61 | 54 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

62 | 55 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
63 | 56 | | in the Oklahoma Statutes as Section 11 -901e of Title 47, unless |
---|
64 | 57 | | there is created a duplication in numbering, reads as follows: |

65 | 58 | | A. For the purpose of this section: |
---|
66 | 59 | | 1. “Cellular telephone” means an analog or digital wireless |
---|
67 | 60 | | telephone authorized by the Federal Communications Commission to |
---|
68 | 61 | | operate in the frequency bandwidth reserved for cellular telephones; |
---|
99 | 91 | | 3. “Electronic communication device” means an electronic device |
---|
100 | 92 | | that permits the user to manually transmit a communication of |
---|
101 | 93 | | written text by means other than through an oral transfer or wire |
---|
102 | 94 | | communication. This term does not include: |

103 | 95 | | a. a device that is physically or electronically |
---|
104 | 96 | | integrated into a motor vehicle, |
---|
105 | 97 | | b. a voice-operated global positi oning or navigation |
---|
106 | 98 | | system that is affixed to a motor vehicle, |
---|
107 | 99 | | c. a hands-free or voice-operated device that allows t he |
---|
108 | 100 | | user to write, send, or read a text message without |
---|
109 | 101 | | the use of either hand except to activate, deactivate , |
---|
110 | 102 | | or initiate a feature or function, |
---|
111 | 103 | | d. an ignition interlock device that has been installed |
---|
112 | 104 | | on a motor vehicle, or |
---|
113 | 105 | | e. amateur radio use or operatio n; and |
---|
114 | 106 | | 4. "Text message" includes a text -based message, instant |
---|
115 | 107 | | message, electronic message, photo, video , or electronic mail. |
---|
116 | 108 | | B. Where any portion of a road, street, or highway is a |
---|
117 | 109 | | properly marked school zone, as indicated with appropriate warning |
---|
118 | 110 | | signs placed in accordance with the latest edition of the Manual on |
---|
119 | 111 | | Uniform Traffic Control Devices, and a reduced speed limit is |
---|
150 | 141 | | be unlawful for any person to operate a motor vehicle on any street |
---|
151 | 142 | | or highway within this state while: |
---|
152 | 143 | | 1. Using a hand-held electronic communication device or |
---|
153 | 144 | | cellular telephone to manua lly compose, send, or read an electronic |
---|
154 | 145 | | text message; or |
---|
155 | 146 | | 2. Holding or using a hand -held cellular telephone. |
---|
156 | 147 | | C. Any person who violates the provisions of subsection B of |
---|
157 | 148 | | this section shall, upon conviction, be punished by a fine of not |
---|
158 | 149 | | more than One Hundred Dollars ($100.00). |
---|
159 | 150 | | D. The provisions of subsection B of this section shall not |
---|
160 | 151 | | apply if the person is using the cellular telephone or electronic |
---|
161 | 152 | | communication device: |
---|
162 | 153 | | 1. In conjunction with hands -free or voice-operated technology; |
---|
163 | 154 | | or |
---|
164 | 155 | | 2. For the sole purpose of communicating with any of the |
---|
165 | 156 | | following regarding an imminent emergency situation: |
---|
166 | 157 | | a. an emergency response operator, |
---|
167 | 158 | | b. a hospital, physician’s office , or health clinic, |
---|
168 | 159 | | c. a provider of ambulance services, |
---|
169 | 160 | | d. a provider of firefighting servi ces, or |
---|
170 | 161 | | e. a law enforcement agency. |
---|
201 | 191 | | be the same as provided for in this section; the enforcement |
---|
202 | 192 | | provisions of those ordinances shall not be more stringent than |
---|
203 | 193 | | those of this section; and the total fine and court costs for |
---|
204 | 194 | | municipal ordinance violations shall not exceed One Hundred Dollars |
---|
205 | 195 | | ($100.00). |
---|
206 | 196 | | F. The Department of Public Safety shall not record or assess |
---|
207 | 197 | | points for violations of this section on any license holder’s |
---|
208 | 198 | | traffic record maintained b y Service Oklahoma. |
---|
209 | 199 | | G. A law enforcement officer shall not, without the consent of |
---|
210 | 200 | | the person: |
---|
211 | 201 | | 1. Confiscate a cel lular telephone or electronic communication |
---|
212 | 202 | | device for the purpose of determining compliance with this section; |
---|
213 | 203 | | 2. Confiscate a cellular telephone or electronic communication |
---|
214 | 204 | | device and retain it as evidence pending trial for a violation of |
---|
215 | 205 | | this section; or |
---|
216 | 206 | | 3. Extract or otherwise download information from a cellular |
---|
217 | 207 | | telephone or electronic communication device for a violation of this |
---|
218 | 208 | | section unless: |
---|
219 | 209 | | a. the law enforcement officer has probable cause to |
---|
220 | 210 | | believe that the cellular telephone or electroni c |
---|
