40	40	An Act relating to crimes and punishments; making
41	41	certain acts unlawful; providing penalties; defining
42	42	terms; providing for codification; a nd providing an

48	48	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	49	SECTION 1. NEW LAW A new section of law to be codified
50	50	in the Oklahoma Statutes as Section 1761.2 of Title 21, unless there
51	51	is created a duplication in numbering, reads as follows:
52	52	A. A person shall not establish an unauthorized camp upon a
53	53	street, sidewalk, or other public or private property within five
54	54	hundred (500) feet of public school or private school property.
55	55	B. Any person who violates the provisions of this section and
56	56	refuses to vacate the unauthorized camp upon command by a law
57	57	enforcement officer shall , upon conviction, be guilty of a
58	58	misdemeanor punishable by a fine not to exceed Fifty Dollars
59	59	($50.00), or by imprisonment i n the county jail not to exceed one
60	60	(1) year, or by both such fine and impriso nment.

88	88	1. "Private school property " means a school that offers a
89	89	course of instruction for students in one or more grades from
90	90	prekindergarten throu gh grade twelve and is not operated by a
91	91	governmental entity;
92	92	2. "Public school property " means any publicly owned property
93	93	held for purposes of elementary, secondary or vocational -technical
94	94	education, and shall not include property owned by public school
95	95	districts or where such property is leased or rented to an
96	96	individual or corporation and used for purposes other than
97	97	educational; and
98	98	3. "Unauthorized camp" means any tent, shelter, or bedding
99	99	constructed or arranged for the purpose of or in such a way to
100	100	permit overnight use on a property not designated as a campsite.
101	101	SECTION 2. This act shall become effective November 1, 2025.
