5454 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 70 O.S. 2021, S ection 2605,
5656 as last amended by Section 2, Chapter 274, O.S.L. 2024 (70
5757 O.S. Supp. 2024, Section 2605), is amended to read as
5858 follows:
5959 Section 2605. A. Each school year, every fifth- through
6060 eleventh-grade student in the public and private schools of
6161 this state and students who are educated by other means and
6262 are in the equivalent of the fifth through eleventh grade
6363 shall be apprised, together with the parent, custodial
6464 parent, or guardian of the student, of the opportunity for

9191 access to higher learning u nder the Oklahoma Higher Learning
9292 Access Program. The Oklahoma State Regents for Higher
9393 Education and the State Board of Education shall develop,
9494 promote, and coordinate a publi c awareness program to be
9595 utilized in making students and parents aware of the Oklahoma
9696 Higher Learning Access Program.
9797 B. On a form provided by the Oklahoma State Regents for Higher
9898 Education, every public school district shall designate at least one
9999 Oklahoma Higher Learning Access Program contact person, who shall be
100100 a counselor or teacher, at each public school site in this state in
101101 which eighth-, ninth-, tenth-, or eleventh-grade classes are taught.
102102 When requested by the State Regents, the State Board of Education
103103 shall assist the State Regents to ensure the designation of contact
104104 persons. Private schools shall also designate at least one school
105105 official as a contact person. For students who are educated by
106106 other means, a parent or guardian or other person approved by the
107107 State Regents shall be designated the contact person.
108108 C. 1. Students who qualify on the basis of financial need
109109 according to subsection D or E of this section or who meet the
110110 eligibility qualification set forth in subparagraph a of paragraph 1
111111 of subsection B of Section 2603 of this title prior to entering the
112112 eleventh grade or prior to reaching the age of sixteen (16) and the
113113 standards and provisions promulgated by the Oklahoma State Regents
114114 for Higher Education shall be given the opportunity throughout the

141141 eighth-, ninth-, tenth-, and eleventh-grade years, for students
142142 enrolled in a public or private school, or between the ages of
143143 thirteen (13) and sixteen (16), for students who are educated by
144144 other means, to enter into participat ion in the program by agreeing
145145 to, throughout the remainder of their school years or educational
146146 program:
147147 a. attend school or an educational program regularly and
148148 do homework regularly,
149149 b. refrain from substance abuse,
150150 c. refrain from commission of violent crimes or
151151 delinquent acts,
152152 d.
153153 c. have school work and school records reviewe d by
154154 mentors designated pursuant to the program,
155155 e.
156156 d. provide information requested by the Oklahoma State
157157 Regents for Higher Education or the State Board of
158158 Education, and
159159 f.
160160 e. participate in program activities.
161161 2. Students who meet the eligibility qualification set forth in
162162 subparagraph a of paragraph 1 of subsection B of Section 2603 of
163163 this title after completing the eleventh grade or after reaching the
164164 age of seventeen (17) shall be given the opportunity prior to

191191 reaching the age of twenty -one (21) to enter into participation in
192192 the program and shall execute an agreement with provisions as
193193 determined by the Oklahoma State Regents for Higher Education.
194194 3. The contact perso n shall maintain the agreements, which
195195 shall be executed on forms provided by the Oklahoma State Regents
196196 for Higher Education and managed according to regulations
197197 promulgated by the Oklahoma State Regents for Higher Education, and
198198 the contact person shall monitor compliance of the student with the
199199 terms of the agreement. The Oklaho ma State Regents for Higher
200200 Education are authorized to process student agreements and verify
201201 compliance with the agreements. Students failing to comply with the
202202 terms of the agreement shall not be eligible for the awards provided
203203 in Section 2604 of this title.
204204 D. Except as otherwise provided for in subsection E of this
205205 section and except for students who qualify pursuant to subsection B
206206 of Section 2603 of this title, a student shall not be found to be in
207207 financial need for purposes of the Oklahoma Higher Learning Access
208208 Program if:
209209 1. Beginning with eighth -, ninth-, or tenth-grade students who
210210 are enrolled in a public or private school or students between the
211211 ages of thirteen (13) and fifteen (15) who are educated by other
212212 means who apply for participation in the program in the 2017 -2018
213213 school year, the federal adjusted gross income of the student 's
214214 parent(s) exceeds Fifty -five Thousand Dollars ($55,000.00) per year;

