53	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	49		SECTION 1. AMENDATORY 3 O.S. 2021, Section 322, is
55	50		amended to read as follows:
56	51		Section 322. A. As used in this section:
57	52		1. "Critical infrastructure facility" means:
58	53		a. one of the following, if completely enclosed by a
59	54		fence or other physical barrier that is obviously
60	55		designed to exclude intruders, or if clearly marked
61	56		with a sign or signs that are posted on the property,
62	57		are reasonably likely to come to the attention of
63	58		intruders, and indicate that entry is forbidden or
	59	+	flight of unmanned aircraft without site authorization
	60	+	is forbidden:
	61	+	(1) a petroleum or alumina refinery,

93		-	(1) a petroleum or alumina refinery,

105	99		(7) a telecommunications central switching office,
106	100		(8) wireless telecommunications infrastructure,
107	101		including cell towers,
108	102		(9) a port, railroad switching yard, trucking
109	103		terminal or other freight transportation
110	104		facility,
111	105		(10) a gas processing plant, including a plant used in
112	106		the processing, treatment or fractionation of
113	107		natural gas or natural gas liquids,
	108	+	(11) a transmission facility used by a federally
	109	+	licensed radio or television station,
	110	+	(12) a steelmaking facility th at uses an electric arc

141		-	(11) a transmission facility used by a federally
142		-	licensed radio or television sta tion,
143		-	(12) a steelmaking facility that uses an electric arc
144		-	furnace to make steel,
145	138		(13) a facility identified and regulated by the United
146	139		States Department of Homeland Security Chemical
147	140		Facility Anti-Terrorism Standards (CFATS)
148	141		program,
149	142		(14) a dam that is regulated by the state or federal
150	143		government, or
151	144		(15) a natural gas distribution utility facility,
152	145		including, but not limited to, pipeline
153	146		interconnections, a city gate or town border
154	147		station, metering station, aboveground piping, a
155	148		regulator station and a natural gas storage
156	149		facility, or
157	150		b. any aboveground portion of an oil, g as, hazardous
158	151		liquid or chemical pipeline that is enclosed by a
159	152		fence or other physical barrier that is obviously
160	153		designed to exclude intruders;
161	154		2. "Dam" means any barrier, including any appurtenant
162	155		structures, that is constructed for the purpose of permanently or
163	156		temporarily impounding water; and
	157	+	3. "Unmanned aircraft" means an aircraft without occupants that
	158	+	is flown by a pilot via a ground control system or autonomously
	159	+	through use of an onboard computer and other a dditional equipment
	160	+	necessary to operate the aircraft and includes unmanned aircraft
	161	+	commonly called drones.

191		-	3. "Unmanned aircraft" means an aircraft without occupants that
192		-	is flown by a pilot via a ground control system or autonomously
193		-	through use of an onboard computer and other additional equipment
194		-	necessary to operate the aircraft and includes unmanned aircraft
195		-	commonly called drones.
196	188		B. Except as provided in subsection C of this section, a person
197	189		shall not intentionally or knowingly:
198	190		1. Operate an unmanned aircraft over a crit ical infrastructure
199	191		facility if the unmanned aircraft is less than four hundred (400)
200	192		feet above ground level;
201	193		2. Allow an unmanned aircraft to make contact with a critical
202	194		infrastructure facility, including any person or object on the
203	195		premises of or within the facility; or
204	196		3. Allow an unmanned aircraft to come within a distance of a
205	197		critical infrastructure facility that is close enough to interfere
206	198		with the operations of or cause a disturbance to the facility.
207	199		C. This section shall not apply to conduct committed by:
208	200		1. The federal government, the state or a political subdivision
209	201		of the state;
210	202		2. A person under contract with or otherwise acting under the
211	203		direction or on behalf of the federal government, the state or a
212	204		political subdivision of the state;
213	205		3. A law enforcement agency;
	206	+	4. A person under contract with or otherwise acting under the
	207	+	direction or on behalf of a law enforcement agency;
	208	+	5. An owner or operator of the critical infrastructure
	209	+	facility;

241		-	4. A person under contract with or otherwise acting under the
242		-	direction or on behalf of a law enforcement agency;
243		-	5. An owner or operator of the critical infrastructure
244		-	facility;
245	236		6. A person under contract with or otherwis e acting under the
246	237		direction or on behalf of an owner or operator of the critical
247	238		infrastructure facility;
248	239		7. A person who has the prior written consent of the owner or
249	240		operator of the critical infrastructure facility; or
250	241		8. The owner or occupant of the property on which the critical
251	242		infrastructure facility is located or a person who has the prior
252	243		written consent of the owner or occupant of that property ; or
253	244		9. An operator of an unmanned aircraft that is being used for a
254	245		commercial purpose, if the operat or is authorized by the Federal
255	246		Aviation Administration to conduct operations over that airspace .
256	247		D. Any person in violation of this section may be civilly
257	248		liable for damages to the critical infrastructure facility to
258	249		include, but not be limited to, damag e to property, the environment
259	250		or human health.
260	251		SECTION 2. This act shall become effective November 1, 2025.
