67	64		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
68	65		SECTION 1. NEW LAW A new section of law to be codified
69	66		in the Oklahoma Statutes as Section 401 of Title 16, unless there is
70	67		created a duplication in numbering, reads as follows:
	68	+	This act shall be known and may be cited as the " Oklahoma
	69	+	Uniform Unlawful Restrictions in Land Records Act".

98		-	This act shall be known and may be cited as the "Oklahoma
99		-	Uniform Unlawful Restrictions in Land Records Act".
100	96		SECTION 2. NEW LAW A new section of law to be codified
101	97		in the Oklahoma Statutes as Section 402 of Title 16, unless th ere is
102	98		created a duplication in numbering, reads as fo llows:
103	99		As used in this act:
104	100		1. "Amendment" means a document that removes an unlawful
105	101		restriction;
106	102		2. "Document" means a record recorded or eligible to be
107	103		recorded in land records;
108	104		3. "Governing instrument" means a document recorded in land
109	105		records that:
110	106		a. establishes a governing body responsible for
111	107		management of common areas or facilities used by more
112	108		than one owner of a property interest affected by the
113	109		document, and
114	110		b. requires contribution, enfor ceable by a lien on a
115	111		separate property interest, of a share of taxes,
116	112		insurance premiums, maintenance, or improvement of, or
117	113		services or other expenses for the common benefit of,
118	114		the real property described in the document;
119	115		4. "Index" means a system that enables a search for a document
120	116		in land records;

148		-	5. "Land records" means documents and indexes maintained by a
149		-	recorder;
150	145		6. "Owner" means a person that has a fee interest in real
151	146		property;
152	147		7. "Person" means an individual, estate, business or nonprofit
153	148		entity, government or governmental subdivision, agency , or
154	149		instrumentality, or other legal entity;
155	150		8. "Record", used as a noun, means information:
156	151		a. inscribed on a tangible medium, or
157	152		b. stored in an electronic or other medium and
158	153		retrievable in perceivable form;
159	154		9. "Recorder" means an officer authorized u nder other laws of
160	155		this state to accept a document for recordation in land records;
161	156		10. "Remove" means eliminate any apparent or purportedly
162	157		continuing effect on title to real property; and
163	158		11. "Unlawful restriction" means a prohibition, restriction,
164	159		covenant, or condition in a document that purports to interfere with
165	160		or restrict the transfer, use, or occupancy of real property:
166	161		a. on the basis of race, color, religion, national
167	162		origin, sex, familial status, disability, or other
168	163		personal characteristics, and
169	164		b. in violation of other laws of this state or federal
170	165		law.

201	195		Except with respect to property to which Section 4 of this act
202	196		applies, an owner of real property subject to an unlawful
203	197		restriction may submit to the recorder for recordation in the land
204	198		records an amendment to remove the unlawful restriction, b ut only as
205	199		to the owner's property.
206	200		SECTION 4. NEW LAW A new section of law to be codified
207	201		in the Oklahoma Statutes as Section 404 of Title 16, unless there is
208	202		created a duplication in numbering, reads as follows:
209	203		A. The governing body of an owners association identified in a
210	204		governing instrument may, without a vote of the members of the
211	205		association, amend the governing instrument to remove an unlawful
212	206		restriction.
213	207		B. A member of an owners association may request, in a record
214	208		that sufficiently identifies an unlawful restriction in the
215	209		governing instrument, that the governing body exercise its authority
216	210		under subsection A of this section. Not later than ninety (90) days
217	211		after the governing body receives the request, the governing bo dy
218	212		shall determine reasonably and in good faith whether the governing
219	213		instrument includes the unlawful restriction. If the governing body
220	214		determines the governing instrument includes the unlawful
221	215		restriction, the governing body, not later than ninety (90) days
	216	+	after the determination, shall amend the governing instrument to
	217	+	remove the unlawful restriction.

250		-	remove the unlawful restriction.
251	244		C. Notwithstanding any provision of the governing instrument or
252	245		other laws of this state, the gov erning body may execute an
253	246		amendment under this sectio n.
254	247		D. An amendment under this section is effective notwithstanding
255	248		any provision of the governing instrument or other law of this state
256	249		that requires a vote of the members of the owners association to
257	250		amend the governing instrument.
258	251		SECTION 5. NEW LAW A new section of law to be codified
259	252		in the Oklahoma Statutes as Section 405 of Title 16, unless there is
260	253		created a duplication in numbering, reads as follows:
261	254		A. An amendment under this act must identify the owner, the
262	255		real property affected, and the document containing the unlawful
263	256		restriction. The amendment must include a conspicuous statement in
264	257		substantially the following form:
265	258		"This amendment removes from this deed or other document
266	259		affecting title to real property an unlawful re striction as defined
267	260		under the Oklahoma Uniform Unlawful Restrictions in Land Records
268	261		Act. This amendment does not affect the validity or enforceability
269	262		of a restriction that is not an unlawful restric tion."
270	263		B. The amendment must be executed and acknowle dged in the
271	264		manner required for recordation of a document in the land records.
272	265		The amendment must be recorded with the county clerk in the county
	266	+	in which the document containing the unlawful restriction is
	267	+	recorded.

303	295		of any restriction that is not an unlawful restriction.
304	296		D. The amendment or a future conveyance of the affected real
305	297		property is not a republication of a restriction that oth erwise
306	298		would expire by passage of time under other law of this state.
