5554 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5655 SECTION 1. NEW LAW A new section of law to be codified
5756 in the Oklahoma Statutes as Section 6170 of Title 36, unless there
5857 is created a duplication in numbering, reads as follows:

9189 Cancer centers in the State of Oklahoma may carry out the
9290 purposes and functions of the Fighting Chance for Firefighters Act
9391 to cover the costs of occupational cancer screenings.
9492 SECTION 3. AMENDATORY 74 O.S. 2021, Section 1315, is
9593 amended to read as follows:
9694 Section 1315. A. Upon application in writing and subject to
9795 any underwriting criteria that may be established by the Office of
9896 Management and Enterprise Servic es Oklahoma Health Care Authority,
9997 the Office Authority may extend the benefits of the Oklahoma
10098 Employees Insurance and Benefits Plans to employees who are employed
10199 in positions requiring actual performance of duty during not less
102100 than one thousand (1,000) hours per year and to all full -time
103101 employees of:
104102 1. Any of the following groups which participate in the
105103 Oklahoma Public Employees Retirement System:
106104 a. county,
107105 b. city,
108106 c. town,
109107 d. public trust for which the state is the primary
110108 beneficiary, or
111109 e. conservation districts; and

190186 k. statewide nonprofit entities receivi ng state funds to
191187 provide no cost legal services to low income and
192188 senior citizens,
193189 l. municipal fire departments organized pursuant to
194190 Section 29-101 et seq. of Title 11 of the Oklahoma
195191 Statutes, or
196192 m. county fire departments organized pursuant to Section
197193 351 of Title 19 of the Oklahoma Statutes .
198194 B. Applications to participate in the Oklahoma Employees
199195 Insurance and Benefits Plans shall be approved by majority action of
200196 the governing body of the groups listed in subsection A of this
201197 section.
202198 C. Groups listed in subsection A of this section participating
203199 in the Oklahoma Employees Insurance and Benefits Plans shall pay all
204200 costs attributable to their participation. The benefits of said
205201 plans for a participant provided coverage pursuant to this section
206202 shall be the same and shall include the same plan options as would
207203 be made available to a state employee participating in the plan that
208204 resided at the same location. The premium for participating groups
209205 listed in subsection A of this section shall be the same as paid by
210206 state and education employees.
211207 D. Participating groups listed in subsection A of this section
212208 shall not be required to offer dental insurance as defined in
213209 paragraph 11 12 of Section 1303 of this title, or other insurance as

242237 if dental insurance or any other insurance is offered, it must be
243238 provided to all eligible employees. If an employee retires and
244239 begins to receive benefits from the Oklahoma Public Employees
245240 Retirement System or terminates servi ce and has a vested benefit
246241 with the Oklahoma Public Employees Retirement System, the employee
247242 may elect, in the manner provided in Section 1316.2 of this title,
248243 to participate in the dental insurance plan offered through the
249244 Oklahoma Employees Insurance and Benefits Act within thirty (30)
250245 days from the date of termination of employment. The employee shall
251246 pay the full cost of the dental insurance.
252247 E. 1. Any employee of a group listed in subsection A of this
253248 section who retires or who has a vested benefi t pursuant to the
254249 Oklahoma Public Employees Retirement System may begin the health
255250 insurance coverage if the employer of the employee is not a
256251 participant of the Oklahoma Employees Insurance and Benefits Act and
257252 does not offer health insurance to its employees. Such election by
258253 the employee to begin coverage shall be made within thirty (30) days
259254 from the date of termination of service.
260255 2. Any employee of a group listed in subsection A of this
261256 section who retires or who has a vested benefit pursuant to the
262257 Oklahoma Public Employees Retirement System may begin or continue
263258 the health insurance coverage if the employer of the employee is a
264259 participant of the Oklahoma Employees Insurance and Benefits Act and

