5348 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5449 SECTION 1. AMENDATORY 3 O.S. 2021, Section 322, is
5550 amended to read as follows:
5651 Section 322. A. As used in this section:
5752 1. "Critical infrastructure facility" means:
5853 a. one of the following, if completely enclosed by a
5954 fence or other physical barrier that is obviously
6055 designed to exclude intruders, or if clearly marked
6156 with a sign or signs that are posted on the property,
6257 are reasonably likely to come to the attention of
6358 intruders, and indicate that entry is forbidden or
59+flight of unmanned aircraft without site authorization
60+is forbidden:
61+(1) a petroleum or alumina refinery,

91-flight of unmanned aircraft without site authorization
92-is forbidden:
93-(1) a petroleum or alumina refinery,
9488 (2) an electrical power generating facility,
9589 substation, switching station or electrical
9690 control center,
9791 (3) a chemical, polymer or rubber manufacturing
9892 facility,
9993 (4) a water intake structure, water treatment
10094 facility, wastewater treatment plant or pump
10195 station,
10296 (5) a natural gas compressor station,
10397 (6) a liquid natural gas terminal or storage
10498 facility,
10599 (7) a telecommunications central switching office,
106100 (8) wireless telecommunications infrastructure,
107101 including cell towers,
108102 (9) a port, railroad switching yard, trucking
109103 terminal or other freight transportation
110104 facility,
111105 (10) a gas processing plant, including a plant used in
112106 the processing, treatment or fractionation of
113107 natural gas or natural gas liquids,
108+(11) a transmission facility used by a federally
109+licensed radio or television station,
110+(12) a steelmaking facility th at uses an electric arc

141-(11) a transmission facility used by a federally
142-licensed radio or television sta tion,
143-(12) a steelmaking facility that uses an electric arc
144-furnace to make steel,
145138 (13) a facility identified and regulated by the United
146139 States Department of Homeland Security Chemical
147140 Facility Anti-Terrorism Standards (CFATS)
148141 program,
149142 (14) a dam that is regulated by the state or federal
150143 government, or
151144 (15) a natural gas distribution utility facility,
152145 including, but not limited to, pipeline
153146 interconnections, a city gate or town border
154147 station, metering station, aboveground piping, a
155148 regulator station and a natural gas storage
156149 facility, or
157150 b. any aboveground portion of an oil, g as, hazardous
158151 liquid or chemical pipeline that is enclosed by a
159152 fence or other physical barrier that is obviously
160153 designed to exclude intruders;
161154 2. "Dam" means any barrier, including any appurtenant
162155 structures, that is constructed for the purpose of permanently or
163156 temporarily impounding water; and
157+3. "Unmanned aircraft" means an aircraft without occupants that
158+is flown by a pilot via a ground control system or autonomously
159+through use of an onboard computer and other a dditional equipment
160+necessary to operate the aircraft and includes unmanned aircraft
161+commonly called drones.

191-3. "Unmanned aircraft" means an aircraft without occupants that
192-is flown by a pilot via a ground control system or autonomously
193-through use of an onboard computer and other additional equipment
194-necessary to operate the aircraft and includes unmanned aircraft
195-commonly called drones.
196188 B. Except as provided in subsection C of this section, a person
197189 shall not intentionally or knowingly:
198190 1. Operate an unmanned aircraft over a crit ical infrastructure
199191 facility if the unmanned aircraft is less than four hundred (400)
200192 feet above ground level;
201193 2. Allow an unmanned aircraft to make contact with a critical
202194 infrastructure facility, including any person or object on the
203195 premises of or within the facility; or
204196 3. Allow an unmanned aircraft to come within a distance of a
205197 critical infrastructure facility that is close enough to interfere
206198 with the operations of or cause a disturbance to the facility.
207199 C. This section shall not apply to conduct committed by:
208200 1. The federal government, the state or a political subdivision
209201 of the state;
210202 2. A person under contract with or otherwise acting under the
211203 direction or on behalf of the federal government, the state or a
212204 political subdivision of the state;
213205 3. A law enforcement agency;
206+4. A person under contract with or otherwise acting under the
207+direction or on behalf of a law enforcement agency;
208+5. An owner or operator of the critical infrastructure
209+facility;

241-4. A person under contract with or otherwise acting under the
242-direction or on behalf of a law enforcement agency;
243-5. An owner or operator of the critical infrastructure
244-facility;
245236 6. A person under contract with or otherwis e acting under the
246237 direction or on behalf of an owner or operator of the critical
247238 infrastructure facility;
248239 7. A person who has the prior written consent of the owner or
249240 operator of the critical infrastructure facility; or
250241 8. The owner or occupant of the property on which the critical
251242 infrastructure facility is located or a person who has the prior
252243 written consent of the owner or occupant of that property ; or
253244 9. An operator of an unmanned aircraft that is being used for a
254245 commercial purpose, if the operat or is authorized by the Federal
255246 Aviation Administration to conduct operations over that airspace .
256247 D. Any person in violation of this section may be civilly
257248 liable for damages to the critical infrastructure facility to
258249 include, but not be limited to, damag e to property, the environment
259250 or human health.
260251 SECTION 2. This act shall become effective November 1, 2025.
