6262 BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
6363 SECTION 1. NEW LAW A new section of law to be codified
6464 in the Oklahoma Statutes as Section 6401 of Title 74, unless there
6565 is created a duplication in numbering, reads as follows:
6666 As used in this act:
6767 1. "Extremely low income household " means income not in excess

104104 eighty percent (80%) of the area median income, adjusted for the

106106 of Housing and Urban Development;
107107 4. "Moderate income household " means a household income of more
108108 than eighty percent (80%) of the area median income but no more than
109109 one hundred twenty percent (120%) of the area median i ncome,
110110 adjusted for the size of the household, as determined by the United
111111 States Department of Housing and Urban Development; and
112112 5. "Middle income household " means a household that has an
113113 income of more than one hundred twenty percent (120%) of the area
114114 median income but no more than one hundred sixty percent (160%) of
115115 the area median income, adjusted for the size of the household, as
116116 determined by the United States Department of Housing and Urban

144144 SECTION 2. NEW LAW A new section of law to be codified
145145 in the Oklahoma Statutes as Section 6402 of Title 74, unless there
146146 is created a duplication in numbering, reads as follows:
147147 A. There is hereby created the Oklahoma Affordable Housing
148148 Commission. The Commission shall be composed of sixteen (16)
149149 members. The members shall serve as follows:
150150 1. Eight members shall be appointed by the President Pro
151151 Tempore of the Oklahoma State Senate:
152152 a. one shall be a Senator from the majority party who
153153 shall serve as co-chair of the Commission,
154154 b. one shall be a Senator from the minority party who
155155 shall serve as co-vice chair of the Commission,
156156 c. one shall be a representative of an American Indian
157157 Tribe who provides affordable housing in rural areas,
158158 whose first term shall be for one (1) year, and then
159159 renewable for three-year terms thereafter,
160160 d. one shall be a representative from a low income and
161161 moderate to low income population -serving financial
162162 institution (A Community Development Financial
163163 Institution as defined by the Federal Reser ve) whose
164164 first term shall be for two (2) years, and then
165165 renewable for three-year terms thereafter,
166166 e. one shall be a representative from a Community Housing
167167 Development Organization (CHDO), as determined by the

207207 States Department of Agriculture (USDA);
208208 2. Eight members shall be appointed by the Speaker of the
209209 Oklahoma House of Representatives:
210210 a. one shall be a House member from the majority party
211211 who shall serve as co -chair of the Commission,
212212 b. one shall be a House member from the minority party
213213 who shall serve as co-vice chair of the Commission,
214214 c. one shall be a representative from a not -for-profit
215215 organization who serves low -income Oklahomans
216216 experiencing difficulty in obtain ing affordable

245245 d. one of whom shall be a representative from an
246246 organization who assists special populations (elderly,
247247 disabled, veterans, or children transitioning out of
248248 foster care) in obtaining affordable housing, whose
249249 first term shall be for two (2) years, and then
250250 renewable for three-year terms thereafter,
251251 e. one shall be a representative from an urban housing
252252 authority whose first term shall be f or two (2) years,
253253 and then renewable for three -year terms thereafter,
254254 f. the Executive Director of the Oklahoma Housing Finance
255255 Agency (OHFA) or designee whose first term shall be
256256 for two (2) years, and then renewable for three -year
257257 terms thereafter,
258258 g. one shall be a representative from an urban housing
259259 authority whose first term s hall be for two (2) years ,
260260 and then renewable for three -year terms thereafter,
261261 and
262262 h. one shall be a representative of an Oklahoma rural
263263 housing authority whose first term shall be for two
264264 (2) years, and then renewable for three -year terms

292292 B. The Commission shall utilize the Oklahoma Affordable Housing
293293 Commission Revolving Fund as authorized in Section 3 of this act.
294294 C. The Commission shall utilize the resources avai lable to it
295295 in order to address the needs of extremely low income households,
296296 very low income households, low income households, moderate income
297297 households, and middle income households in order to promote a
298298 condition in which suitable housing is available to as many persons
299299 as possible.
300300 SECTION 3. NEW LAW A new section of law to be codified
301301 in the Oklahoma Statutes as Section 6404 of Title 74, unless there
302302 is created a duplication in numbering, reads as follows:
303303 A. There is hereby created in the State Treasury a revolving
304304 fund to be designated as the "Oklahoma Affordable Housing Commission
305305 Revolving Fund", which shall consist of all monies appropriated,
306306 transferred, or otherwise designated to the fund by law. The
307307 revolving fund shall be a continuing fund, not subject to fiscal
308308 year limitations, and shall be under the administration of the
309309 Oklahoma Affordable Housing Commission and shall be budgeted and
310310 expended in accordance with the provisions of subsection B of this
311311 section for the purpose of improving the stock and affordability of
312312 Oklahoma housing.
313313 B. No funds shall be budgeted or expended from the Oklahoma
314314 Affordable Housing Commission Revolving Fund prior to July 1, 2025,
315315 or prior to the approval by the Legislature of promulga ted permanent

342342 rules by the Commission pursuant to the provisions of the
343343 Administrative Procedures Act.
344344 C. The Oklahoma Affordable Housing Commission shall promulgate,
345345 pursuant to the provisions of the Administrative Procedures Act,
346346 permanent rules subject to approval by the Legislature, to
347347 implement:
348348 1. An initial comprehensive Ok lahoma Affordable Housing
349349 environmental scan and needs assessment;
350350 2. A comprehensive Oklahoma Affordable Housing annual report
351351 and action plan;
352352 3. Details of the Commission 's general duties;
353353 4. Reporting requirements of the Commission to the Legislature;
354354 5. Evaluate and make recommendations to the Legislature on
355355 abatement and exemption incentives to support the development of
356356 more affordable housing; and
357357 6. Any other rules n ecessary to carry out the purpose and
358358 mission of the Commission as expressed i n this act.
359359 D. All unencumbered funds remaining in the Oklahoma Affordable
360360 Housing Commission Revolving Fund upon the expiration of the
361361 Oklahoma Affordable Housing Commission sh all be transferred to the
362362 State Treasurer for deposit in the General Revenue Fund.
363363 SECTION 4. This act shall become effective July 1, 2025.
364364 SECTION 5. It being immediately necessary for the preservation
365365 of the public peace, health or safety, an emergency is hereby
