41	41	amending 59 O.S. 2021, Section 4200.4, which relates
42	42	to the practice of massage therapy; establishing a
43	43	massage therapist oversight committee; violation
44	44	enforcement; and providing an effective date .

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 59 O.S. 2021, Section 4200.4, is
52	52	amended to read as follows:
53	53	Section 4200.4. A. The State Board of Cosmetolo gy and
54	54	Barbering is hereby authorized to adopt and promulgate rules
55	55	pursuant to the Administrative Procedures Act that are necessary for
56	56	the implementation and enforcement of the Massage Therapy Practice
57	57	Act, including, but not limited to, qualifications for licensure,
58	58	renewals, reinstatements, and continuing education requirements.
59	59	B. The State Board of Cosmetology and Barbering is hereby
60	60	empowered to perform investigations, to require the production of
61	61	records and other documents relating to practices re gulated by the
62	62	Massage Therapy Practice Act, and to seek injunctive relief.

89	89	C. There is hereby created an Advisory Board on Massage
90	90	Therapy. The Advisory Board on Massage Thera py shall assist the
91	91	Board in carrying out the provisions of this section regarding the
92	92	qualifications, examination, registration, regulation, and standards
93	93	of professional conduct of massage therapists. The Advisory Board
94	94	on Massage Therapy shall consist of five (5) members to be appointed
95	95	by the Governor for four -year terms as follows:
96	96	1. Three members who shall be licensed massage therapists and
97	97	have practiced in Oklahoma for not less than three (3) years prior
98	98	to their appointment;
99	99	2. One member who s hall be an administrator or faculty member
100	100	of a nationally accredited school of massage therapy; and
101	101	3. One who shall be a citizen member.
102	102	D. There is hereby created an Oversight Committee on Massage
103	103	Therapy. The Oversight Committee on Massage Therapy s hall assist
104	104	the Board in reviewing formal complaints and professional standard
105	105	violations. The Oversight Committee shall consist of three (3) to
106	106	five (5) members to be selected by the Advisory Board on Massage
107	107	Therapy and serve four (4) year terms. The Oversight Committee
108	108	shall have the following duties:
109	109	1. Establish and oversee a formal complaint, investigation, and
110	110	hearing process for violations under Section 4200.11 of this title,
111	111	2. Make recommendations to the Board for disciplinary actions
112	112	under Section 4200.11 of this title,

139	139	3. Provide required annual training for sexual h arassment and
140	140	assault and professional conduct standards,
141	141	4. Any other duties the Advisory Board finds necessary to
142	142	adhere to professional standards of conduct under the Massage
143	143	Therapy Act.
144	144	D. E. The fee for any license issued between the effective date
145	145	of this act and May 1, 2017, shall be Twenty -five Dollars ($25.00).
146	146	The fee or renewal fee for any massage therapy license issued after
147	147	May 1, 2017, shall be Fifty Dollars ($50 .00) per year. A duplicate
148	148	license fee shall be Ten Dollars ($10.00).
149	149	SECTION 2. This act shall become effective November 1, 2025.
