4040 An Act relating to state identification cards;

5252 BE IT ENACTED BY THE PEOPLE OF THE S TATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 47 O.S. 2021 , Section 6-105.3, as
5454 last amended by Section 3, Chapter 315, O.S.L. 2024 (47 O.S. Supp.
5555 2024, Section 6-105.3), is amended to read as follows:
5656 Section 6-105.3. A. In addition to the licenses to operate
5757 motor vehicles, the Department of Public Safety may issue cards to
5858 Oklahoma residents for purposes of identification only. The
5959 identification cards shall be issued, renewed, replaced, canceled
6060 and denied in the same manner as dr iver licenses in this state. A
6161 licensee whose record reflects a notation of t he person's proof of
6262 legal presence, verified by the U.S. Department of Homeland
6363 Security, or proof of U.S. citizenship, may obtain a REAL ID

9090 Compliant Identification Card or a N oncompliant Identification Card
9191 from a motor license agent or the Department of Public Safety,
9292 regardless of the status of the license held by the licensee.
9393 Provided, the licensee must comply with all REAL ID documentation
9494 requirements to obtain a REAL ID Compliant Identification Card. A
9595 person shall not apply for or possess more than one state-issued or
9696 territory-issued REAL ID Compliant Identification Card pursuant to
9797 the provisions of Section 6 -101 of this title.
9898 The application for an identification c ard by any person under
9999 the age of eighteen (18) years shall be signed and verified by a
100100 custodial legal parent or legal guardian, either in person before a
101101 person authorized to administer oaths or electronically if
102102 completing an online application, or a n otarized affidavit signed by
103103 a custodial legal parent or legal guardian submit ted before a person
104104 authorized to administer oaths by the person under the age of
105105 eighteen (18) years with the application. Provided, that persons
106106 under eighteen (18) years of a ge who are homeless children and
107107 youth, as defined in Section 600 of Title 10 of the Oklahoma
108108 Statutes and verified as such through the process established in
109109 Section 2 601.6d of this act Title 10 of the Oklahoma Statutes ,
110110 shall be allowed to apply for a R EAL ID Noncompliant Identification
111111 Card, which shall be valid for a period of four (4) years from the
112112 month of issuance, without the signature of their parent or legal
113113 guardian. Except as otherwise provided in this section, the

140140 identification cards shall be valid for a period of either four (4)
141141 years from the month of issuance or eight (8) years from the month
142142 of issuance; however, the identification cards issued to persons
143143 sixty-five (65) years of age or older shall be valid indefinitely
144144 from the month of issuance.
145145 B. 1. The Department of Corrections shall coordinate with the
146146 Department of Public Safety to provide REAL ID Noncompliant
147147 Identification Cards to all inmates who do not have a current state -
148148 issued identification card or driver license upon the ir release from
149149 custody. The identification cards shall be issued, replaced,
150150 canceled and denied in the same manner as driver licenses in this
151151 state.
152152 2. The Department of Public Safety shall allow the use of a
153153 certified copy of a birth certificate couple d with a Department of
154154 Corrections-issued consolidated record card to serve as a valid form
155155 of photo identification documentation to obtain a REAL ID
156156 Noncompliant Identification Card.
157157 3. REAL ID Noncompliant Identification Cards issued with a
158158 consolidated record card from the Department of Corrections for
159159 inmates shall be valid for a period of four (4) years from the month
160160 of issuance for an allowable fee to be determined by the Department
161161 of Public Safety and are nonrenewable and nontransferable.
162162 4. The fee charged for the issuance or replacement of a REAL ID
163163 Noncompliant Identifi cation Card pursuant to this subsection shall

190190 be deposited in the Department of Public Safety Revolving Fund.
191191 Provided, however, REAL ID Noncompliant Identification Cards issued
192192 to individuals required to register pursuant to the Sex Offenders
193193 Registration Act shall only be valid for a period of one (1) year.
194194 No person sixty-five (65) years of age or older shall be charged a
195195 fee for a REAL ID Noncompliant Identification Card.
196196 5. The Department of Public Safety is authorized to promulgate
197197 rules and procedures to implement the provisions of this subsection.
198198 C. No person shall hold more than one state -issued or
199199 territory-issued REAL ID Compliant Driver License or REAL ID
200200 Compliant Identification Card, as defined in subsection G of Section
201201 6-101 of this title. The Department shall not issue a REAL ID
202202 Compliant Identification Card to any applicant who has been
203203 previously issued a REAL ID Compliant Driver License or REAL ID
204204 Compliant Identification Card unless such license or identification
205205 card has been surrendered to the Department by the applicant. The
206206 Department may promulgate rules related to the issuance of
207207 replacement REAL ID Compliant Identification Cards in the event of
208208 loss or theft.
209209 D. The fee charged for the issuance or renewal of a REAL ID
210210 Compliant Identification Card shall be Twenty -five Dollars ($25.00)
211211 for a 4-year card and Fifty Dollars ($50.00) for an 8 -year card.
212212 The fee charged for the issuance or renewal of a R EAL ID
213213 Noncompliant Identification Card pursuant to this section shall be