241241 2. Beginning with eighth-, ninth-, tenth-, or eleventh-grade
242242 students who are enrolled in a public or private school or students
243243 between the ages of thirteen (13) and sixteen (16) who are educated
244244 by other means who apply for participation in the program in the
245245 2021-2022 school year, the federal adjusted gross income of the
246246 student's parent(s) exceeds Sixty Thousand Dollars ($60,000.00) per
247247 year;
248248 3. Beginning with eighth -, ninth-, tenth-, or eleventh-grade
249249 students who are enrolled in a public or private school or students
250250 between the ages of thirteen (13) and sixteen (16) who are educated
251251 by other means who apply for participation in the program in the
252252 2022-2023 school year:
253253 a. the federal adjusted gross income of the student 's
254254 parent(s), who have two or fewer depe ndent children,
255255 exceeds Sixty Thousand Dollars ($60,000.00) per year,
256256 b. the federal adjusted gross income of the student 's
257257 parent(s), who have three or four dependent children,
258258 exceeds Seventy Thousand Dollars ($70,000.00) per
259259 year, or
260260 c. the federal adjusted gross income of the student 's
261261 parent(s), who have five or more dependent children,
262262 exceeds Eighty Thousand Dollars ($80,000.00) per year;
263263 4. Beginning with the 2018 -2019 academic year, prior to
264264 receiving any Oklahoma Higher Learning Access Program be nefit award

291291 for any year during which the student is enrolled in an institution
292292 which is a member of The Oklahoma State System of Higher Education,
293293 a postsecondary vocational -technical program offered by a technology
294294 center school that meets the requiremen ts to be eligible for federal
295295 student financial aid, or a private institution of higher learning
296296 located within this state and accredited pursuant to Section 4103 of
297297 this title, the federal adjusted gross income of the student 's
298298 parent(s) exceeds One Hundr ed Thousand Dollars ($100,000.00) per
299299 year.
300300 The determination of financial qualification as set forth in
301301 this paragraph shall be based on the income of the student, not the
302302 income of the parent(s), if a student:
303303 a. is determined to be independent of the st udent's
304304 parents for federal financial aid purposes,
305305 b. was in the permanent cu stody of the Department of
306306 Human Services at the time the student enrolled in the
307307 program, or
308308 c. was in the court-ordered custody of a federally
309309 recognized Indian tribe, as defin ed by the federal
310310 Indian Child Welfare Act, at the time the student
311311 enrolled in the program.
312312 The provisions of this paragraph shall apply to any student who
313313 has received an Oklahoma Higher Learning Access Program benefit
314314 award after the 2017 -2018 school year; and

341341 5. The Oklahoma State Regents for Higher Education shall review
342342 the determination of financial qualification as set forth in
343343 paragraphs 1, 2, and 3 of this subsection if the income from taxable
344344 and nontaxable sources of the student 's parent(s) includes income
345345 received from nontaxable military benefits or income received from
346346 the federal Social Security Administration due to the death or
347347 disability of the student 's parent(s). If the income from taxable
348348 and nontaxable sources of the student 's parent(s), excluding income
349349 received from nontaxable military benefits or income rec eived from
350350 the federal Social Security Administration due to the death or
351351 disability of the student 's parent(s), does not exceed the
352352 limitations set forth by paragraphs 1, 2, and 3 of this subsection,
353353 the student shall be determined to have met the financial
354354 qualification set forth in paragraphs 1, 2, and 3 of this
355355 subsection.
356356 E. 1. A student who was adopted between birth and twelve (12)
357357 years of age while in the permanent custo dy of the Department of
358358 Human Services, in the court -ordered custody of a lice nsed private
359359 nonprofit child-placing agency, or federally recognized Indian
360360 tribe, as defined by the federal Indian Child Welfare Act, shall not
361361 be found to be in financial need for purposes of the Oklahoma Higher
362362 Learning Access Program if at the time the student begins
363363 postsecondary education and prior to receiving any Oklahoma Higher
364364 Learning Access Program benefit award, the federal adjusted gross

