4040 An Act relating to crimes and punishments; amending
4141 21 O.S. 2021, Section 1740.2, which relates to
4242 larceny of mail; increasing and delet ing certain
4343 penalties; and providing an effective date .

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1740.2, is
5252 amended to read as follows:
5353 Section 1740.2. A. As used in this section:
5454 1. "Mail" means a letter, postal card, package, bag or any
5555 other article or thing contained therein, or other sealed article
5656 addressed to a person, that:
5757 a. is delivered by a common carrier or delivery service
5858 and not yet received by the addressee, or
5959 b. has been left to be collected for delivery by a common
6060 carrier or delivery service; and
6161 2. "Person" means an individual, partnership, corporation,
6262 limited liability company, association or other legal entity.

8989 B. It shall be unlawful for any person to hold, conceal,
9090 destroy or take mail from the mailbox or pre mises of another person
9191 or from a delivery vehicle at any point throughout the delivery
9292 route without the effective consent of the addressee and with the
9393 intent to deprive the ad dressee of the mail.
9494 C. Any person who violates the provisions of this section
9595 shall, upon conviction, be guilty of a misdemeanor felony punishable
9696 by imprisonment in the county jail custody of the Department of
9797 Corrections for a term not to exceed one (1) year two (2) years, or
9898 by a fine not to exceed Five Hundred Dollars ($500.00 ) Five Thousand
9999 Dollars ($5,000.00), or by both such fine and imprisonment.
100100 D. When three or more separate offenses under this section are
101101 committed within a sixty -day period, the person shall be guilty of a
102102 felony punishable by imprisonment in the custody of the Department
103103 of Corrections for a term of not less than two (2) years nor more
104104 than five (5) years, or by a fine not to exceed Five Thousand
105105 Dollars ($5,000.00), or by bot h such fine and imprisonment.
106106 E. Any person convicted pursuant to the provisi ons of this
107107 section shall also be ordered to pay restitution to the victim as
108108 provided in Section 991f of Title 22 of the Oklahoma Statutes.
109109 SECTION 2. This act shall become effective November 1, 2025.
