6154 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6255 SECTION 1. NEW LAW A new section of law to be codified
6356 in the Oklahoma Statutes as Section 11 -901e of Title 47, unless
6457 there is created a duplication in numbering, reads as follows:
6558 A. For the purpose of this section:
6659 1. “Cellular telephone” means an analog or digital wireless
6760 telephone authorized by the Federal Communications Commission to
6861 operate in the frequency bandwidth reserved for cellular telephones;
62+2. “Compose”, “send”, or “read” with respect to a text message
63+means the manual entry, sending , or retrieval of a text message t o
64+communicate with any person or device;

96-2. “Compose”, “send”, or “read” with respect to a text message
97-means the manual entry, se nding, or retrieval of a text message to
98-communicate with any person or device;
9991 3. “Electronic communication device” means an electronic device
10092 that permits the user to manually transmit a communication of
10193 written text by means other than through an oral transfer or wire
10294 communication. This term does not include:
10395 a. a device that is physically or electronically
10496 integrated into a motor vehicle,
10597 b. a voice-operated global positi oning or navigation
10698 system that is affixed to a motor vehicle,
10799 c. a hands-free or voice-operated device that allows t he
108100 user to write, send, or read a text message without
109101 the use of either hand except to activate, deactivate ,
110102 or initiate a feature or function,
111103 d. an ignition interlock device that has been installed
112104 on a motor vehicle, or
113105 e. amateur radio use or operatio n; and
114106 4. "Text message" includes a text -based message, instant
115107 message, electronic message, photo, video , or electronic mail.
116108 B. Where any portion of a road, street, or highway is a
117109 properly marked school zone, as indicated with appropriate warning
118110 signs placed in accordance with the latest edition of the Manual on
119111 Uniform Traffic Control Devices, and a reduced speed limit is
112+properly posted that is in effect during certain times due to the
113+presence or potential presence of school children, or in a road
114+construction zone, and while a motor vehicle is in motion, it shall

147-properly posted that is in effect during certain times due to the
148-presence or potential pre sence of school children, or in a road
149-construction zone, and while a motor vehicle is in motion, it shall
150141 be unlawful for any person to operate a motor vehicle on any street
151142 or highway within this state while:
152143 1. Using a hand-held electronic communication device or
153144 cellular telephone to manua lly compose, send, or read an electronic
154145 text message; or
155146 2. Holding or using a hand -held cellular telephone.
156147 C. Any person who violates the provisions of subsection B of
157148 this section shall, upon conviction, be punished by a fine of not
158149 more than One Hundred Dollars ($100.00).
159150 D. The provisions of subsection B of this section shall not
160151 apply if the person is using the cellular telephone or electronic
161152 communication device:
162153 1. In conjunction with hands -free or voice-operated technology;
163154 or
164155 2. For the sole purpose of communicating with any of the
165156 following regarding an imminent emergency situation:
166157 a. an emergency response operator,
167158 b. a hospital, physician’s office , or health clinic,
168159 c. a provider of ambulance services,
169160 d. a provider of firefighting servi ces, or
170161 e. a law enforcement agency.
162+E. Municipalities may enact and municipal police officers may
163+enforce ordinances prohibiting and pena lizing conduct under the
164+provisions of this section. The provisions of such ordinances shall

198-E. Municipalities may enact and municipal police officers may
199-enforce ordinances prohibiting and pena lizing conduct under the
200-provisions of this section. The provisions of such o rdinances shall
201191 be the same as provided for in this section; the enforcement
202192 provisions of those ordinances shall not be more stringent than
203193 those of this section; and the total fine and court costs for
204194 municipal ordinance violations shall not exceed One Hundred Dollars
205195 ($100.00).
206196 F. The Department of Public Safety shall not record or assess
207197 points for violations of this section on any license holder’s
208198 traffic record maintained b y Service Oklahoma.
209199 G. A law enforcement officer shall not, without the consent of
210200 the person:
211201 1. Confiscate a cel lular telephone or electronic communication
212202 device for the purpose of determining compliance with this section;
213203 2. Confiscate a cellular telephone or electronic communication
214204 device and retain it as evidence pending trial for a violation of
215205 this section; or
216206 3. Extract or otherwise download information from a cellular
217207 telephone or electronic communication device for a violation of this
218208 section unless:
219209 a. the law enforcement officer has probable cause to
220210 believe that the cellular telephone or electroni c
211+communication device has been used in the commission
212+of a crime,
213+b. the information is extracted or otherwise downloaded
214+under a valid search warrant, or
