5956 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6057 SECTION 1. NEW LAW A new section of law to be codified
6158 in the Oklahoma Statutes as Section 24 -162 of Title 70, unless there
6259 is created a duplicati on in numbering, reads as follows:
6360 A. This act shall be known and may be cited as the "Federal
6461 Education Guidance Disclosure Act".
6562 B. Within five (5) days of receiving a guidance document from
6663 the United States Department of Education, the State Departme nt of
6764 Education shall publ ish the guidance document on an Internet website
65+designated by the State Superintendent of Public Instruction unless

95-designated by the State Superintendent of Public Instruction unless
9692 the guidance document contains sensitive or confidential information
9793 not legal to disclose due to privacy laws.
9894 C. 1. The State Department of Education shall create the
9995 designated Internet website for publication described in subsection
10096 B of this section no later than ninety (90) days after the effective
10197 date of this act.
10298 2. The State Department of Education shall include hyperlinks
10399 on the Internet website, in a conspicuous manner, that provide
104100 access to the guidance documents received pursuant to subsection B
105101 of this section.
106102 D. If a guidance document is rescinded by the United States
107103 Department of Education, the State Department of Education shall
108104 maintain the rescinded guidance document at the location described
109105 in subsection C of this section and indicate within fifteen (15)
110106 days of such rescission:
111107 1. That the document has been rescinded; and
112108 2. The date the document was rescinded.
113109 E. For purposes of this section, "guidance document" means a
114110 federal agency statement of general applicability, other than a rule
115111 that has the force and effect of law promulgated in accordance with
116112 the notice and comment procedure s under 5 U.S.C., Section 553, that
117113 is designated by an agency official as setting forth a policy or
118114 interpretation on a statutory, regulatory, or technical issue. A
115+guidance document may include, but is not limited to, a memorandum,

146-guidance document may include, but is not limited to, a memorandum,
147142 notice, bulletin, dir ective, letter, or no -action letter. The term
148143 guidance document shall be construed broadly to effectuate the
149144 purpose and intent of this act.
150145 SECTION 2. This act shall become effective November 1, 2025.
