5059 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5160 SECTION 1. NEW LAW A new section of law to be codified
5261 in the Oklahoma Statutes as Section 1501 of Title 60, unless there
5362 is created a duplication in numbering, reads as follows:
54-A. Utility scale solar energy and associated battery storage
55-facilities, excluding residential solar energy panels, shall have
56-the following setback requirem ents:
57-1. Shall not be located within five hundred (500) feet of an
58-occupied residence unle ss waived in writing by the owner of the
59-residence;
60-2. Shall not be located within fifty (50) feet of any outer
61-boundary of the facility property;
63+A. Solar energy and indust rial battery storage facilities,
64+excluding residential solar energy panels, shall have the following
65+setback requirements:

93+1. Shall not be located within five hundred (500) feet of an
94+occupied structure or occupied residence unless waived in writing by
95+the owner of the structure or residence;
96+2. Shall not be located within fifty (50) feet of any outer
97+boundary of the facility property;

8999 centerline of any public road; and
90100 4. Shall not be locat ed within a half (1/2) mile from any
91101 public school or hospital.
92-B. This act shall apply to ten (10) megawatt and larger solar
93-energy and associated battery storage facilities. Furthermore, this
94-act shall apply to any project in development t hat does not yet have
95-an interconnection agreement in place on or after the effective date
96-of this act.
102+B. This act shall apply to 10 megawatt and larger solar energy
103+and industrial battery storage facilities. Furthermore, this act
104+shall apply to any project in development that does not yet ha ve a
105+power purchase agreement in place on or after the effective date of
106+this act.
97107 SECTION 2. It being immediately necessary for the preservation
98108 of the public peace, health or safety, an emergency is hereby
99109 declared to exist, by reason wh ereof this act shall take effect and
100110 be in full force from and after its passage and approval.
