4540 An Act relating to schools; creating the Emerson Kate

6358 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6459 SECTION 1. NEW LAW A new section of law not to be
6560 codified in the Oklahoma Statutes reads as follows:
6661 This act shall be known and may be cited as the "Emerson Kate
6762 Cole Act".
6863 SECTION 2. AMENDATORY 70 O.S. 2021, Section 1 -116.3, is
6964 amended to read as follows:
65+Section 1-116.3. A. Notwithstanding the provisions of Section

97-Section 1-116.3. A. Notwithstanding the provisions of Section
98-1-116.2 of this title, the board of education of each school
9993 district shall adopt a policy on or before September 1, 2008, that
10094 permits the self-administration of inhaled asthma medication by a
10195 student for treatment of asthma, the self -administration of
10296 anaphylaxis medication by a student for treatment of anaphylaxis and
10397 the self-administration of replacement pancreatic enzymes by a
10498 student for treatment of cystic fibrosis. The policy shall require:
10599 1. The parent or guardian of the student to authorize in
106100 writing the student's self-administration of medication;
107101 2. The parent or guardian of the student to provide to the
108102 school a written statement from the physician treating the student
109103 that the student has asthma, anaphylaxis or cystic fibrosis and is
110104 capable of, and has been instructed in the proper method of, self -
111105 administration of medication;
112106 3. The parent or guardian of the student to provide to the
113107 school an emergency supply of the student 's medication to be
114108 administered pursuant to the provisions of Section 1 -116.2 of this
115109 title;
116110 4. The school district to inform the parent or guardian of the
117111 student, in writing, that the school district and its employees and
118112 agents shall incur no liability as a result of any injury arising
119113 from the self-administration of medication by the student; and
114+5. The parent or guardian of th e student to sign a statement
115+acknowledging that the school district shall incur no liability as a

147-5. The parent or guardian of the student to sign a statement
148-acknowledging that the school district shall incur no liability as a
149142 result of any injury arising from the self -administration of
150143 medication by the student.
151144 B. The school board of each school district that elects to
152145 stock Epinephrine injectors or inhalers shall amend the policy
153146 identified in subsection A of this section.
154147 1. The amended policy for Epinephrine injectors shall require:
155148 a. the school district to inform the parent or guardian
156149 of each student, in writing, that a sc hool nurse or
157150 school employee trained by a health care professional
158151 or trained in correlation with the State Department of
159152 Health's Diabetes Management Annual School Training
160153 Program pursuant to subsection G of this section may
161154 administer, with parent or guardian permission but
162155 without a health care provider order, an Epinephrine
163156 injection to a student whom the school nurse or
164157 trained school employee in good faith believes is
165158 having an anaphylactic reaction,
166159 b. a waiver of liability executed by a parent or guardian
167160 be on file with the school district prior to the
168161 administration of an Epinephrine injection pursuant to
169162 paragraph 1 of this subsection, and
163+c. the school district to designate the employee
164+responsible for obtaining the Epinephrine injectors at
165+each school site.

200192 2. The amended policy for inhalers shall require:
201193 a. the school district to inform the parent or guardian
202194 of each student, in writing, that a school nurse or
203195 school employee trained by a health care professional
204196 may administer an inhaler to a student whom the school
205197 nurse or trained school employee in good faith
206198 believes is having respiratory distress,
207199 b. the school district to designate the employee
208200 responsible for obtaining the inhalers and spacers or
209201 holding chambers at each school site, and
210202 c. the school district to notify the parent or guardian
211203 of a student after administration of an inhaler.
212204 C. The school district and its employees and agents shall incur
213205 no liability as a result of any injury arising pursuant to the
214206 discharge or nondischarge of the powers provided for pursuant to
215207 subparagraph a of paragraphs 1 and 2 of subsection B of this
216208 section.
217209 D. A licensed physician who has prescriptive authority may
218210 write a prescription for Epinephrine injectors and inhalers and
219211 spacers or holding chambers to the school district in the name of
220212 the district as a body corporate specified in Section 5 -105 of this
213+title which shall be maintained at each school site. Such physician
214+shall incur no liability as a result of any injury arising from the

248-title which shall be maintained at each school site. Such physician
249-shall incur no liabilit y as a result of any injury arising from the
250241 use of the Epinephrine injectors or the inhalers and spacers or
251242 holding chambers.
252243 E. The school district may maintain at each school a minimum of
253244 two Epinephrine injectors devices and two inhalers with spacers or
254245 holding chambers in a secure location. Pro vided, however, that
255246 nothing in this section shall be construed as creating or imposing a
256247 duty on a school district to maintain Epinephrine injectors or
257248 inhalers with spacers or holding chambers at a school site or sites.
258249 F. In the event a student is beli eved to be having an
259250 anaphylactic reaction or respiratory distress, a school employee
260251 shall contact 911 as soon as possible. If Epinephrine is
261252 administered to a student, a school employee shall contact 911 as
262253 soon as possible. The school district shall n otify the parent or
263254 guardian of any student who experiences a possible allergic reaction
264255 as soon as possible.
265256 G. The State Board of Education, in consultation with the State
266257 Board of Health, shall develop model policies which school districts
267258 may shall use in compliance with this section. The model policies
268259 shall include, at a minimum, required annual training for teachers
269260 and school employees who are directly responsible for students on
270261 the topics of food allergies, recognizing anaphylaxis, and
271262 instruction on how to administer Epinephrine. The training shall be
263+completed before the school year begins or upon hiring the teacher
264+or school employee. Documentation certifying completion of the

299-completed before the school year begins or upon hiring the teacher
300-or school employee. Documentation certifying completion of the
301291 required training shall be retained in the personnel file of the
302292 teacher or school employee. The training may be provided online or
303293 in person by the school nurse or a recognized food allergy and
304294 anaphylaxis training program.
305295 H. The State Board of Education, in consultation with the State
306296 Board of Health, shall promulg ate rules to implement this section.
307297 I. As used in this section:
308298 1. "Medication" means a metered dose inhaler or a dry powder
309299 inhaler to alleviate asthmatic symptoms, prescribed by a physician
310300 and having an individual label, an anaphylaxis medication use d to
311301 treat anaphylaxis including but not limited to Epinephrine injectors
312302 prescribed by a physician and having an individual label, or
313303 replacement pancreatic enzymes prescribed by a physician and having
314304 an individual label; and
315305 2. "Self-administration" means a student's use of medication
316306 pursuant to prescription or written direction from a physician .;
317307 3. "Respiratory distress " means the perceived or actual
318308 presence of coughing, wheezing or shortness of breath; and
319309 4. "Inhaler" means a device that deliver s a bronchodilator to
320310 alleviate symptoms of respiratory distress that is manufactured in
321311 the form of a metered -dose inhaler or dry-powder inhaler and that
312+may include a spacer or holding chamber that attaches to the inhaler
313+to improve the delivery of the b ronchodilator.

351340 J. The permission for self -administration of asthma,
352341 anaphylaxis or replacement pancreatic enzyme medication is effective
353342 for the school year for which it is granted and shall be renewed
354343 each subsequent school year upon fulfillment of the r equirements of
355344 this section.
356345 K. A student who is permitted to self -administer asthma,
357346 anaphylaxis or replacement pancreatic enzyme medication pursuant to
358347 this section shall be permitted to possess and use a prescribed
359348 inhaler, anaphylaxis medication inclu ding but not limited to an
360349 Epinephrine injector, or replacement pancreatic enzyme medication at
361350 all times.
