW A new section of law to be codified
394394 in the Oklahoma Statutes as Section 1908 of Title 47, unless there
395395 is created a duplication in numbering, reads as follows:
396396 A. A driver shall demonstrate to a covered provider the
397397 authority to terminate a person 's access to connected vehicle
398398 service by providing both of the following:
399399 1. The vehicle identification number ; and
400400 2. Proof of legal possession of the vehicle, which may be a
401401 legal title to the vehicle, or a dissolution de cree, temporary court
402402 order, or domestic violence restraining order that awards possession
403403 or exclusive use of the vehicle to the driver. A court order
404404 awarding sole possession or exclusive use of a vehicle shall take
405405 priority over a vehicle title showing joint ownership for purposes
406406 of this act.
407407 B. A covered provider shall not re quire a driver to provide any
408408 proof of legal possession other than what is required in sub section
409409 A of this section to establish the authority to terminate a person 's
410410 access to connected vehicle service.
411411 C. A covered provider shall not require a driver to take any
412412 action to terminate a person 's access to connected vehicle service
413413 other than what is set forth in this section, including, but not
414414 limited to, requiring any of the fol lowing:

441441 1. Payment of a fee, penalty, or other charge to complete a
442442 connected vehicle service request ;
443443 2. Maintaining or extending the term of a connected vehicle
444444 service account;
445445 3. Approval by any account holder, including, but not limited
446446 to, the named account holder, of the change in access ; or
447447 4. An increase in the rate charged for the connected vehicle
448448 service.
449449 D. A covered provider shall terminate a person 's access to
450450 connected vehicle service within two (2) business days after the
451451 date of receiving a completed request from a driver who meets the
452452 requirements of this sect ion.
453453 SECTION 10. NEW LAW A new section of law to be codified
454454 in the Oklahoma Statutes as Section 1909 of Title 47, unless there
455455 is created a duplication in numbering, reads as follows:
456456 A. If a covered provider terminated a person 's access to
457457 connected vehicle service in response to a connected vehicle service
458458 request, the covered provider shall not provide to the person any
459459 data or information regarding the driver, the vehicle, or any new
460460 connected vehicle service account that was ge nerated after that
461461 person's access to the connected vehicle service was terminated.
462462 B. A covered provider shall ensure that all personal
463463 information provided during the process to terminate a person 's
464464 access to connected vehicle service is handled with appropriate

492492 regulations.
493493 C. A covered provider and any officer, director, employee,
494494 vendor, or agent thereof sh all treat any information submitted by a
495495 driver pursuant to this act as confidential and shall comply with
496496 applicable privacy laws.
497497 D. A covered provider shall not share information submitted by
498498 a driver pursuant to this act with any third party without t he
499499 affirmative consent of the driver, unless sharing that information
500500 is required to effectuate a connected vehicle service request.
501501 E. Nothing in this section shall preclude a covered provider
502502 from responding to a court order or warrant.
503503 SECTION 11. NEW LAW A new section of law to be codified
504504 in the Oklahoma Statutes as Section 1910 of Title 47, unless there
505505 is created a duplication in numbering, reads as follows:
506506 The termination of connected vehicle service pursuant to this
507507 act shall not be deemed to impact legal ownership of a vehicle.
508508 SECTION 12. NEW LAW A new section of law to be codified
509509 in the Oklahoma Statutes as Section 1911 of Title 47, unless there
510510 is created a duplication in numbering, reads as follo ws:
511511 If a vehicle includes connected vehicle location access, a
512512 covered provider shall provide a mechanism that can be used by a
513513 driver who is inside a vehicle to immediately disable connected
514514 vehicle location access.

541541 SECTION 13. NEW LAW A new section of law to be codified
542542 in the Oklahoma Statutes as Section 1912 of Title 47, unless there

544544 A mechanism for disabling connected vehicle location access
545545 shall meet all of the following requirements:
546546 1. Be prominently located and easy to use ;
547547 2. Not require access to, or use of, a remote or online
548548 application;
549549 3. Not require account creation, a password, or login
550550 information.
551551 A vehicle manufacturer may require a driver to input a mobil e
552552 number associated with the connected vehicle service account. If a
553553 vehicle manufacturer requires a driver to input a mobile number in
554554 order to disable the connected vehicle location access connection,
555555 it shall not require any further information in orde r to allow the
556556 driver to disable the connection, including, but not limited to ,
557557 using that number as part of a two -factor authentication process
558558 that results in sending a code to the mobile number ; and
559559 4. Allow connected vehicle location access that has b een
560560 disabled from inside the vehicle to be enabled only by a driver who
561561 is located inside the vehicle.
562562 SECTION 14. NEW LAW A new section of law to be codified
563563 in the Oklahoma Statutes as Section 1913 of Title 47, unless there

591591 Disabling the connected vehi cle location access from inside the
592592 vehicle shall not result in an account holder of the connected
593593 vehicle service, vehicle manufacturer, or a third -party service
594594 provider receiving any notification related to the connected vehicle
595595 location access being disabled, including, but not limited to, an
596596 alert, email, text, or telephone call.
597597 SECTION 15. NEW LAW A new section of law to be codified
598598 in the Oklahoma Statutes as Section 1914 of Title 47, unless there
599599 is created a duplication in n umbering, reads as follows:
600600 The provisions of this act shall apply:
601601 1. On the effective date of this act for vehicles that have
602602 connected vehicle service on the effective date o f this act;
603603 2. On July 1, 2026, for vehicles manufactured prior to January
604604 1, 2028, that have connected vehicle location access and have the
605605 capability to receive software updates that provide for the
606606 functionality required by Sections 12 through 15 of th is act; and
607607 3. On January 1, 2028, for vehicles manufactured on or after
608608 January 1, 2028, that have connected vehicle location access.
609609 SECTION 16. This act shall become effective November 1, 2025.
