4040 An Act relating to professions and occupations;
4141 amending 59 O.S. 2021, Section 4200.4, which relates
4242 to the practice of massage therapy; establishing a
4343 massage therapist oversight committee; violation
4444 enforcement; and providing an effective date .

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 59 O.S. 2021, Section 4200.4, is
5252 amended to read as follows:
5353 Section 4200.4. A. The State Board of Cosmetolo gy and
5454 Barbering is hereby authorized to adopt and promulgate rules
5555 pursuant to the Administrative Procedures Act that are necessary for
5656 the implementation and enforcement of the Massage Therapy Practice
5757 Act, including, but not limited to, qualifications for licensure,
5858 renewals, reinstatements, and continuing education requirements.
5959 B. The State Board of Cosmetology and Barbering is hereby
6060 empowered to perform investigations, to require the production of
6161 records and other documents relating to practices re gulated by the
6262 Massage Therapy Practice Act, and to seek injunctive relief.

8989 C. There is hereby created an Advisory Board on Massage
9090 Therapy. The Advisory Board on Massage Thera py shall assist the
9191 Board in carrying out the provisions of this section regarding the
9292 qualifications, examination, registration, regulation, and standards
9393 of professional conduct of massage therapists. The Advisory Board
9494 on Massage Therapy shall consist of five (5) members to be appointed
9595 by the Governor for four -year terms as follows:
9696 1. Three members who shall be licensed massage therapists and
9797 have practiced in Oklahoma for not less than three (3) years prior
9898 to their appointment;
9999 2. One member who s hall be an administrator or faculty member
100100 of a nationally accredited school of massage therapy; and
101101 3. One who shall be a citizen member.
102102 D. There is hereby created an Oversight Committee on Massage
103103 Therapy. The Oversight Committee on Massage Therapy s hall assist
104104 the Board in reviewing formal complaints and professional standard
105105 violations. The Oversight Committee shall consist of three (3) to
106106 five (5) members to be selected by the Advisory Board on Massage
107107 Therapy and serve four (4) year terms. The Oversight Committee
108108 shall have the following duties:
109109 1. Establish and oversee a formal complaint, investigation, and
110110 hearing process for violations under Section 4200.11 of this title,
111111 2. Make recommendations to the Board for disciplinary actions
112112 under Section 4200.11 of this title,

139139 3. Provide required annual training for sexual h arassment and
140140 assault and professional conduct standards,
141141 4. Any other duties the Advisory Board finds necessary to
142142 adhere to professional standards of conduct under the Massage
143143 Therapy Act.
144144 D. E. The fee for any license issued between the effective date
145145 of this act and May 1, 2017, shall be Twenty -five Dollars ($25.00).
146146 The fee or renewal fee for any massage therapy license issued after
147147 May 1, 2017, shall be Fifty Dollars ($50 .00) per year. A duplicate
148148 license fee shall be Ten Dollars ($10.00).
149149 SECTION 2. This act shall become effective November 1, 2025.