240240 Twenty-five Dollars ($25.00) for a 4 -year card and Fifty Dollars
241241 ($50.00) for an 8-year card; however, no person sixty -five (65)
242242 years of age or older, a high school student who is a t least
243243 fourteen (14) years of age or older, one hundred percent (100%)
244244 disabled veteran described in subsection P of Section 6 -101 of this
245245 title, or persons who are homeless children and youth as defined in
246246 Section 600 of Title 10 of the Oklahoma Statutes and verified
247247 through the process established in Section 2 601.6d of this act
248248 Title 10 of the Oklahoma Statutes shall be charged a fee for an
249249 identification card. Of each fee charged pursuant to the provisions
250250 of this subsection:
251251 1. Seven Dollars ($7.00) of a 4-year card and Fourteen Dollars
252252 ($14.00) of an 8-year card shall be apportioned as provided in
253253 Section 1104 of this title;
254254 2. Three Dollars ($3.00) of a 4 -year card and Six Dollars
255255 ($6.00) of an 8-year card shall be credited to the Department of
256256 Public Safety Computer Imaging System Revolving Fund to be used
257257 solely for the purpose of the administration and maintenance of the
258258 computerized imaging system of the Department;
259259 3. Ten Dollars ($10.00) of a 4 -year card and Twenty Dollars
260260 ($20.00) of an 8-year card shall be deposited in the Department of
261261 Public Safety Revolving Fund;

288288 4. Three Dollars ($3.00) of a 4 -year card and Six Dollars
289289 ($6.00) of an 8-year card shall be deposited to the State Public
290290 Safety Fund created in Section 2 -147 of this title; a nd
291291 5. Two Dollars ($2.00) for a 4 -year card and Four Dollars
292292 ($4.00) for an 8-year card of the fee authorized by this subsection
293293 related to the issuance or renewal of an identification card by a
294294 motor license agent that does process approved applications or
295295 renewals for REAL ID Compliant and REAL ID Noncompliant Driver
296296 Licenses or Identification Cards shall be retained by the licensed
297297 operator through June 30, 2023. Beginning July 1, 2023, these
298298 monies shall be retained by the licensed operator pursuant t o
299299 subsection E of Section 1141.1 of this title.
300300 E. The fee charged for replac ement of a REAL ID Compliant
301301 Identification Card, or REAL ID Noncompliant Identification Card,
302302 shall be Twenty-five Dollars ($25.00); however, no person sixty -five
303303 (65) years of age or older shall be charged a fee for an
304304 identification card replacement. Of each fee charged pursuant to
305305 the provisions of this subsection:
306306 1. Seven Dollars ($7.00) shall be apportioned as provided in
307307 Section 1104 of this title;
308308 2. Three Dollars ($3. 00) shall be credited to the Department of
309309 Public Safety Computer Imaging Syst em Revolving Fund to be used

338338 3. Ten Dollars ($10.00) shall be deposited in the Department of
339339 Public Safety Revolving Fund;
340340 4. Three Dollars ($3.00) shall be deposited to the State Public
341341 Safety Fund created in Section 2 -147 of this title; and
342342 5. Two Dollars ($2.00) of the fee authorized by this subsection
343343 related to the replacement of an identification card by a motor
344344 license agent that does process approved applications or renewals
345345 for REAL ID Compliant or REAL ID Noncompliant Driver Licenses or
346346 Identification Cards shall be retained by the licensed operator
347347 through June 30, 2023. Beginning July 1, 2023, these monies shall
348348 be retained by the licensed operator pursuant to subsection E of
349349 Section 1141.1 of this title.
350350 F. The Oklahoma Tax Commission is hereby authorized to
351351 reimburse, from funds available to that agen cy, each motor license
352352 agent issuing an identification card to a person sixty -five (65)
353353 years of age or older, an amount not to exceed One Dollar ($1.00)
354354 for each card or driver license so issued through June 30, 2023.
355355 The Tax Commission shall develop pro cedures for claims for
356356 reimbursement.
357357 G. Notwithstanding any other provision of law, when a person
358358 makes application for a new identification card, or makes
359359 application to renew an identification card, and the person has been
360360 convicted of, or received a d eferred judgment for, any offense
361361 required to register pursuant to the Sex Off enders Registration Act,

388388 the identification card shall be valid for a period of one (1) year
389389 from the month of issuance, but may be renewed yearly during the
390390 time the person is s ubject to registration on the Sex Offender
391391 Registry. The cost for such identification card shall be the same
392392 as for other identification cards and renewals.
393393 H. Nothing in this section requires or authorizes the
394394 Department of Public Safety to issue a REAL ID Noncompliant
395395 Identification Card without the documentation required by the
396396 provisions of paragraph 9 of subsection A of Section 6 -103 of this
397397 title.
398398 SECTION 2. This act shall become effective November 1, 2025.
