41	41	21 O.S. 2021, Section 1740.2, which relates to
42	42	larceny of mail; increasing and delet ing certain
43	43	penalties; and providing an effective date .

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1740.2, is
52	52	amended to read as follows:
53	53	Section 1740.2. A. As used in this section:
54	54	1. "Mail" means a letter, postal card, package, bag or any
55	55	other article or thing contained therein, or other sealed article
56	56	addressed to a person, that:
57	57	a. is delivered by a common carrier or delivery service
58	58	and not yet received by the addressee, or
59	59	b. has been left to be collected for delivery by a common
60	60	carrier or delivery service; and
61	61	2. "Person" means an individual, partnership, corporation,
62	62	limited liability company, association or other legal entity.

89	89	B. It shall be unlawful for any person to hold, conceal,
90	90	destroy or take mail from the mailbox or pre mises of another person
91	91	or from a delivery vehicle at any point throughout the delivery
92	92	route without the effective consent of the addressee and with the
93	93	intent to deprive the ad dressee of the mail.
94	94	C. Any person who violates the provisions of this section
95	95	shall, upon conviction, be guilty of a misdemeanor felony punishable
96	96	by imprisonment in the county jail custody of the Department of
97	97	Corrections for a term not to exceed one (1) year two (2) years, or
98	98	by a fine not to exceed Five Hundred Dollars ($500.00 ) Five Thousand
99	99	Dollars ($5,000.00), or by both such fine and imprisonment.
100	100	D. When three or more separate offenses under this section are
101	101	committed within a sixty -day period, the person shall be guilty of a
102	102	felony punishable by imprisonment in the custody of the Department
103	103	of Corrections for a term of not less than two (2) years nor more
104	104	than five (5) years, or by a fine not to exceed Five Thousand
105	105	Dollars ($5,000.00), or by bot h such fine and imprisonment.
106	106	E. Any person convicted pursuant to the provisi ons of this
107	107	section shall also be ordered to pay restitution to the victim as
108	108	provided in Section 991f of Title 22 of the Oklahoma Statutes.
109	109	SECTION 2. This act shall become effective November 1, 2025.
