4049 An Act relating to wind energy facilities; defining
4150 terms; prohibiting construction or modification of
4251 wind energy facilities with respect to certain
4352 military facilities; defining adverse impact with
4453 respect to military facilities; prescribing
4554 procedures; requiring fil ing of application;

5665 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5766 SECTION 1. NEW LAW A new section of law to be codified
5867 in the Oklahoma Statutes as Section 240.1 of Title 44, unless there
5968 is created a duplication in numbering, reads as follows:
6069 As used in this act:
61-1. "Clearinghouse" means the Military Aviation and Installation
62-Assurance Siting Clearinghouse established by the United States
63-Secretary of Defense under 10 U.S.C., Section 183(a);
64-2. "Commencement of construction" means begi nning excavation of
65-wind turbine foundations or other actions relating to the actual

97+1. "Clearinghouse" means the Military Aviation and Installation
98+Assurance Siting Clearinghouse established by the United States
99+Secretary of Defense under 10 U.S.C., Section 183(a);
100+2. "Commencement of construction" means beginning excavation of
101+wind turbine foundations or other actions relating to the actual
92102 erection and installation of commercial wind energy equipment.
93103 Commencement of construction does not include activities relat ed to:
94104 a. the erection of meteorological towers,
95105 b. environmental assessments,
96106 c. surveys,
97107 d. preliminary engineering, or
98108 e. assessments of the development of the wind resources
99109 on a given parcel of property ;
100110 3. "Department" means the Oklahoma Military De partment;
101111 4. "Determination of no hazard" means the formal response
102112 issued by the FAA upon completion of an aeronautical study regarding
103113 a facility structure's impact to air navigation affirming that:
104114 a. the facility structure does not exceed obstruction
105115 standards, and
106116 b. modifications to the facility structure are not
107117 required;
108118 5. "FAA" means the United States Federal Aviation
109119 Administration;
110-6. "Facility structure" means a wind turbine or other structure
111-located on a wind energy facility, the construction or modification
112-of which would require th e completion of Form 74 60-1;
113-7. "Form 7460-1" means:
114-a. FAA Form 7460-1 Notice of Proposed Construction or
115-Alteration, which the FAA uses to conduct aeronautical

147+6. "Facility structure" means a wind turbine or other structure
148+located on a wind energy facility, the construct ion or modification
149+of which would require the completion of Form 74 60-1;
150+7. "Form 7460-1" means:
151+a. FAA Form 7460-1 Notice of Proposed Construction or
152+Alteration, which the FAA uses to conduct aeronautical
142153 studies to promote air safety and the efficient use of
143154 navigable airspace, as required under 14 C.F.R., Part
144155 77, or
145156 b. a form designated by the FAA to conduct aeronautical
146157 studies to promote air safety and the efficient use of
147158 navigable airspace;
148159 8. "Mission compatibility certification letter" means th e
149160 formal response the Clearinghouse issues through the Clearinghouse's
150161 review of proposed projects and facility structures through the
151162 Clearinghouse's evaluation process;
152163 9. "Owner" means a person having a majority equity interest in
153164 a commercial wind ene rgy facility;
154165 10. "Wind energy facility" means an electrical generation
155166 consisting of one or more wind turbines under common ownership or
156167 operating control. Wind energy facility includes the infrastructure
157168 necessary to support the generation of electrici ty by one or more
158169 wind turbines, including:
159170 a. substations,
160-b. meteorological data towers,
161-c. aboveground and underground electrical transmission
162-lines,
163-d. transformers,
164-e. control systems, and

191203 f. other structures used to support the operation of the
192204 facility with the primary purpose of supplying
193205 electricity to an off -site customer; and
194206 11. "Wind turbine" means a wind energy conversion system that
195207 converts wind energy into electricity through the use of a wind
196208 turbine generator. Wind turbine includes the turbine, blade, tower,
197209 base, and pad transformer.
198210 SECTION 2. NEW LAW A new section of law to be codified
199211 in the Oklahoma Statutes as Section 240.2 of Title 44, unless there

201213 A. Construction or modification of a facility structure may not
202214 encroach upon or otherwise have an adverse impact on the mission,
203215 training, or operations of any military installation or branch of
204216 the military as determined by the Clearinghouse and the FAA.
205217 B. An adverse impact to a military installation or branch of
206218 the military as described in subsection A of this section includes
207219 an adverse impact to:
208220 1. A military training route;
209221 2. A drop zone;
210-3. An approach to a runway;
211-4. A test or training range;
212-5. A military installation or facility;
213-6. United States Department of Defense special use air space;

249+3. An approach to a runway;
250+4. A test or training range ;
251+5. A military installation or facility;
252+6. United States Department of Defense special use air space;
253+and
241254 7. United States Department of Defense spectral requirements.
242255 C. A facility structure may not be constructed or expanded
243256 unless:
244257 1. There is an active determination of no hazard; or
245258 2. Any adverse impacts to the Unit ed States Department of
246259 Defense, determined in accordance with 32 C.F.R., Section 211.6, or
247260 the National Defense Authorization Act have been resolved as
248261 evidenced by documentation fr om the Clearinghouse for the facility
249262 structure and the Department.
250263 D. For purposes of paragraph 2 of subsection C of this section,
251264 a mission compatibility certification letter may serve as evidence
252265 that the wind energy facility has resolved adverse impac ts with the
253266 United States Department of Defense or successor agency.
254267 E. Before expanding or constructing a facility structure, and
255268 within thirty (30) days of submitting an application to the FAA, an
256269 owner shall file a copy of the FAA application with the Department.
257270 F. Within fifteen (15) days of receiving a copy of the FAA
258271 application to construct a wind energy site, the Oklahoma Military
259-Department will provide a copy of the application to the affected
260-military entities.
261-G. The Department may serve in a coordination role with the
262-owner and the affected military entity.

299+Department will provide a copy of the application to the affected
300+military entities.
301+G. The Department may serve in a coordination role with the
302+owner and the affected military entity.
289303 H. Within thirty (30) days of receiving final notification from
290304 the FAA or a Notice of Presumed Risk from the Department of Defense,
291305 the owner shall provide the Department a copy of the documentation.
292306 I. The Department may make rules in accordance with the
293307 Oklahoma Administrative Procedures Act to administer this section.
294308 J. The documentation an owner submits in accordance with
295309 subsections E and H of this section:
296310 1. Shall only be use d and disclosed by the Department in
297311 accordance with this section;
298312 2. Is confidential, not public, and not open to public
299313 inspection; and
300314 3. Is not subject to the Oklahoma Open Records Act.
301315 K. If an owner fails to submit the documentation described in
302316 subsections E and H of this section for an individual facility
303317 structure:
304318 1. The Department may charge the owner an administrative
305319 penalty not to exceed One Thousand Five Hundred Dollars ($1,500.00)
306320 per day, per violation; and
307321 2. A stakeholder, including the Department, may bring an action
308322 in court to:
309-a. enjoin any action on a facility structure in violation
310-of this section, and
311-b. enforce the requirements o f this section.
312-SECTION 3. This act shall become effective November 1, 2025.
