6262 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6363 SECTION 1. NEW LAW A new section of law to be co dified
6464 in the Oklahoma Statutes as Section 2904 of Title 74, unless there
6565 is created a duplication in numbering, reads as follows:
6666 As used in this act:
6767 1. “Extremely low-income household” means a household that has
6868 an income not in excess of thirty percen t (30%) of the area median

9595 income, adjusted for the size of the household, as determined by the

9797 2. “Very low-income household” means a household that has an
9898 income of more than thirty percent (30% ) of the area median income
9999 but no more than fifty percent (50%) of the area median income,

102102 3. “Low-income household” means a household that has an income
103103 of more than fifty percent (50%) of the area median income but no
104104 more than eighty percent (80%) of the area median income, adjusted
105105 for the size of the household, as determined by the United States
106106 Department of Housing and Urban Devel opment;
107107 4. “Moderate-income household” means a household that has an
108108 income of more than eighty percent (80%) of the area median income
109109 but no more than one hundred twenty percent (120%) of the area
110110 median income, adjusted for the size of the household, a s determined
111111 by the United States Department of Housing and Urban Development;

113113 5. “Middle-income household” means a household that has an
114114 income of more than one hundred twenty percent (120%) of the area
115115 median income but no more than one hundred sixt y percent (160%) of
116116 the area median income, adjusted for the size of the household, as
117117 determined by the United States Department of Housing and Urban

145145 SECTION 2. NEW LAW A new section of law to be codified
146146 in the Oklahoma Statutes as Section 2904.1 of Title 74, unless there
147147 is created a duplication in numbering, reads as follows:
148148 A. There is hereby created until December 30, 2034, the
149149 Oklahoma Workforce Housing Commission. The Commission shall be
150150 composed of fifteen (1 5) members. The members shall serve as
151151 follows:
152152 1. Five members shall be appointed by the Governor:
153153 a. one shall be a person living in an urban area with a
154154 population more than one hundred thousand (100,000)
155155 persons according to the latest Federal Decenn ial
156156 Census,
157157 b. one shall be a person living in a rural community in a
158158 county with a population less than seventy -five
159159 thousand (75,000) persons according to the latest
160160 Federal Decennial Census,
161161 c. one shall be an official serving in a city, town, or
162162 political subdivision in a county with a population
163163 less than seventy-five thousand (75,000) persons
164164 according to the latest Federal Decennial Census,
165165 d. one shall represent an organization that assists
166166 special populations, including , but not limited to,
167167 the elderly, the disabled, veterans, and children

196196 e. one shall represent an Oklahoma rural housing
197197 authority;
198198 2. Five members shall be appointed by the President Pro Tempore
199199 of the Senate:
200200 a. one shall be a Senator from the majority party who
201201 shall serve as co-chair of the Commission,
202202 b. one shall be a Senator from the minority party who
203203 shall serve as co-vice chair of the Commission,
204204 c. one shall represent a low -income and moderate-to-low-
205205 income population-serving financial institution or a
206206 community development financial institution, as
207207 defined by the Federal Reserve,
208208 d. one shall be an official serving in a municipality
209209 with a population more than one hundred thousand
210210 (100,000) persons accor ding to the latest Federal
211211 Decennial Census, and
212212 e. one shall represent an urban housing authority;
213213 3. Five members shall be appointed by the Speaker of the House
214214 of Representatives:
215215 a. one shall be a Representative from the majority party
216216 who shall serve as co-chair of the Commission,

243243 b. one shall be a Representative from the minority party
244244 who shall serve as co -vice chair of the Commission,
245245 c. one shall represent a federally recognized tribe in
246246 Oklahoma that provides affordable housing in rural
247247 areas,
248248 d. one shall be a representative from a community housing
249249 development organization, as determined by the United
250250 States Department of Housing and Urban Development,
251251 and
252252 e. one shall represent a not -for-profit organization that
253253 serves low-income Oklahomans exp eriencing difficulty
254254 in obtaining affordable housing; and
255255 4. The following shall be ex officio members:
256256 a. one shall be a representative from the Oklahoma
257257 Department of Commerce representing community
258258 development,
259259 b. one shall be an Oklahoma representativ e of the United
260260 States Department of Agriculture, and
261261 c. the Executive Director of the Oklahoma Housing Finance
262262 Agency, or his or her designee.
263263 B. For the initial appointments of members to the Commission,
264264 each appointment shall be for a two -year term. Thereafter, the
265265 terms of the Commission shall be for three (3) years.

292292 C. No member of the Commission shall receive a salary or
293293 reimbursement for duties performed as a member of the Commission;
294294 however, members may be eligible to receive travel reimbursemen t as
295295 provided in the State Travel Reimbursement Act.
296296 D. The meetings of the Commission shall be subject to the
297297 Oklahoma Open Meeting Act.
298298 E. The Commission shall utilize the resources available to
299299 address the needs of extremely low -income households, ver y low-
300300 income households, low -income households, moderate -income
301301 households, and middle -income households in order to promote a
302302 condition in which suitable housing is available to as many persons
303303 as possible pursuant to rules promulgated by the Oklahoma Hou sing
304304 Finance Agency pursuant to Section 3 of this act.
305305 SECTION 3. NEW LAW A new section of law to be codified
306306 in the Oklahoma Statutes as Section 2904.2 of Title 74, unless there
307307 is created a duplication in numbering, reads as follo ws:
308308 The Oklahoma Housing Finance Agency shall promulgate rules
309309 relating to:
310310 1. An initial comprehensive Oklahoma workforce housing
311311 environmental scan and needs assessment;
312312 2. A comprehensive Oklahoma affordable housing annual report
313313 and action plan to be submitted electronically to the Governor and
314314 the Legislature;

341341 3. A state plan for long -term expansion of workforce and
342342 affordable housing across the state;
343343 4. An update on the implementation and outcomes of the
344344 investment in the Oklahoma Housing Stabili ty Program created in
345345 Section 2903 et seq. of Title 74 of the Oklahoma Statutes;
346346 5. An evaluation to make recommendations to the Legislature on
347347 policies and incentives to increase the development, inventory, and
348348 diversification of affordable housing; and
349349 6. Any other rules necessary to carry out the purpose and
350350 mission of the Oklahoma Workforce Housing Commission pursuant to
351351 Section 2 of this act.
352352 SECTION 4. NEW LAW A new section of law to be codified
353353 in the Oklahoma Statutes as Se ction 2904.3 of Title 74, unless there
354354 is created a duplication in numbering, reads as follows:
355355 A. There is hereby created in the State Treasury a revolving
356356 fund to be designated as the “Oklahoma Workforce Housing Commission
357357 Revolving Fund”, which shall consist of all monies appropriated,
358358 transferred, or otherwise designated to the fund by law. The
359359 revolving fund shall be a continuing fund, not subject to fiscal
360360 year limitations, and shall be under the administration of the
361361 Oklahoma Workforce Housing Comm ission and shall be budgeted and
362362 expended in accordance with the provisions of subsection B of this
363363 section for the purpose of improving the stock and affordability of
364364 Oklahoma housing.

391391 B. No funds shall be budgeted or expended from the Oklahoma
392392 Workforce Housing Commission Revolving Fund prior to July 1, 2025,
393393 or prior to the approval by the Legislature of promulgated permanent
394394 rules by the Commission pursuant to the provisions of the
395395 Administrative Procedures Act.
396396 SECTION 5. This act shall become effective November 1, 2025.