391391 income of the student 's parent(s) exceeds One Hundred Fifty Thousand
392392 Dollars ($150,000.00) per year. The p rovisions of this paragraph
393393 shall not apply to any student who has received an Oklahoma Higher
394394 Learning Access Program benefit award prior to the 2012 -2013 school
395395 year.
396396 2. A student who was adopted between thirteen (13) and
397397 seventeen (17) years of age while in the permanent custody of the
398398 Department of Human Services, in the court -ordered custody of a
399399 licensed private nonprofit child -placing agency, or federally
400400 recognized Indian tribe, as defined by the federal Indian Child
401401 Welfare Act, shall not be found to be in financial need for purposes
402402 of the Oklahoma Higher Learning Access Program if at the time the
403403 student begins postsecondary education and prior to receiving any
404404 Oklahoma Higher Learning Access Program benefit award, the federal
405405 adjusted gross income of the student 's parent(s) exceeds Two Hundred
406406 Thousand Dollars ($200,000.00) per year. The provisions of this
407407 paragraph shall not apply to any student who has received an
408408 Oklahoma Higher Learning Access Program benefit award prior to the
409409 2012-2013 school year.
410410 3. A student who was placed in the custody of the Department of
411411 Human Services at any time during the eighth, ninth, tenth, or
412412 eleventh grades and enrolls in the progr am no later than his or her
413413 official date of high school graduation shall not be found to be in
414414 financial need for purposes of the Oklahoma Higher Learning Access

441441 Program if the federal adjusted gross income of the student exceeds
442442 Sixty Thousand Dollars ($ 60,000.00) per year.
443443 4. Except for students who qualify pursuant to subsectio n B of
444444 Section 2603 of this title, the determination of financial
445445 qualification as set forth in this subsection shall be based on the
446446 income of the student, not the income of the parent(s), if the
447447 student is determined to be independent of the student 's parent(s)
448448 for federal financial aid purposes. A determination of financial
449449 qualification shall not be required for the student who meets the
450450 criteria set forth in this subsection at the time the student
451451 applies for participation in the program. The provisi ons of this
452452 paragraph shall not apply to any student who has received an
453453 Oklahoma Higher Learning Access Program benefit award prior to the
454454 2008-2009 school year.
455455 F. The financial qualification of a student as set forth in
456456 subsections D and E of this section shall be certified by the
457457 contact person or by the Oklahoma State Regents for Higher Education
458458 on the agreement form provided by the Oklahoma State Regents for
459459 Higher Education. The form shall be retained in the permanent
460460 record of the student and a c opy forwarded to the Oklahoma State
461461 Regents for Higher Education.
462462 G. Agreements shall be witnessed by the parent, custodial
463463 parent, or guardian of the student, who shall further agree to:

490490 1. Assist the student in achieving compliance with the
491491 agreements;
492492 2. Confer, when requested to do so, with the school contact
493493 person, other school personnel, and program mentors;
494494 3. Provide information requested by the Oklahoma State Regents
495495 for Higher Education or the State Board of Education; and
496496 4. Assist the student in completing forms and reports required
497497 for program participation, making applications to institutions and
498498 schools of higher learning, and filing applications for student
499499 grants and scholarships.
500500 H. The Oklahoma State Regents for Higher Education shall
501501 promulgate rules for the determination of student compliance with
502502 agreements made pursuant to this section.
503503 I. The Oklahoma State Regents for Higher Education shall
504504 designate personnel to coordinate tracking of program records for
505505 the years when studen ts participating in the program are still in
506506 the schools or are being educated by other means, provide staff
507507 development for contact persons in the schools, and provide liaison
508508 with the State Board of Education and local organizations and
509509 individuals participating in the program.
510510 J. The school district where an Oklahoma Higher Learning Access
511511 Program student is enrolled when the student begins participation in
512512 the program and any subsequent school district where the student
513513 enrolls shall forward informatio n regarding participation by the

541541 upon the request of the school for the records of the student.
542542 K. Students participating in the Oklahoma Higher Learning
543543 Access Program shall provide their Social Security number or their
544544 student identification number used by their school to the Oklahoma
545545 State Regents for Higher Education. The Regents shall keep the
546546 numbers confidential and use them only for administrative purposes.
547547 SECTION 2. This act shall become effective November 1, 2025.
