53 | 48 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

54 | 49 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 2 -1101, is |

56 | 51 | | Section 2-1101. A. Until July 1, 2026 2027, the following are |

57 | 52 | | hereby authorized to engage in harm -reduction services: |

59 | 54 | | Department of Health and the Department of Mental Health and |
---|
60 | 55 | | Substance Abuse Services; provided, no state dollars shall be use d |

61 | 56 | | to purchase hypodermic needles; |

62 | 57 | | 2. Religious institutions or churches; |

63 | 58 | | 3. Nonprofit organizations; |

64 | 59 | | 4. For-profit companies; |
---|

95 | 89 | | B. Those offering harm -reduction services shall register with |

96 | 90 | | the State Department of Health and may engage in the following |
---|
97 | 91 | | activities in order to reduce the use of drugs, prevent outbreaks of |
---|
98 | 92 | | infectious diseases and reduce morbidity among people who use |
---|
99 | 93 | | injection drugs: |

100 | 94 | | 1. Offer referrals and resources to treat subst ance use |
---|
101 | 95 | | disorders; |
---|
102 | 96 | | 2. Provide education on the risk of transmission of infectious |
---|
103 | 97 | | diseases, including human immunodeficiency virus (HIV) and viral |
---|
104 | 98 | | hepatitis; |
---|
105 | 99 | | 3. Rapid testing for HIV, hepatitis C and sexually transmitted |
---|
106 | 100 | | infections (STIs); |
---|
107 | 101 | | 4. Referrals for medical and mental health services; |
---|
108 | 102 | | 5. Collect used hypodermic needles for safe disposal; |
---|
109 | 103 | | 6. Possess and distribute hypodermic needles, cleaning kits, |
---|
110 | 104 | | test kits and opioid antagonists; and |
---|
111 | 105 | | 7. Rapid substance testing products used, intended for use, or |
---|
112 | 106 | | fashioned specifically for the use in identifying or analyzing the |
---|
113 | 107 | | potency or toxicity of unknown substances. |

114 | 108 | | C. Registered providers of harm -reduction services shall report |
---|
115 | 109 | | at least quarterly to the State Department o f Health and annually to |
---|
145 | 138 | | 1. The number of clients served including basic demographic |

146 | 139 | | information; |
---|
147 | 140 | | 2. Number and type of referrals provided; |
---|
148 | 141 | | 3. Number of syringes, test kits and antag onists distributed; |

150 | 143 | | 5. Number of rapid HIV and viral hepatitis tests performed |

151 | 144 | | including the number of reactive test results. |

152 | 145 | | D. The State Commissioner of Health shall promulgate rules for |

153 | 146 | | the implementation of this section. |
