48	43		creating the Doran Act of 2025; defining term;
49	44		requiring an automated external defibrillator be on
50	45		health spa premises; providing requirements for
51	46		automated external defibrillator s; providing for
52	47		immunity; allowing for voidable contract; creating a
53	48		tax credit; providing for codification; and providing

59	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	57		SECTION 1. NEW LAW A new section of law not to be
61	58		codified in the Oklahoma Statutes reads as follows:
62	59		This act shall be known and may be cited as th e "Doran Act of
63	60		2025".
64	61		SECTION 2. NEW LAW A new section of law to be codified
65	62		in the Oklahoma Statutes as Section 1 -1030 of Title 63, unless there
66	63		is created a duplication in numbering, reads as follows:

94	90		A. As used in this section, "health spa" means any person,
95	91		firm, corporation, organization, club, or association engaged in the
96	92		sale of:
97	93		1. Memberships in a program of physical exercise that includes
98	94		the use of one or more sauna, whirlpool, weightlifting room,
99	95		massage, steam room, or exercising machine or device; or
100	96		2. The right or privilege to use exercise equipment or
101	97		facilities such as a sauna, whirlpool, weightlifting room, massage,
102	98		steam room, or exercising machine or device, including, but not
103	99		limited to:
104	100		a. for-profit businesses, firms, corporations,
105	101		organizations, clubs, or associations,
106	102		b. bona fide nonprofit organizations, including, but not
107	103		limited to, the Young Men 's Christian Association,
108	104		Young Women's Christian Association, or similar
109	105		organizations whose functions as h ealth spas are only
110	106		incidental to the overall functions and purposes,
111	107		c. any organization primarily operated for the purpose of
112	108		teaching a particular form of martial arts such as
113	109		judo or karate,
114	110		d. any college or university fitness center,
115	111		e. any country club, or
116	112		f. weight-loss or weight-control services which do not
117	113		provide physical exercise facilities and which do not

145	140		obligate the customer for more than twenty -five (25)
146	141		months.
147	142		B. 1. Each health spa shall have at least one automated
148	143		external defibrillat or on the premises.
149	144		2. The defibrillator shall at all times be placed in the
150	145		location that best provides accessibility to staff, members, and
151	146		guests.
152	147		3. An unstaffed health spa shall have on the premises:
153	148		a. a telephone for 9-1-1 telephone call access, and
154	149		b. in plain view:
155	150		(1) a sign indicating the location of the automated
156	151		external defibrillator, and
157	152		(2) a sign providing instruction in the use of the
158	153		automated external defibrillator and in
159	154		cardiopulmonary resuscitation.
160	155		C. No cause of action against a health spa or its employees may
161	156		arise in connection with the use or nonuse of an automated external
162	157		defibrillator unless the health spa has:
163	158		1. Failed to purchase an automated external defibrillator as
164	159		required under this section; or
165	160		2. Acted with gross negligence in the use of an automated
166	161		external defibrillator.

194	188		D. If a health spa does not comply with this section, any
195	189		contract for health spa services shall be voidable at the option of
196	190		the buyer.
197	191		SECTION 3. This act shall become effect ive November 1, 2025.
