59	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	57		SECTION 1. NEW LAW A new section of law to be codified
61	58		in the Oklahoma Statutes as Section 24 -162 of Title 70, unless there
62	59		is created a duplicati on in numbering, reads as follows:
63	60		A. This act shall be known and may be cited as the "Federal
64	61		Education Guidance Disclosure Act".
65	62		B. Within five (5) days of receiving a guidance document from
66	63		the United States Department of Education, the State Departme nt of
67	64		Education shall publ ish the guidance document on an Internet website

96	92		the guidance document contains sensitive or confidential information
97	93		not legal to disclose due to privacy laws.
98	94		C. 1. The State Department of Education shall create the
99	95		designated Internet website for publication described in subsection
100	96		B of this section no later than ninety (90) days after the effective
101	97		date of this act.
102	98		2. The State Department of Education shall include hyperlinks
103	99		on the Internet website, in a conspicuous manner, that provide
104	100		access to the guidance documents received pursuant to subsection B
105	101		of this section.
106	102		D. If a guidance document is rescinded by the United States
107	103		Department of Education, the State Department of Education shall
108	104		maintain the rescinded guidance document at the location described
109	105		in subsection C of this section and indicate within fifteen (15)
110	106		days of such rescission:
111	107		1. That the document has been rescinded; and
112	108		2. The date the document was rescinded.
113	109		E. For purposes of this section, "guidance document" means a
114	110		federal agency statement of general applicability, other than a rule
115	111		that has the force and effect of law promulgated in accordance with
116	112		the notice and comment procedure s under 5 U.S.C., Section 553, that
117	113		is designated by an agency official as setting forth a policy or
118	114		interpretation on a statutory, regulatory, or technical issue. A

148	143		guidance document shall be construed broadly to effectuate the
149	144		purpose and intent of this act.
150	145		SECTION 2. This act shall become effective November 1, 2025.