292286 the election to begin or conti nue coverage is made within thirty
293287 (30) days from the date of termination of service.
294288 F. Any county, city, town, county hospital, public trust,
295289 conservation district, or rural water, sewer, gas or solid waste
296290 management district, or nonprofit water corpor ation, any of which of
297291 the aforementioned groups is not a participating employer in the
298292 Oklahoma Public Employees Retirement System, but which has employees
299293 who are participating in the health, dental or life insurance plans
300294 offered by or through the Oklah oma Employees Insurance and Benefits
301295 Act on July 1, 1997, may continue to allow its current and future
302296 employees to participate in such health, dental or life insurance
303297 plans. Participation of such employees may also continue following
304298 termination of employment if the employee has completed at least
305299 eight (8) years of service with a participating employer and such an
306300 election to continue in force is made within thirty (30) days
307301 following termination of employment. Any retiree or terminated
308302 employee electing coverage pursuant to this section shall pay the
309303 full cost of the insurance.
310304 G. An employee of a group listed in paragraph 2 of subsection A
311305 of this section may continue in force health, dental and life
312306 insurance coverage following termination of employ ment if the
313307 employee has a minimum of eight (8) years of service with a
314308 participating employer and the election to continue in force is made

343336 employment.
344337 H. Notwithstanding other provisions in this section, an
345338 employer listed in subsection A of this section may cease to
346339 participate in the Oklahoma Employees Insurance and Benefits Act but
347340 provide health insurance coverage for its current and former
348341 employees through another insurance carrier. The sub sequent carrier
349342 shall be responsible for providing coverage to the entity's
350343 employees who terminated employment with a retirement benefit, with
351344 a vested benefit, or who have eight (8) or more years of service
352345 with a participating employer but did not have a vested benefit
353346 through the Oklahoma Public Employees Retirement System, if the
354347 election to retain health insurance coverage was made within thirty
355348 (30) days of termination of employment. Coverage shall also be
356349 provided to the eligible dependents of the employees if an electio n
357350 to retain coverage is made within thirty (30) days of termination of
358351 employment. Employees who terminate employment from an employer
359352 covered by this paragraph before December 31, 2001, and elect
360353 coverage under the Oklahoma Employe es Insurance and Benefits Act,
361354 shall not be required to change insurance carriers in the event that
362355 the employer changes its insurance carrier to a subsequent carrier.
363356 The provisions of this subsection shall become effective January 1,
364357 2002.

392384 I. Employers pursuant to subsection A of this section who
393385 participate in the Oklahoma Public Employees Retirement System and
394386 who offer health insurance coverage to their active employees, shall
395387 offer health insurance coverage to those employees who retire from
396388 the employer and also to those employees who terminate employment
397389 and are eligible to elect a vested benefit in the System. Such
398390 employers shall begin offering coverage to such employees on or
399391 before January 1, 2004. Such employees who wish to continue
400392 coverage shall make an election to retain health insurance coverage
401393 within thirty (30) days of termination of employment. However,
402394 former employees of such employers who have already retired or who
403395 have terminated and are eligible to elect a vested benefit under the
404396 Oklahoma Public Employees Retirement System, during the period
405397 beginning January 1, 2002, and ending December 31, 2003, may make an
406398 election to begin participation in the plans offered by the Office
407399 on or before December 31, 2003, in the same manner as other
408400 participating retired or vested members. The employer, assisted by
409401 the Oklahoma Public Employees Retirement System shall notify by
410402 October 1, 2003, all members who have either retired from the System
411403 or who are eligible to elect a vested benefit in the System between
412404 January 1, 2002, through December 31, 2003, and who were employed by
413405 an employer listed in subsection A of this section of the member's
414406 potential eligibility to participate in such plans. Each employer
415407 shall notify the Oklahoma Public Employees Retirement Sy stem when an

443434 employee is retiring and makes the election pursuant to this
444435 subsection to continue coverage under a plan offered by such
445436 employer and when an employee terminates employment and is eligible
446437 to elect a vested benefit in t he System and such employee elects to
447438 continue coverage under a plan offered by such employer. Such
448439 employer shall also notify the Oklahoma Public Employees Retirement
449440 System if a retired employee or an employee who is eligible to elect
450441 a vested benefit in the System terminates such continued coverage.
451442 J. Any group that begins participation in the Oklahoma
452443 Employees Insurance and Benefits Plans after the effective date of
453444 this act March 1, 2004, and that is not composed of state or
454445 education employees must shall have one hundred percent (100%)
455446 participation in the health plan offered pursuant to the Oklahoma
456447 Employees Insurance and Benefits Act.
457448 SECTION 4. This act shall become effective November 1, 2025.
