161 | 154 | | 2. "Dam" means any barrier, including any appurtenant |

162 | 155 | | structures, that is constructed for the purpose of permanently or |

163 | 156 | | temporarily impounding water; and |

196 | 188 | | B. Except as provided in subsection C of this section, a person |

197 | 189 | | shall not intentionally or knowingly: |

198 | 190 | | 1. Operate an unmanned aircraft over a crit ical infrastructure |
---|
199 | 191 | | facility if the unmanned aircraft is less than four hundred (400) |
---|
200 | 192 | | feet above ground level; |
---|
201 | 193 | | 2. Allow an unmanned aircraft to make contact with a critical |
---|
202 | 194 | | infrastructure facility, including any person or object on the |
---|
203 | 195 | | premises of or within the facility; or |
---|
204 | 196 | | 3. Allow an unmanned aircraft to come within a distance of a |
---|
205 | 197 | | critical infrastructure facility that is close enough to interfere |
---|
206 | 198 | | with the operations of or cause a disturbance to the facility. |
---|
207 | 199 | | C. This section shall not apply to conduct committed by: |
---|
208 | 200 | | 1. The federal government, the state or a political subdivision |
---|
209 | 201 | | of the state; |
---|
210 | 202 | | 2. A person under contract with or otherwise acting under the |
---|
211 | 203 | | direction or on behalf of the federal government, the state or a |
---|
212 | 204 | | political subdivision of the state; |
---|
213 | 205 | | 3. A law enforcement agency; |
---|
245 | 236 | | 6. A person under contract with or otherwis e acting under the |
---|
246 | 237 | | direction or on behalf of an owner or operator of the critical |
---|
247 | 238 | | infrastructure facility; |
---|
248 | 239 | | 7. A person who has the prior written consent of the owner or |
---|
249 | 240 | | operator of the critical infrastructure facility; or |
---|
250 | 241 | | 8. The owner or occupant of the property on which the critical |
---|
251 | 242 | | infrastructure facility is located or a person who has the prior |
---|
252 | 243 | | written consent of the owner or occupant of that property ; or |
---|
253 | 244 | | 9. An operator of an unmanned aircraft that is being used for a |
---|
254 | 245 | | commercial purpose, if the operat or is authorized by the Federal |
---|
255 | 246 | | Aviation Administration to conduct operations over that airspace . |
---|
256 | 247 | | D. Any person in violation of this section may be civilly |
---|
257 | 248 | | liable for damages to the critical infrastructure facility to |
---|
258 | 249 | | include, but not be limited to, damag e to property, the environment |
---|
259 | 250 | | or human health. |
---|
260 | 251 | | SECTION 2. This act shall become effective November 1, 2025. |
