60 | 58 | | the "Terry Peach North Canadian Watershed Water Restoration Act". |

93 | 90 | | 1. "Commission" means the Oklahoma Conservation Commission; |

94 | 91 | | 2. "Harmful woody species " means a tree or shrub species that |
---|
95 | 92 | | is rapidly encroaching into adjoining lands and is likely to cause |
---|
96 | 93 | | harm to the environment or economy. Harmful woody species include, |
---|
97 | 94 | | but are not limited to, Juniperus virginiana (Eastern Redcedar), |
---|
98 | 95 | | Juniperus scopulorum (Rocky Mountain jun iper), Juniperus monosperma |
---|
99 | 96 | | (oneseed juniper) and, Tamarix ramosissima (salt cedar) , Juniperus |
---|
100 | 97 | | pinchotii (Redberry juniper), Juniper ashei (ashe juniper), and |
---|
101 | 98 | | Prosopis glandulosa (honey mesquite) ; and |
---|
102 | 99 | | 3. "North Canadian Watershed" means the an area of land in |
---|
103 | 100 | | Oklahoma that drains or sheds water into the North Canadian River a |
---|
104 | 101 | | waterway or water basin . |
---|
105 | 102 | | B. There is hereby created a pilot statewide program to remove |
---|
106 | 103 | | or eradicate harmful woody species in the North Canadian Watershed |
---|
107 | 104 | | watersheds to be administered by the Oklahoma Conservation |
---|
108 | 105 | | Commission. To accomplish the goals listed in this section, the |
---|
109 | 106 | | Commission is authorized to use the funds available in the North |
---|
110 | 107 | | Canadian Watershed Water Restoration Revolving Fund established in |
---|
111 | 108 | | Section 3 of this act Section 3-8-103 of this title. The purpose of |
---|
112 | 109 | | the program is to manage and eradicate, where possible, harmful |
---|
113 | 110 | | woody species that damage grazing lands, create significant wildfire |
---|
144 | 140 | | 1. Cooperate with landowners, state agencies, and other |
---|
145 | 141 | | political subdivisions for removal of harmful woody species; |
---|
146 | 142 | | 2. Measure the density of harmful woody specie s and estimate |
---|
147 | 143 | | water used by those species; |
---|
148 | 144 | | 3. Create a study using a parallel watershed with no control of |
---|
149 | 145 | | harmful woody species; |
---|
150 | 146 | | 4. Utilize available funds to cost -share with landowners for |
---|
151 | 147 | | expenses incurred in the eradication of harmful woody species by |
---|
152 | 148 | | prescribed burn, biological controls, mechanical removal, or |
---|
153 | 149 | | herbicide applications; |
---|
154 | 150 | | 5. Develop grant programs with conservation districts, rural |
---|
155 | 151 | | fire departments, and prescribe burn associations for resources |
---|
156 | 152 | | needed for prescribed burns, mechanical re moval, biological control, |
---|
157 | 153 | | or herbicide applications on harmful woody species; |
---|
158 | 154 | | 6. Bring attention to the problems posed by harmful woody |
---|
159 | 155 | | species to create awareness, demonstrate value to all stakeholders, |
---|
160 | 156 | | and encourage landowners to participate in the pro gram; and |
---|
161 | 157 | | 7. Have at least two active project areas in the program, one |
---|
162 | 158 | | above the Canton Lake dam and one below. |
---|
163 | 159 | | D. The Commission is authorized to promulgate any rules and |
---|
164 | 160 | | procedures to effectuate the provisions of this section. |

195 | 190 | | Section 3-8-103. There is hereby created in the State Treasury |
---|
196 | 191 | | a revolving fund for the Oklahoma Conservation Commission to be |
---|
197 | 192 | | designated the "North Canadian Watershed Water Restoration Revolving |
---|
198 | 193 | | Fund". The fund shall be a continuing fund, not subject to fiscal |
---|
199 | 194 | | year limitations, and shall consist of all monies received by the |
---|
200 | 195 | | Conservation Commission from appropriations, federa l grants or |
---|
201 | 196 | | funds, municipal contributions, private contributions, and any other |
---|
202 | 197 | | sources, including interest earned from the income in the fund, that |
---|
203 | 198 | | are designated for deposit to such fund or designated for duties |
---|
204 | 199 | | associated with harmful woody species rem oval from the North |
---|
205 | 200 | | Canadian Watershed watersheds throughout the state . All monies |
---|
206 | 201 | | accruing to the credit of said fund are hereby appropriated and may |
---|
207 | 202 | | be budgeted and expended by the Conservation Commission to perform |
---|
208 | 203 | | the duties imposed on the Commission by law. Expenditures from said |
---|
209 | 204 | | fund shall be made upon warrants issued by the State Treasurer |
---|
210 | 205 | | against claims filed as prescribed by law with the Director of the |
---|
211 | 206 | | Office of Management and Enterprise Services for approval and |
---|
212 | 207 | | payment. |
---|
213 | 208 | | SECTION 4. This act shall become effective November 1, 2025. |
