---|
102 | 102 | | purposes of this section, "consent" shall have the same meaning as |
---|
103 | 103 | | that provided by Section 113 of Title 21 of the Oklahoma Statutes. |
---|
104 | 104 | | The superintendent or a designee of the school district shall |
---|
105 | 105 | | provide prior written notification to the parents or guardians of |
---|
106 | 106 | | the students involved of their right to inspect the curriculum and |
---|
107 | 107 | | material and of their obligation to notify the school in writing if |
---|
108 | 108 | | they do not want their child to participate in the class, program, |
---|
109 | 109 | | test, survey or questionnair e. Each local board of education shall |
---|
110 | 110 | | determine the means of providing written notification to the parents |
---|
111 | 111 | | and guardian which will ensure effective notice in an efficient and |
---|
112 | 112 | | appropriate manner. No student shall be required to participate in |
---|
113 | 113 | | a sex education class or program which discusses sexual behavior or |
---|
114 | 114 | | attitudes if unless a parent or guardian of the student objects |
---|
115 | 115 | | provides permission in writing to such participation. If the type |
---|
116 | 116 | | of program referred to in this section is a part of or is taught |
---|
117 | 117 | | during a credit course, a student may be required to enroll in the |

152 | 152 | | primary purpose is to elicit responses on sexual behavior or |
---|
153 | 153 | | attitudes used in the school prior to their use in the classroom or |
---|
154 | 154 | | school. The teacher involved in the class, program, testing or |
---|
155 | 155 | | survey shall submit the curriculum, materials, tests or surveys to |
---|
156 | 156 | | the superintendent or a designee for approval prior to their use in |
---|
157 | 157 | | the classroom or school. This section shall not apply to those |
---|
158 | 158 | | students enrolled in classes, programs, testings or surveys offered |
---|
159 | 159 | | through an alternative education program. |

199 | 199 | | of students regarding a variety of issues with a focus on alcohol, |
---|
200 | 200 | | tobacco, other drug use, mental health, academic failure, and |
---|
201 | 201 | | violence. |
---|
202 | 202 | | C. The Department of Mental Health and Substance Abuse Services |
---|
203 | 203 | | shall maintain the Oklahoma Prevention Needs Assessment Survey and |
---|
204 | 204 | | shall provide technical assistance for schools in s urvey |
---|
205 | 205 | | administration, reporting, planning, and development of school |
---|
206 | 206 | | mental health prevention and intervention strategies informed by the |
---|
207 | 207 | | survey results. |
---|
208 | 208 | | D. If a school or school district chooses to administer an |
---|
209 | 209 | | alternative survey or assessment tool to f ulfill the purpose |
---|
210 | 210 | | described in subsection B of this section, it may apply for a waiver |
---|
211 | 211 | | through the Department of Mental Health and Substance Abuse |
---|
212 | 212 | | Services. |
---|
213 | 213 | | E. The school district superintendent or his or her designee |
---|
214 | 214 | | shall provide prior written notifica tion to the parents or legal |
---|
215 | 215 | | guardians of students to be administered of the intent to administer |
---|
216 | 216 | | the Oklahoma Prevention Needs Assessment Survey or an alternative |
---|

249 | 249 | | Prevention Needs Assessment Survey, the Department of Mental Health |

250 | 250 | | and Substance Abuse Services shall submit the survey to the |
---|
251 | 251 | | President Pro Tempore of the Oklahoma State Senate, the Speaker of |
---|
252 | 252 | | the Oklahoma House of Representatives, the chairs of the committees |
---|
253 | 253 | | with responsibility over common education in both houses of the |
---|
254 | 254 | | Legislature, and the chairs of the committees with responsibility |
---|
255 | 255 | | over public health in both houses of the Legislature. |
---|
256 | 256 | | G. The provisions of this section shall be subject to the |
---|
257 | 257 | | availability of federal funding. If federal funding is insufficient |
---|
258 | 258 | | to provide the Oklahoma Prevention Needs Assessment Survey to public |
---|
259 | 259 | | schools on a biennial basis, administration of the survey shall not |
---|
260 | 260 | | be required. |
---|
261 | 261 | | H. The Board of Mental Health and Substance Abuse Services and |
---|
262 | 262 | | the State Board of Education may promulgate rules as necessary to |
---|
263 | 263 | | carry out the provisions of this section. |
---|
264 | 264 | | SECTION 3. This act shall become effective July 1, 2025. |
---|
265 | 265 | | SECTION 4. It being immediately necessary for the preservation |
---|
266 | 266 | | of the public peace, health or safety, an emergency is hereby |
---|
