55	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56	55		SECTION 1. NEW LAW A new section of law to be codified
57	56		in the Oklahoma Statutes as Section 6170 of Title 36, unless there
58	57		is created a duplication in numbering, reads as follows:
59	58		This act shall be known and may be cited as the "Fighting Chance
60	59		for Firefighters Act".
61	60		SECTION 2. NEW LAW A new section of law to be codified
62	61		in the Oklahoma Statutes as Section 6171 of Title 36, unles s there

91	89		Cancer centers in the State of Oklahoma may carry out the
92	90		purposes and functions of the Fighting Chance for Firefighters Act
93	91		to cover the costs of occupational cancer screenings.
94	92		SECTION 3. AMENDATORY 74 O.S. 2021, Section 1315, is
95	93		amended to read as follows:
96	94		Section 1315. A. Upon application in writing and subject to
97	95		any underwriting criteria that may be established by the Office of
98	96		Management and Enterprise Servic es Oklahoma Health Care Authority,
99	97		the Office Authority may extend the benefits of the Oklahoma
100	98		Employees Insurance and Benefits Plans to employees who are employed
101	99		in positions requiring actual performance of duty during not less
102	100		than one thousand (1,000) hours per year and to all full -time
103	101		employees of:
104	102		1. Any of the following groups which participate in the
105	103		Oklahoma Public Employees Retirement System:
106	104		a. county,
107	105		b. city,
108	106		c. town,
109	107		d. public trust for which the state is the primary
110	108		beneficiary, or
111	109		e. conservation districts; and
112	110		2. Any of the following groups:

155	152		i. voluntary association designated to administer the
156	153		County Government Council as authorized in Section 7
157	154		of Title 19 of the Oklahoma Statutes,
158	155		j. statewide nonprofit entities representing employees of
159	156		the state or employees of local political subdivisions
160	157		who are eligible for insurance benefits authorized by
161	158		the provisions of the Oklahoma Employees Insurance and
162	159		Benefits Act, or

190	186		k. statewide nonprofit entities receivi ng state funds to
191	187		provide no cost legal services to low income and
192	188		senior citizens,
193	189		l. municipal fire departments organized pursuant to
194	190		Section 29-101 et seq. of Title 11 of the Oklahoma
195	191		Statutes, or
196	192		m. county fire departments organized pursuant to Section
197	193		351 of Title 19 of the Oklahoma Statutes .
198	194		B. Applications to participate in the Oklahoma Employees
199	195		Insurance and Benefits Plans shall be approved by majority action of
200	196		the governing body of the groups listed in subsection A of this
201	197		section.
202	198		C. Groups listed in subsection A of this section participating
203	199		in the Oklahoma Employees Insurance and Benefits Plans shall pay all
204	200		costs attributable to their participation. The benefits of said
205	201		plans for a participant provided coverage pursuant to this section
206	202		shall be the same and shall include the same plan options as would
207	203		be made available to a state employee participating in the plan that
208	204		resided at the same location. The premium for participating groups
209	205		listed in subsection A of this section shall be the same as paid by
210	206		state and education employees.
211	207		D. Participating groups listed in subsection A of this section
212	208		shall not be required to offer dental insurance as defined in
213	209		paragraph 11 12 of Section 1303 of this title, or other insurance as

241	236		defined in paragraph 12 13 of Section 1303 of this title. However,
242	237		if dental insurance or any other insurance is offered, it must be
243	238		provided to all eligible employees. If an employee retires and
244	239		begins to receive benefits from the Oklahoma Public Employees
245	240		Retirement System or terminates servi ce and has a vested benefit
246	241		with the Oklahoma Public Employees Retirement System, the employee
247	242		may elect, in the manner provided in Section 1316.2 of this title,
248	243		to participate in the dental insurance plan offered through the
249	244		Oklahoma Employees Insurance and Benefits Act within thirty (30)
250	245		days from the date of termination of employment. The employee shall
251	246		pay the full cost of the dental insurance.
252	247		E. 1. Any employee of a group listed in subsection A of this
253	248		section who retires or who has a vested benefi t pursuant to the
254	249		Oklahoma Public Employees Retirement System may begin the health
255	250		insurance coverage if the employer of the employee is not a
256	251		participant of the Oklahoma Employees Insurance and Benefits Act and
257	252		does not offer health insurance to its employees. Such election by
258	253		the employee to begin coverage shall be made within thirty (30) days
259	254		from the date of termination of service.
260	255		2. Any employee of a group listed in subsection A of this
261	256		section who retires or who has a vested benefit pursuant to the
262	257		Oklahoma Public Employees Retirement System may begin or continue
263	258		the health insurance coverage if the employer of the employee is a
264	259		participant of the Oklahoma Employees Insurance and Benefits Act and

