153 | 153 | | 4. "Apprentice" means a person who is engaged in learning the |

154 | 154 | | practice of embalming or the pract ice of funeral directing, as the |
---|
155 | 155 | | case may be, under the instruction and personal supervision of a |
---|
156 | 156 | | duly licensed embalmer or a duly licensed funeral director of and in |
---|
157 | 157 | | the State of Oklahoma, pursuant to the provisions of the Funeral |
---|
158 | 158 | | Services Licensing Act, and who is duly registered as such with said |
---|
159 | 159 | | Board; |
---|
160 | 160 | | 5. "Board" means the Oklahoma Funeral Board; |
---|
161 | 161 | | 6. "Directing a funeral" or "funeral directing" means directing |
---|
162 | 162 | | funeral services from the time of the first call until final |
---|
163 | 163 | | disposition or release to a comm on carrier or release to next of kin |
---|
164 | 164 | | of the deceased or the designee of the next of kin; |
---|
165 | 165 | | 7. "First call" means the beginning of the relationship and |
---|
166 | 166 | | duty of the funeral director to take charge of dead human remains |
---|
167 | 167 | | and have such remains prepared by embalm ing, cremation, or |
---|
168 | 168 | | otherwise, for burial or disposition, provided all laws per taining |
---|

204 | 204 | | as necessary, for the specified purpose of performing preparation |
---|
205 | 205 | | and shipping services of dead human remains to funeral |
---|
206 | 206 | | establishments inside and outside this state; |
---|
207 | 207 | | 10. "Funeral service merchandise or funeral services " means |
---|
208 | 208 | | those products and services normally provided by funeral |
---|
209 | 209 | | establishments and required to be listed on the General Price List |
---|
210 | 210 | | of the Federal Trade Commission, 15 U.S.C., Section 57a(a), |
---|
211 | 211 | | including, but not limited to, the sale of burial supplies and |
---|
212 | 212 | | equipment, but excluding the sale by a cemetery of lands or |
---|
213 | 213 | | interests therein, services incidental thereto, markers, memorials, |
---|
214 | 214 | | monuments, equipment, crypts, niches or outer enclosures; |
---|
215 | 215 | | 11. "Outer enclosure" means a grave liner, grave box, or grave |
---|
216 | 216 | | vault; |
---|
217 | 217 | | 12. "Funeral director in charge " means an individual licensed |
---|
218 | 218 | | as both a funeral director and embalmer designated by a funeral |
---|
219 | 219 | | service establishment, commercial embalming establishment, or |

248 | 248 | | 13. "Authorizing agent" means a person legally entitled to |

250 | 250 | | pursuant to Section 1151 or 1158 of Title 21 of the Oklahoma |
---|
251 | 251 | | Statutes; |
---|
252 | 252 | | 14. "Cremation" means the technical process, using heat and |
---|
253 | 253 | | flame, or heat and pressure, that reduces human remains to essential |
---|
254 | 254 | | elements, including bone fragments. The reduction takes place |
---|
255 | 255 | | through heat and evaporation. Cremation shall include, but not be |
---|
256 | 256 | | limited to, the processing and pulverization of the bone fragments, |
---|
257 | 257 | | or through alkaline hydrolysis; |
---|
258 | 258 | | 15. "Crematory or reduction facility " means a structure |
---|
259 | 259 | | containing a furnace or alkaline hydro lysis vessel used or intended |
---|
260 | 260 | | to be used for the cremation reduction of human remains. The term |
---|
261 | 261 | | includes a facility that cremates human remains through alkaline |
---|
262 | 262 | | hydrolysis; and |
---|
263 | 263 | | 16. "Alkaline hydrolysis" means the reduction of human remains |
---|
264 | 264 | | to bone fragments and essential elements in a licensed crematory |
---|
265 | 265 | | using heat, pressure, water and base chemical agents. |
---|

297 | 297 | | 1. Prescribe and promulgate rules necessary to effectuate the |
---|
298 | 298 | | provisions of the Funeral Services Licensing Act, and to make orders |
---|
299 | 299 | | as it may deem necessary or e xpedient in the performance of its |
---|
300 | 300 | | duties; |
---|
301 | 301 | | 2. Prepare, conduct and grade exam inations, written or oral, of |
---|
302 | 302 | | persons who apply for the issuance of licenses to them; |
---|
303 | 303 | | 3. Determine the satisfactory passing score on such |
---|
304 | 304 | | examinations and issue licenses to pers ons who pass the examinations |
---|
305 | 305 | | or are otherwise entitled to licensure; |
---|
306 | 306 | | 4. Determine eligibility for licenses and certificates of |
---|
307 | 307 | | apprenticeship; |
---|
308 | 308 | | 5. Issue licenses for funeral directors, embalmers, funeral |
---|
309 | 309 | | establishments, commercial embalming establishment s, and |
---|
310 | 310 | | crematories, and each crematory operator shall be registered with |
---|
311 | 311 | | the Board; |
---|
312 | 312 | | 6. Issue certificates of apprenticeship; |
---|
313 | 313 | | 7. Upon good cause shown, as hereinafter provided, deny the |
---|
314 | 314 | | issuance of a license or certificate of apprenticeship or suspend, |
---|
315 | 315 | | revoke or refuse to renew licenses or certificates of |
---|
316 | 316 | | apprenticeship, and upon proper showing, to reinstate them; |
---|

