4040 An Act relating to torts; defining term; creating
4141 limitation of action for body dysmorphia affirmation
4242 procedures; providing for codificati on; and providing
4343 an effective date.

4848 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4949 SECTION 1. NEW LAW A new section of law to be codified
5050 in the Oklahoma Statutes as Section 18A of Title 76, unless there is
5151 created a duplication in numbering, reads as follows:
5252 A. As used in this section:
5353 1. "Anorexia affirmation procedures" means the following
5454 medical or surgical services performed for the purpose of attempting
5555 to affirm the perception of a person diagnosed with anorexia nervosa
5656 about his or her body weight, if that perception is inconsistent
5757 with the actual, current body weight of the person:
5858 a. surgical procedures intended to result in weight loss,
5959 also known as bariatric surgeries, or
6060 b. weight-loss drugs, or other drugs to suppress hunger
6161 or appetite;

8888 2. a. "BIID affirmation procedures " means medical or
8989 surgical services performed for the purpose of
9090 attempting to affirm the perception of a person
9191 diagnosed with Body Integrity Identity Disorder about
9292 his or her body, if that perception is inconsistent
9393 with the actual, current physique of the person .
9494 b. BIID affirmation procedures include surgical
9595 procedures that amputate or remove healthy body parts
9696 without a clear physical and medical need including,
9797 but not limited to, leg, arm, finger, toe, eye, ear,
9898 tongue, lip, or nose;
9999 3. a. "Gender transition procedures " means the following
100100 medical or surgical services performed for the purpose
101101 of attempting to affirm the person's perception of his
102102 or her gender or biolo gical sex, if that perception is
103103 inconsistent with the person's biological sex:
104104 (1) surgical procedures that alter or remove physical
105105 or anatomical characteristics or features that
106106 are typical for the individual’s biological sex,
107107 or
108108 (2) puberty-blocking drugs, cross-sex hormones, or
109109 other drugs to suppress or delay normal puberty
110110 or to promote the development of feminizing or

137137 masculinizing features consistent with the
138138 opposite biological sex.
139139 b. Gender transition procedures do not include:
140140 (1) behavioral health care services or mental health
141141 counseling,
142142 (2) medications to treat depression and anxiety,
143143 (3) medications prescribed, dispensed, or
144144 administered specifically for the purpose of
145145 treating precocious puberty or delayed puberty in
146146 that patient,
147147 (4) services provided to individuals born with
148148 ambiguous genitalia, incomplete genital ia, or
149149 both male and female anatomy, or biochemically
150150 verifiable disorder of sex development (DSD),
151151 including but not limited to:
152152 (a) 46,XX DSD,
153153 (b) 46,XY DSD,
154154 (c) sex chromosomes DSDs,
155155 (d) XX or XY sex reversal, and
156156 (e) ovotesticular disorder,
157157 (5) the treatment of any infection, injury, disease,
158158 or disorder that has been caused by or
159159 exacerbated by the performance of gender
160160 transition procedures, whether or not the gender

187187 transition procedure was performed in accordance
188188 with state and federal law ,
189189 (6) the treatment of any physical injury or illness
190190 that would, as certified by a physician, place
191191 the individual in imminent danger of death or
192192 impairment of a major bodily function unl ess such
193193 treatment is performed, or
194194 (7) the provision of puberty -blocking drugs or cross -
195195 sex hormones to a person currently receiving such
196196 drugs or hormones as of the effective date of
197197 this act for a period of not more than six (6)
198198 months solely for the pu rpose of assisting the
199199 person with gradually decreasing and
200200 discontinuing use of the drugs or hormones.
201201 4. "Body dysmorphia affirmation procedures" means a general
202202 term encompassing gender transition procedures, anorexia affirmation
203203 procedures, and BIID a ffirmation procedures ;
204204 5. “Health care provider” means a physician, physician
205205 assistant, Advanced Practice Registered Nurse, or any other person
206206 who is licensed, certified, or otherwise authorized by the laws of
207207 this state to administer health care in the ordinary course of the
208208 practice of his or her profession.
209209 B. An action for damages for injury or death against any health
210210 care provider or hospital licensed under the laws of this state,

237237 whether based in tort, breach of contract or otherwise, arising out
238238 of body dysmorphia affirmation procedures, shall be brought within
239239 twenty (20) years of the date the plaintiff knew or should have
240240 known, through the exercise of reasonable diligence, of the
241241 existence of the death, injury , or condition complained of;
242242 provided, however, the minority or incompetency when the cause of
243243 action arises shall extend said period of limitation.
244244 SECTION 2. This act shall become effective November 1, 2025.
