5058 BE IT ENACTED BY THE PEOPLE OF THE S TATE OF OKLAHOMA:
5159 SECTION 1. NEW LAW A new section of law not to be
5260 codified in the Oklahoma Statutes reads as follows:
5361 A. The Oklahoma Legislature finds that:
54-1. To maintain strong economic growth and to improve the
55-quality of life of its citizens, the electrical generation capacity
56-within the State of Oklahoma must increase significantly over time;
57-2. Along with our traditional abundance of natural gas
58-generation, the growth of various renewable energy projects could

85-significantly expand the renewable energy footprint which could
86-potentially impact agriculture production;
89+1. To maintain strong e conomic growth and to improve the
90+quality of life of its citizens, the electri cal generation capacity
91+within the State of Oklahoma must increase significantly over time;
92+2. Much of this required generation capacity will, by
93+necessity, be provided by renew able energy projects that have a
94+significant footprint which could potentially impact agriculture
95+production;
8796 3. There are strategies for both the siting and construction of
8897 these renewable energy projects that could minimize this impact on
8998 farming and ranching and in some cases assist in improving ov erall
9099 agriculture productivity; and
91100 4. It is in the interest of the public that the State of
92-Oklahoma develop a legislative strategy designed to maintain
93-agricultural productivity along with renewable energy development in
94-a way that works in harmony with farming and ran ching.

151161 distribution of electrical energy to be appointed by the Speaker of

156-11. One member who is a designee of the Oklahoma Center for the

186198 B. Members of the Committee shall serve wit hout compensation
187199 but shall be reimbursed for t heir actual and necessary expen ses as
188-provided in the State Travel Reimbursement Act. The Oklahoma Center
189-for the Advancement of Science and Technology (OCAST) shall provide
190-space for meetings of the Committee and shall provide other
191-assistance and staffing needs of the Committee.

199211 help in the siting and construction of renewable energy projects and
200212 transmission systems in a manner supportive of farming, ranching,
201213 and forestry, including agritourism and outdoor recreation leases;
202-3. Develop for consideration by the Oklahoma Legislature, the

236249 materials regarding the development of agrivoltaics in Oklahoma and
237250 to inform both landowners and the renewable energy industry on
238251 strategies designed to encourage the development of renewable energy
239252 generation in a manner suppor ting farming, ranching , and forestry,
240253 including agritourism and outdoor recreation leases; and
241254 5. Identify and recommend areas of research needed on the
242255 development of agrivoltaics and the siting and construc tion of
243256 renewable energy projects and transmiss ion systems in a manner
244257 designed to minimize their impact on production agriculture and
245258 forestry, including agritourism and outdoor recreation leases.
246259 SECTION 4. NEW LAW A new section o f law to be codified
247-in the Oklahoma Statutes as Section 5060.48 of Title 74, unless
248-there is created a duplication in numbering, reads as follows:
249-On or before January 1, 2026, the Oklahoma Center for the
250-Advancement of Science and Technology , in consultation with the
251-Oklahoma Agrivoltaics Advisory Committee, shall prepare a report and
252-submit to the Legislature. The report shall include, bu t shall not
253-be limited to:
254-1. A list and explanation of existing tools and government
255-initiatives designed to help in the siting and construction of
256-renewable energy projects and transmission systems in a manner
260+in the Oklahoma Statutes a s Section 852 of Title 17, unle ss there is

262+On or before January 1, 2026, the Corporation Commission, in

292305 3. Recommended areas of research n eeded on the development of
293306 agrivoltaics and the siting and construction of renewable energy
294307 projects and transmission systems in a manner designed to minimize
295308 their impact on production agriculture and forestry, including
296309 agritourism and outdoor recreation leases.
297310 SECTION 5. NEW LAW A new section of law to be codified
298-in the Oklahoma Statutes as Section 5060.49 of Title 74, unless

300313 There is hereby created in the State Treasur y a revolving fund
301-for the Oklahoma Center for the Advancement of Science and
302-Technology (OCAST), to be designated the "Oklahoma Agrivoltaics Cash
303-Revolving Fund". The fund shall be a continuing fund, not subject
304-to fiscal year limitations, and shall consist of all mon ies
305-designated for deposit to said fund, including any money received as
306-gifts, grants, or other contributions from public or private
314+for the Corporation Commission, to be designated the "Oklahoma

333-sources. All monies accruing to the credit of said fund are hereby
334-appropriated and may be budgeted and shall be expended by OCAST for
335-the purposes of carrying out the provisions of the Oklahoma
336-Agrivoltaics Act. Expenditures from said fund shall be made upon
337-warrants issued by the State Treasurer against claims filed as
338-prescribed by law with the Director of the Office of Management and
339-Enterprise Services for approval and payment. No money shall be
340-transferred or expended by OCAST for any other purpose than that
341-authorized by this section.
342+Agrivoltaics Cash Revolving Fund ". The fund shall be a continuing
343+fund, not subject to fiscal y ear limitations, and shall consist of
344+all monies designated for deposit to said fund, including any money
345+received as gifts, grants , or other contributions from public or
346+private sources. All monies accruing to the credit of said fund are
347+hereby appropriated and may be budgeted and shall be expended b y the
348+Corporation Commission fo r the purposes of carrying out the
349+provisions of the Oklahoma Agrivoltaics Act. Expenditures from said
350+fund shall be made upon warrants issued by the State Treasurer
351+against claims filed as prescribed by law with the Directo r of the
352+Office of Management and Enterprise Services for approval and
353+payment. No money shall be transferred or expended by the
354+Corporation Commission for any other purpose than that authorized by
355+this section.
342356 SECTION 6. It being immediately necessary for the preserv ation
343357 of the public peace, health or safety, an emergency is hereby
344358 declared to exist, by reason whereof this act shall take effect and
345359 be in full force from and after its passag e and approval.