292	286		the election to begin or conti nue coverage is made within thirty
293	287		(30) days from the date of termination of service.
294	288		F. Any county, city, town, county hospital, public trust,
295	289		conservation district, or rural water, sewer, gas or solid waste
296	290		management district, or nonprofit water corpor ation, any of which of
297	291		the aforementioned groups is not a participating employer in the
298	292		Oklahoma Public Employees Retirement System, but which has employees
299	293		who are participating in the health, dental or life insurance plans
300	294		offered by or through the Oklah oma Employees Insurance and Benefits
301	295		Act on July 1, 1997, may continue to allow its current and future
302	296		employees to participate in such health, dental or life insurance
303	297		plans. Participation of such employees may also continue following
304	298		termination of employment if the employee has completed at least
305	299		eight (8) years of service with a participating employer and such an
306	300		election to continue in force is made within thirty (30) days
307	301		following termination of employment. Any retiree or terminated
308	302		employee electing coverage pursuant to this section shall pay the
309	303		full cost of the insurance.
310	304		G. An employee of a group listed in paragraph 2 of subsection A
311	305		of this section may continue in force health, dental and life
312	306		insurance coverage following termination of employ ment if the
313	307		employee has a minimum of eight (8) years of service with a
314	308		participating employer and the election to continue in force is made

343	336		employment.
344	337		H. Notwithstanding other provisions in this section, an
345	338		employer listed in subsection A of this section may cease to
346	339		participate in the Oklahoma Employees Insurance and Benefits Act but
347	340		provide health insurance coverage for its current and former
348	341		employees through another insurance carrier. The sub sequent carrier
349	342		shall be responsible for providing coverage to the entity's
350	343		employees who terminated employment with a retirement benefit, with
351	344		a vested benefit, or who have eight (8) or more years of service
352	345		with a participating employer but did not have a vested benefit
353	346		through the Oklahoma Public Employees Retirement System, if the
354	347		election to retain health insurance coverage was made within thirty
355	348		(30) days of termination of employment. Coverage shall also be
356	349		provided to the eligible dependents of the employees if an electio n
357	350		to retain coverage is made within thirty (30) days of termination of
358	351		employment. Employees who terminate employment from an employer
359	352		covered by this paragraph before December 31, 2001, and elect
360	353		coverage under the Oklahoma Employe es Insurance and Benefits Act,
361	354		shall not be required to change insurance carriers in the event that
362	355		the employer changes its insurance carrier to a subsequent carrier.
363	356		The provisions of this subsection shall become effective January 1,
364	357		2002.

392	384		I. Employers pursuant to subsection A of this section who
393	385		participate in the Oklahoma Public Employees Retirement System and
394	386		who offer health insurance coverage to their active employees, shall
395	387		offer health insurance coverage to those employees who retire from
396	388		the employer and also to those employees who terminate employment
397	389		and are eligible to elect a vested benefit in the System. Such
398	390		employers shall begin offering coverage to such employees on or
399	391		before January 1, 2004. Such employees who wish to continue
400	392		coverage shall make an election to retain health insurance coverage
401	393		within thirty (30) days of termination of employment. However,
402	394		former employees of such employers who have already retired or who
403	395		have terminated and are eligible to elect a vested benefit under the
404	396		Oklahoma Public Employees Retirement System, during the period
405	397		beginning January 1, 2002, and ending December 31, 2003, may make an
406	398		election to begin participation in the plans offered by the Office
407	399		on or before December 31, 2003, in the same manner as other
408	400		participating retired or vested members. The employer, assisted by
409	401		the Oklahoma Public Employees Retirement System shall notify by
410	402		October 1, 2003, all members who have either retired from the System
411	403		or who are eligible to elect a vested benefit in the System between
412	404		January 1, 2002, through December 31, 2003, and who were employed by
413	405		an employer listed in subsection A of this section of the member's
414	406		potential eligibility to participate in such plans. Each employer
415	407		shall notify the Oklahoma Public Employees Retirement Sy stem when an

443	434		employee is retiring and makes the election pursuant to this
444	435		subsection to continue coverage under a plan offered by such
445	436		employer and when an employee terminates employment and is eligible
446	437		to elect a vested benefit in t he System and such employee elects to
447	438		continue coverage under a plan offered by such employer. Such
448	439		employer shall also notify the Oklahoma Public Employees Retirement
449	440		System if a retired employee or an employee who is eligible to elect
450	441		a vested benefit in the System terminates such continued coverage.
451	442		J. Any group that begins participation in the Oklahoma
452	443		Employees Insurance and Benefits Plans after the effective date of
453	444		this act March 1, 2004, and that is not composed of state or
454	445		education employees must shall have one hundred percent (100%)
455	446		participation in the health plan offered pursuant to the Oklahoma
456	447		Employees Insurance and Benefits Act.
457	448		SECTION 4. This act shall become effective November 1, 2025.
