5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new section o f law to be codified
5858 in the Oklahoma Statutes as Section 80.2 of Title 74, unless there
5959 is created a duplication in numbering, reads as follows:
6060 A. This act shall be known and may be cited as the "Pretrial
6161 Data Collection Act".
6262 B. As used in this act:
6363 1. "Average cost for jail stay " means the average daily cost to
6464 house an inmate including, but not limited to, average medical care
6565 costs, daily stay fee, extra food, and transportation;

9292 2. "Case number" means the identification number assigned by
9393 the clerk of the court to a criminal case;
9494 3. "Charge description" means the statement of the conduct that
9595 is alleged to have been violated, the associated statutory section
9696 establishing such conduct as criminal, and the misdemeanor or felony
9797 classification that is provided for in the statutory section alleged
9898 to have been violated;
9999 4. "Charge modifier" means an aggravating circumstance of an
100100 alleged crime that enhances or reclassifies a charge to a more
101101 serious misdemeanor or felony offense;
102102 5. "Cited offense" means the alleged offense for which an
103103 arrest occurred, including the state or municipal code under which
104104 the offense is alleged;
105105 6. "Co-occurring disorder" means any combination of mental
106106 health symptoms and substance use disorder symptoms or diagnoses
107107 that affect a consumer and are typically determined by the current
108108 Diagnostic and Statistical Manual of Mental Disorders ;
109109 7. "Criminal charge against " means information related to the
110110 formal charges filed against a defendant, including charge
111111 description, as defined in this section, code section, jurisdiction,
112112 and charge modifier, as defined in this section, if applicable;
113113 8. "Date of arrest" means the day, month, and year the arrest

141141 9. "Date of entrance" means the day, month, and year of
142142 entrance into a county jail or detention facility;
143143 10. "Demographic information " means identifying information
144144 including name, age, race and ethnicity, gender, ZIP Code of primary
145145 residence, and unhoused status;
146146 11. "Mental illness” means a substantial disorde r of thought,
147147 mood, perception, psychological orientation or memory that
148148 significantly impairs judgment, behavior, capacity to recognize
149149 reality, or ability to meet the ordinary demands of life ;
150150 12. "Offense location" means the county in which the offense is
151151 alleged to have occurred;
152152 13. "Operational capacity " means the maximum nu mber of inmates
153153 a county jail or detention facility can hold;
154154 14. "Release date" means the day, month, and year a defendant
155155 is released from a county jail or detention facility;
156156 15. ”Substance-use disorders” means alcohol or drug dependence
157157 or psychoactive substance use disorder , as defined by current
158158 Diagnostic and Statistical Manual of Mental Disorders criteria or by
159159 other standardized and widely accepted criteria ; and
160160 16. "Term of sentence" means the sentence type and length
161161 imposed by the court inclu ding, but not limited to, the total
162162 duration of imprisonment in a county jail or detention facility and
163163 conditions of probation or community supervision.

190190 C. Beginning January 1, 2026, an entity required to collect
191191 data in accordance with the provisions of this act shall collect the
192192 specified data required of the entity on a monthly basis. Each
193193 entity shall report the data collected to the Oklahoma State Bureau
194194 of Investigation on a monthly basis.
195195 1. Municipal police departments and county sheriff offices
196196 shall collect for each individual arrested the following
197197 information:
198198 a. arrest location,
199199 b. date of arrest,
200200 c. race of detainee,
201201 d. ethnicity of detainee,
202202 e. age of detainee,
203203 f. gender of detainee,
204204 g. ZIP Code of residence of detainee, if applicable, and
205205 h. cited offense.
206206 2. County jail and county detention facilities shall collect
207207 for each confined person the following information:
208208 a. date of entrance,
209209 b. name,
210210 c. date of birth,
211211 d. gender,
212212 e. race,
213213 f. ethnicity,

241241 h. mental illness, co-occuring disorder, substance abuse
242242 disorder, history of opioid use , if any,
243243 i. last-known residential ZIP Code, if applicable,
244244 j. unhoused status,
245245 k. Medicaid enrollment status,
246246 l. any criminal charges against the person by code
247247 section and jurisdiction,
248248 m. term of sentence,
249249 n. bond amount,
250250 o. if bond is set, and
251251 p. release date.
252252 3. Each county jail and county detention facility shall collect
253253 the following informa tion:
254254 a. average costs for jail stay per day for a confined
255255 person,
256256 b. average medical care costs for a confined person,
257257 c. daily stay fee and rate for a confined person,
258258 d. bill for medical costs for all confined persons,
259259 e. bill for extra food for all co nfined persons,
260260 f. bill for transportation for all confined persons,
261261 g. operational capacity of the county jail and county
262262 detention facility,

290290 with accompanying demographic information:
291291 (1) the number of sentenced confined people,
292292 (2) the number of unsentenced confined people with a
293293 hold and what kind of hold each unsentenced
294294 person has including, but not limited to, tribal
295295 or federal holds,
296296 (3) the number of unsentenced confined people without
297297 a hold, and
298298 (4) the number of unsentenced people admitted for a
299299 probation violation or violation of community
300300 sentencing standards,
301301 i. for unsentenced confined people, counting only one
302302 time, and with accompanying demographic information:
303303 (1) the number of unsentenced confined people whose
304304 most serious charged offense is a felony, and
305305 (2) the number of unsentenced confined people whose
306306 most serious charged offense is a misdemeanor,
307307 j. number of confined people held solely for a municipal
308308 offense with accompanying demographic information,
309309 k. average daily population of the jail facility with
310310 accompanying demographic information,
311311 l. average or median length of stay with accompanying

340340 prior twelve (12) months whose most serious
341341 offense was a felony, and
342342 (2) number of people who were released within the
343343 prior twelve (12) months whose most serious
344344 offense was a misdemeanor,
345345 m. number of confined people identified as unhoused with
346346 accompanying demographic information,
347347 n. number of bookings into the jail facility with
348348 accompanying demographic information ,
349349 o. number of people screened at intake for mental health
350350 and substance use disorders using a validated
351351 screening tool,
352352 p. number of people referred to mental health or
353353 substance use services based on intake behavioral
354354 health screening,
355355 q. number of people receiving psychotropic medication,
356356 r. number of people receiving medications for opioid use
357357 disorder or medication assisted treatment,
358358 s. number of people awaiting competency evaluation,
359359 t. number of deaths in the jail, and
360360 u. cause of any reported death .
361361 D. The Bureau shall publish datasets in its possession in a
362362 modern, open, electronic format that is machine -readable and readily

389389 accessible by the public on the website of the Office. The
390390 published data shall be searchable, at a minimum, by each data
391391 element, county, circuit, and unique identifier. Agencies that
392392 employ five hundred (500) or more employees shall submit data to the
393393 Office by July 1, 2026. Agencies that employ more than one hundred
394394 (100) but less than five hundred (500) employees shall submit data
395395 to the Office by July 1, 2027. Agencies with more than zero (0) and
396396 less than one hundred (100) employees shall submit data to the
397397 Office by July 1, 2028.
398398 E. Upon a determination by the Bureau of noncompliance, any
399399 member of any board of county commissioners may bring an action in a
400400 district court having jurisdiction over the county from which the
401401 county commissioner serves to force compli ance. If any entity
402402 covered under the provisions of this act encompasses more than one
403403 county, upon a determination by the Office of noncompliance, a
404404 county commissioner serving from any of the encompassed counties may
405405 bring such action against the entity .
406406 SECTION 2. This act shall become effective November 1, 2025 .
