60	60	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
61	61	SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -105.1, is
62	62	amended to read as follows:
63	63	Section 11-105.1. A. All curriculum and materials including
64	64	supplementary materials which will be used to teach or will be used
65	65	for or in connection with a sex education class or program which is
66	66	designed for the exclusive purpose of discussing sexual behavior or
67	67	attitudes, or any test, survey or questionnaire whose prima ry

94	94	purpose is to elicit responses on sexual behavior or attitudes shall
95	95	be available through the superintendent or a designee of the school
96	96	district for inspection by parents and guardians of the student who
97	97	will be involved with the class, program or test, survey or
98	98	questionnaire. Such curriculum, materials, classes, programs,
99	99	tests, surveys or questionnaires shall include information about
100	100	consent and shall have as one of its p rimary purposes the teaching
101	101	of or informing students about the practice of ab stinence. For the
102	102	purposes of this section, "consent" shall have the same meaning as
103	103	that provided by Section 113 of Title 21 of the Oklahoma Statutes.
104	104	The superintendent or a designee of the school district shall
105	105	provide prior written notification to the parents or guardians of
106	106	the students involved of their right to inspect the curriculum and
107	107	material and of their obligation to notify the school in writing if
108	108	they do not want their child to participate in the class, program,
109	109	test, survey or questionnair e. Each local board of education shall
110	110	determine the means of providing written notification to the parents
111	111	and guardian which will ensure effective notice in an efficient and
112	112	appropriate manner. No student shall be required to participate in
113	113	a sex education class or program which discusses sexual behavior or
114	114	attitudes if unless a parent or guardian of the student objects
115	115	provides permission in writing to such participation. If the type
116	116	of program referred to in this section is a part of or is taught
117	117	during a credit course, a student may be required to enroll in the

144	144	course but shall not be required to receive instruction in or
145	145	participate in the program if unless a parent or guardian objects
146	146	provides permission in writing.
147	147	B. The superintendent or a designee of a school district in
148	148	which sex education is taught or a program is offered which is
149	149	designed for the exclusive purpose of discussing sexual behavior or
150	150	attitudes shall approve all curriculum and materials which will be
151	151	used for such education and a ny test, survey or questionnaire whose
152	152	primary purpose is to elicit responses on sexual behavior or
153	153	attitudes used in the school prior to their use in the classroom or
154	154	school. The teacher involved in the class, program, testing or
155	155	survey shall submit the curriculum, materials, tests or surveys to
156	156	the superintendent or a designee for approval prior to their use in
157	157	the classroom or school. This section shall not apply to those
158	158	students enrolled in classes, programs, testings or surveys offered
159	159	through an alternative education program.
160	160	SECTION 2. AMENDATORY 70 O.S. 2021, Section 24 -158, as
161	161	amended by Section 2, Chapter 281, O.S.L. 2022 (70 O.S. Supp. 2024,
162	162	Section 24-158), is amended to read as follows:
163	163	Section 24-158. A. The "Oklahoma Prevention Needs Assessment
164	164	Survey" means the biennial mental health prevention survey of public
165	165	school students in grades six, eight, ten, and twelve managed by the
166	166	Department of Mental Health and Substance Abuse Services.

193	193	B. Beginning in the 2022 -2023 school year, and biennially
194	194	thereafter, public schools shall administer the Oklahoma Prevention
195	195	Needs Assessment Survey, or an alternative survey as provided in
196	196	subsection D of this section, to students who have parent permission
197	197	to participate, for the purpose of providing direction to schools,
198	198	school districts, and communities to effectively improve the lives
199	199	of students regarding a variety of issues with a focus on alcohol,
200	200	tobacco, other drug use, mental health, academic failure, and
201	201	violence.
202	202	C. The Department of Mental Health and Substance Abuse Services
203	203	shall maintain the Oklahoma Prevention Needs Assessment Survey and
204	204	shall provide technical assistance for schools in s urvey
205	205	administration, reporting, planning, and development of school
206	206	mental health prevention and intervention strategies informed by the
207	207	survey results.
208	208	D. If a school or school district chooses to administer an
209	209	alternative survey or assessment tool to f ulfill the purpose
210	210	described in subsection B of this section, it may apply for a waiver
211	211	through the Department of Mental Health and Substance Abuse
212	212	Services.
213	213	E. The school district superintendent or his or her designee
214	214	shall provide prior written notifica tion to the parents or legal
215	215	guardians of students to be administered of the intent to administer
216	216	the Oklahoma Prevention Needs Assessment Survey or an alternative

243	243	survey or assessment tool adopted pursuant to subsection D of this
244	244	section. The notificatio n shall include information to parents and
245	245	legal guardians that they may must opt their student out of in to
246	246	the survey or assessment tool by providing written notice to the
247	247	school district, if they wish for their student to participate .
248	248	F. Prior to the biennial administration of the Oklahoma
249	249	Prevention Needs Assessment Survey, the Department of Mental Health
250	250	and Substance Abuse Services shall submit the survey to the
251	251	President Pro Tempore of the Oklahoma State Senate, the Speaker of
252	252	the Oklahoma House of Representatives, the chairs of the committees
253	253	with responsibility over common education in both houses of the
254	254	Legislature, and the chairs of the committees with responsibility
255	255	over public health in both houses of the Legislature.
256	256	G. The provisions of this section shall be subject to the
257	257	availability of federal funding. If federal funding is insufficient
258	258	to provide the Oklahoma Prevention Needs Assessment Survey to public
259	259	schools on a biennial basis, administration of the survey shall not
260	260	be required.
261	261	H. The Board of Mental Health and Substance Abuse Services and
262	262	the State Board of Education may promulgate rules as necessary to
263	263	carry out the provisions of this section.
264	264	SECTION 3. This act shall become effective July 1, 2025.
265	265	SECTION 4. It being immediately necessary for the preservation
266	266	of the public peace, health or safety, an emergency is hereby
