6764 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
6865 SECTION 1. NEW LAW A new section of law to be codified
6966 in the Oklahoma Statutes as Section 401 of Title 16, unless there is
7067 created a duplication in numbering, reads as follows:
68+This act shall be known and may be cited as the " Oklahoma
69+Uniform Unlawful Restrictions in Land Records Act".

98-This act shall be known and may be cited as the "Oklahoma
99-Uniform Unlawful Restrictions in Land Records Act".
10096 SECTION 2. NEW LAW A new section of law to be codified
10197 in the Oklahoma Statutes as Section 402 of Title 16, unless th ere is
10298 created a duplication in numbering, reads as fo llows:
10399 As used in this act:
104100 1. "Amendment" means a document that removes an unlawful
105101 restriction;
106102 2. "Document" means a record recorded or eligible to be
107103 recorded in land records;
108104 3. "Governing instrument" means a document recorded in land
109105 records that:
110106 a. establishes a governing body responsible for
111107 management of common areas or facilities used by more
112108 than one owner of a property interest affected by the
113109 document, and
114110 b. requires contribution, enfor ceable by a lien on a
115111 separate property interest, of a share of taxes,
116112 insurance premiums, maintenance, or improvement of, or
117113 services or other expenses for the common benefit of,
118114 the real property described in the document;
119115 4. "Index" means a system that enables a search for a document
120116 in land records;
117+5. "Land records" means documents and indexes maintained by a
118+recorder;

148-5. "Land records" means documents and indexes maintained by a
149-recorder;
150145 6. "Owner" means a person that has a fee interest in real
151146 property;
152147 7. "Person" means an individual, estate, business or nonprofit
153148 entity, government or governmental subdivision, agency , or
154149 instrumentality, or other legal entity;
155150 8. "Record", used as a noun, means information:
156151 a. inscribed on a tangible medium, or
157152 b. stored in an electronic or other medium and
158153 retrievable in perceivable form;
159154 9. "Recorder" means an officer authorized u nder other laws of
160155 this state to accept a document for recordation in land records;
161156 10. "Remove" means eliminate any apparent or purportedly
162157 continuing effect on title to real property; and
163158 11. "Unlawful restriction" means a prohibition, restriction,
164159 covenant, or condition in a document that purports to interfere with
165160 or restrict the transfer, use, or occupancy of real property:
166161 a. on the basis of race, color, religion, national
167162 origin, sex, familial status, disability, or other
168163 personal characteristics, and
169164 b. in violation of other laws of this state or federal
170165 law.

198-SECTION 3. NEW LAW A new section of law to be codified
199-in the Oklahoma Statutes as Section 403 of Title 16, unless there is

201195 Except with respect to property to which Section 4 of this act
202196 applies, an owner of real property subject to an unlawful
203197 restriction may submit to the recorder for recordation in the land
204198 records an amendment to remove the unlawful restriction, b ut only as
205199 to the owner's property.
206200 SECTION 4. NEW LAW A new section of law to be codified
207201 in the Oklahoma Statutes as Section 404 of Title 16, unless there is
208202 created a duplication in numbering, reads as follows:
209203 A. The governing body of an owners association identified in a
210204 governing instrument may, without a vote of the members of the
211205 association, amend the governing instrument to remove an unlawful
212206 restriction.
213207 B. A member of an owners association may request, in a record
214208 that sufficiently identifies an unlawful restriction in the
215209 governing instrument, that the governing body exercise its authority
216210 under subsection A of this section. Not later than ninety (90) days
217211 after the governing body receives the request, the governing bo dy
218212 shall determine reasonably and in good faith whether the governing
219213 instrument includes the unlawful restriction. If the governing body
220214 determines the governing instrument includes the unlawful
221215 restriction, the governing body, not later than ninety (90) days
216+after the determination, shall amend the governing instrument to
217+remove the unlawful restriction.

249-after the determination, shall amend the governing instrument to
250-remove the unlawful restriction.
251244 C. Notwithstanding any provision of the governing instrument or
252245 other laws of this state, the gov erning body may execute an
253246 amendment under this sectio n.
254247 D. An amendment under this section is effective notwithstanding
255248 any provision of the governing instrument or other law of this state
256249 that requires a vote of the members of the owners association to
257250 amend the governing instrument.
258251 SECTION 5. NEW LAW A new section of law to be codified
259252 in the Oklahoma Statutes as Section 405 of Title 16, unless there is
260253 created a duplication in numbering, reads as follows:
261254 A. An amendment under this act must identify the owner, the
262255 real property affected, and the document containing the unlawful
263256 restriction. The amendment must include a conspicuous statement in
264257 substantially the following form:
265258 "This amendment removes from this deed or other document
266259 affecting title to real property an unlawful re striction as defined
267260 under the Oklahoma Uniform Unlawful Restrictions in Land Records
268261 Act. This amendment does not affect the validity or enforceability
269262 of a restriction that is not an unlawful restric tion."
270263 B. The amendment must be executed and acknowle dged in the
271264 manner required for recordation of a document in the land records.
272265 The amendment must be recorded with the county clerk in the county
266+in which the document containing the unlawful restriction is
267+recorded.

302294 C. The amendment does not affect the validity or enforceability
303295 of any restriction that is not an unlawful restriction.
304296 D. The amendment or a future conveyance of the affected real
305297 property is not a republication of a restriction that oth erwise
306298 would expire by passage of time under other law of this state.

402-Signatures in Global and National Commerce Act, 15 U.S.C., Section
403-7001 et seq., as amended, but does not modify, limit, or supersede

405395 of the notices described in 15 U.S.C., Section 7003(b).
406396 SECTION 9. This act shall become effective November 1, 2025.
