5348 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5449 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2 -1101, is
5550 amended to read as follows:
5651 Section 2-1101. A. Until July 1, 2026 2027, the following are
5752 hereby authorized to engage in harm -reduction services:
5853 1. Government entities including, but not limited to, the State
5954 Department of Health and the Department of Mental Health and
6055 Substance Abuse Services; provided, no state dollars shall be use d
6156 to purchase hypodermic needles;
6257 2. Religious institutions or churches;
6358 3. Nonprofit organizations;
6459 4. For-profit companies;

92-5. Nongovernment entities partnering with a governmental

9488 6. Tribal governments.
9589 B. Those offering harm -reduction services shall register with
9690 the State Department of Health and may engage in the following
9791 activities in order to reduce the use of drugs, prevent outbreaks of
9892 infectious diseases and reduce morbidity among people who use
9993 injection drugs:
10094 1. Offer referrals and resources to treat subst ance use
10195 disorders;
10296 2. Provide education on the risk of transmission of infectious
10397 diseases, including human immunodeficiency virus (HIV) and viral
10498 hepatitis;
10599 3. Rapid testing for HIV, hepatitis C and sexually transmitted
106100 infections (STIs);
107101 4. Referrals for medical and mental health services;
108102 5. Collect used hypodermic needles for safe disposal;
109103 6. Possess and distribute hypodermic needles, cleaning kits,
110104 test kits and opioid antagonists; and
111105 7. Rapid substance testing products used, intended for use, or
112106 fashioned specifically for the use in identifying or analyzing the
113107 potency or toxicity of unknown substances.
114108 C. Registered providers of harm -reduction services shall report
115109 at least quarterly to the State Department o f Health and annually to
110+the Governor, the Speaker of the House of Representatives, and the
111+President Pro Tempore of the Senate :

143-the Governor, the Speaker of the House of Representatives, and the
144-President Pro Tempore of the Senate :
145138 1. The number of clients served including basic demographic
146139 information;
147140 2. Number and type of referrals provided;
148141 3. Number of syringes, test kits and antag onists distributed;
149142 4. Number of used syringes collected; and
150143 5. Number of rapid HIV and viral hepatitis tests performed
151144 including the number of reactive test results.
152145 D. The State Commissioner of Health shall promulgate rules for
153146 the implementation of this section.
154147 SECTION 2. This act shall become effective November 1, 2025.
