62	62	BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
63	63	SECTION 1. NEW LAW A new section of law to be codified
64	64	in the Oklahoma Statutes as Section 6401 of Title 74, unless there
65	65	is created a duplication in numbering, reads as follows:
66	66	As used in this act:
67	67	1. "Extremely low income household " means income not in excess
68	68	of thirty percent (30%) of the area median income, adjusted for the

103	103	fifty percent (50%) of the area median income but no more than
104	104	eighty percent (80%) of the area median income, adjusted for the
105	105	size of the household, as determine d by the United States Department
106	106	of Housing and Urban Development;
107	107	4. "Moderate income household " means a household income of more
108	108	than eighty percent (80%) of the area median income but no more than
109	109	one hundred twenty percent (120%) of the area median i ncome,
110	110	adjusted for the size of the household, as determined by the United
111	111	States Department of Housing and Urban Development; and
112	112	5. "Middle income household " means a household that has an
113	113	income of more than one hundred twenty percent (120%) of the area
114	114	median income but no more than one hundred sixty percent (160%) of
115	115	the area median income, adjusted for the size of the household, as
116	116	determined by the United States Department of Housing and Urban

147	147	A. There is hereby created the Oklahoma Affordable Housing
148	148	Commission. The Commission shall be composed of sixteen (16)
149	149	members. The members shall serve as follows:
150	150	1. Eight members shall be appointed by the President Pro
151	151	Tempore of the Oklahoma State Senate:
152	152	a. one shall be a Senator from the majority party who
153	153	shall serve as co-chair of the Commission,
154	154	b. one shall be a Senator from the minority party who
155	155	shall serve as co-vice chair of the Commission,
156	156	c. one shall be a representative of an American Indian
157	157	Tribe who provides affordable housing in rural areas,
158	158	whose first term shall be for one (1) year, and then
159	159	renewable for three-year terms thereafter,
160	160	d. one shall be a representative from a low income and
161	161	moderate to low income population -serving financial
162	162	institution (A Community Development Financial
163	163	Institution as defined by the Federal Reser ve) whose
164	164	first term shall be for two (2) years, and then
165	165	renewable for three-year terms thereafter,
166	166	e. one shall be a representative from a Community Housing
167	167	Development Organization (CHDO), as determined by the

292	292	B. The Commission shall utilize the Oklahoma Affordable Housing
293	293	Commission Revolving Fund as authorized in Section 3 of this act.
294	294	C. The Commission shall utilize the resources avai lable to it
295	295	in order to address the needs of extremely low income households,
296	296	very low income households, low income households, moderate income
297	297	households, and middle income households in order to promote a
298	298	condition in which suitable housing is available to as many persons
299	299	as possible.
300	300	SECTION 3. NEW LAW A new section of law to be codified
301	301	in the Oklahoma Statutes as Section 6404 of Title 74, unless there
302	302	is created a duplication in numbering, reads as follows:
303	303	A. There is hereby created in the State Treasury a revolving
304	304	fund to be designated as the "Oklahoma Affordable Housing Commission
305	305	Revolving Fund", which shall consist of all monies appropriated,
306	306	transferred, or otherwise designated to the fund by law. The
307	307	revolving fund shall be a continuing fund, not subject to fiscal
308	308	year limitations, and shall be under the administration of the
309	309	Oklahoma Affordable Housing Commission and shall be budgeted and
310	310	expended in accordance with the provisions of subsection B of this
311	311	section for the purpose of improving the stock and affordability of
312	312	Oklahoma housing.
313	313	B. No funds shall be budgeted or expended from the Oklahoma
314	314	Affordable Housing Commission Revolving Fund prior to July 1, 2025,
315	315	or prior to the approval by the Legislature of promulga ted permanent

344	344	C. The Oklahoma Affordable Housing Commission shall promulgate,
345	345	pursuant to the provisions of the Administrative Procedures Act,
346	346	permanent rules subject to approval by the Legislature, to
347	347	implement:
348	348	1. An initial comprehensive Ok lahoma Affordable Housing
349	349	environmental scan and needs assessment;
350	350	2. A comprehensive Oklahoma Affordable Housing annual report
351	351	and action plan;
352	352	3. Details of the Commission 's general duties;
353	353	4. Reporting requirements of the Commission to the Legislature;
354	354	5. Evaluate and make recommendations to the Legislature on
355	355	abatement and exemption incentives to support the development of
356	356	more affordable housing; and
357	357	6. Any other rules n ecessary to carry out the purpose and
358	358	mission of the Commission as expressed i n this act.
359	359	D. All unencumbered funds remaining in the Oklahoma Affordable
360	360	Housing Commission Revolving Fund upon the expiration of the
361	361	Oklahoma Affordable Housing Commission sh all be transferred to the
362	362	State Treasurer for deposit in the General Revenue Fund.
363	363	SECTION 4. This act shall become effective July 1, 2025.
364	364	SECTION 5. It being immediately necessary for the preservation
365	365	of the public peace, health or safety, an emergency is hereby
