61 | 56 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

62 | 57 | | SECTION 1. NEW LAW A new section of law to be codified |

63 | 58 | | in the Oklahoma Statutes as Section 26 of Title 20, unless there is |
---|
64 | 59 | | created a duplication in numbering, reads as follows: |

65 | 60 | | A. No member of the Judicial Nominating Commission who is |
---|
66 | 61 | | related to an applicant for any pos ition for which the Commission is |
---|
67 | 62 | | responsible to submit nominations to an appointing authority |
---|
68 | 63 | | pursuant to Section 3 of Article VII -B of the Constitution of t he |
---|
98 | 92 | | to the applicant within the third degree of consanguinity or |
---|
99 | 93 | | affinity. If a member of the Judicial Nominating Commission |
---|
100 | 94 | | participates in the decision -making process with respect to an |
---|
101 | 95 | | applicant in contravention of th e requirement of this subsection, |
---|
102 | 96 | | the member shall be immediately removed from the Commission and |
---|
103 | 97 | | shall be permanently forbidden from being appointed to the |
---|
104 | 98 | | Commission. |

105 | 99 | | B. No later than ten (10) days after receiving the final list |
---|
106 | 100 | | of applications for an o pen position which is set to come before the |
---|
107 | 101 | | Judicial Nominating Commission, a member of the Judicial Nominating |
---|
108 | 102 | | Commission shall make full disclosure of the date and amount of any |
---|
109 | 103 | | contribution made by such member to the judicial campaign of any |
---|
110 | 104 | | person making application to the Commission for their possible |
---|
111 | 105 | | nomination to an appointing authority pursuant to the provisions of |
---|
112 | 106 | | Section 3 of Article VII -B of the Constitution of the State of |
---|
113 | 107 | | Oklahoma. The Administrative Director of the Courts shall prescribe |
---|
114 | 108 | | a form to be used for such purpose. The completed forms shall be |
---|
115 | 109 | | posted in a conspicuous manner on a website maintained by or on |
---|
116 | 110 | | behalf of the Judicial Nominating Commission and shall be accessible |
---|
117 | 111 | | until the position for which nominations are to be submitted by the |
---|
118 | 112 | | Commission has been filled. |
---|
149 | 142 | | With respect to members of the Oklahoma Bar Association who may |

150 | 143 | | be eligible for appointment or election to the Judicial Nominating |

151 | 144 | | Commission, the address for the person as reflected in the records |

152 | 145 | | of the State Election Board shall be used for purposes of |

153 | 146 | | determining the residence of such person for purposes of eligibility |

154 | 147 | | for membership on the Judicial Nominating Commission. |