351 | 351 | | personnel as deemed necessary by the Board; |
---|
352 | 352 | | 11. Initiate disciplinary, prosecution and injunctive |
---|
353 | 353 | | proceedings against any person or entity who violates any of the |
---|
354 | 354 | | provisions of the Funeral Services Licensin g Act or any rule |
---|
355 | 355 | | promulgated pursuant thereto; |
---|
356 | 356 | | 12. Investigate alleged viola tions of the Funeral Services |
---|
357 | 357 | | Licensing Act or of the rules, orders or final orders of the Board; |
---|
358 | 358 | | 13. Promulgate rules of conduct governing the practice of |
---|
359 | 359 | | licensed funeral dire ctors, embalmers, funeral establishments, and |
---|
360 | 360 | | commercial embalming establishments and sale of funeral service |
---|
361 | 361 | | merchandise; |
---|
362 | 362 | | 14. Keep accurate and complete records of its proceedings and |
---|
363 | 363 | | certify the same as may be appropriate; |
---|
364 | 364 | | 15. Request prosecution by th e district attorney or the |
---|
365 | 365 | | Attorney General of this state of any person or any violation of the |
---|
366 | 366 | | Funeral Services Licensing Act; |

407 | 407 | | 20. Promulgate rules for continuing education for licensees |

408 | 408 | | pursuant to Section 396.5b of this title; and |

409 | 409 | | 21. Approve course providers and course cur riculum for |

410 | 410 | | licensure of a funeral director. |

444 | 444 | | B. A funeral establishment shall not do business in a locat ion |

445 | 445 | | that is not licensed as a funeral establishment, shall not advertise |
---|
446 | 446 | | a service that is available from an unlicensed location, and shall |
---|
447 | 447 | | advertise itself by the name that the establishment is licensed as |
---|
448 | 448 | | pursuant to the Funeral Services Licensing Act. |
---|
449 | 449 | | C. Every funeral establishment, commercial embalming |
---|
450 | 450 | | establishment, and crematory shall be operated by a funeral director |
---|
451 | 451 | | in charge. Each establishment license shall be conspicu ously |
---|
452 | 452 | | displayed at the location. |
---|
453 | 453 | | D. The Oklahoma Funeral Board shall have the power to inspect |
---|
454 | 454 | | the premises in which funeral directing is conducted or where |
---|
455 | 455 | | embalming or cremation is practiced or where an applicant proposed |
---|

608 | 608 | | establishment shall not be liable for refusing to accept human |

648 | 648 | | by rule of the Oklahoma Funeral Board. The form s hall accompany the |
---|
649 | 649 | | human remains in all phases of transportation, cremation, a nd return |
---|
650 | 650 | | of the cremated remains. |
---|
651 | 651 | | F. The authorizing agent is responsible for the disposition of |
---|
652 | 652 | | the cremated remains. If, after sixty (60) calendar days from the |
---|
653 | 653 | | date of cremation, the authorizing agent or the representative of |
---|
654 | 654 | | the agent has not specified the ultimate disposition or claimed the |
---|
655 | 655 | | cremated remains, the funeral establishment in possession of the |
---|
656 | 656 | | cremated remains may dispose of the cremated remains in a dignified |
---|
657 | 657 | | and humane manner in accordance with any state, county, or municipal |
---|
658 | 658 | | laws or provisions regarding the disposition of cremated remains, |
---|
659 | 659 | | except as provided in subsection G of this section. A record of |
---|
660 | 660 | | this disposition shall be made and kept by the entity mak ing the |
---|
661 | 661 | | disposition. Upon the disposition of unclaimed cremated remains in |
---|
662 | 662 | | accordance with this subsection, the funeral establishment and |

698 | 698 | | be listed as an exempt organization under Section 501(c) of the |

699 | 699 | | Internal Revenue Code, 26 U.S.C., Section 501(c). Upon the transfer |
---|
700 | 700 | | of the veteran's remains to the charitable organization, the funeral |
---|
701 | 701 | | establishment shall be discharged from any legal obligation or |
---|
702 | 702 | | liability concerning the disposition of the cremated remains. |

802 | 802 | | shall file annually with the Board a report in the form prescribed |

803 | 803 | | by the Board describing the operations of the licensee, including |

804 | 804 | | the number of cremations performed, the disposition thereof, and any |
---|
805 | 805 | | other information that the Board may require by rule. |

806 | 806 | | E. A funeral establishment performing cremation services shall |

807 | 807 | | be subject to all local, state, and federal health and environmental |
---|
808 | 808 | | requirements and shall obtain all necessary licenses and permits |
---|
809 | 809 | | from the Oklahoma Funeral Board, and the appropriate federal and |
---|
810 | 810 | | state health and environmental authorities. |

811 | 811 | | F. Crematories licensed by the Board on t he effective date of |
---|
812 | 812 | | this act shall be exempt from the provisions of subsections C, D and |
