5956 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6057 SECTION 1. NEW LAW A new section of law not to be
6158 codified in the Oklahoma Statutes reads as follows:
6259 This act shall be known and may be cited as th e "Doran Act of
6360 2025".
6461 SECTION 2. NEW LAW A new section of law to be codified
6562 in the Oklahoma Statutes as Section 1 -1030 of Title 63, unless there

9490 A. As used in this section, "health spa" means any person,
9591 firm, corporation, organization, club, or association engaged in the
9692 sale of:
9793 1. Memberships in a program of physical exercise that includes
9894 the use of one or more sauna, whirlpool, weightlifting room,
9995 massage, steam room, or exercising machine or device; or
10096 2. The right or privilege to use exercise equipment or
10197 facilities such as a sauna, whirlpool, weightlifting room, massage,
10298 steam room, or exercising machine or device, including, but not
10399 limited to:
104100 a. for-profit businesses, firms, corporations,
105101 organizations, clubs, or associations,
106102 b. bona fide nonprofit organizations, including, but not
107103 limited to, the Young Men 's Christian Association,
108104 Young Women's Christian Association, or similar
109105 organizations whose functions as h ealth spas are only
110106 incidental to the overall functions and purposes,
111107 c. any organization primarily operated for the purpose of
112108 teaching a particular form of martial arts such as
113109 judo or karate,
114110 d. any college or university fitness center,
115111 e. any country club, or
116112 f. weight-loss or weight-control services which do not
117113 provide physical exercise facilities and which do not

145140 obligate the customer for more than twenty -five (25)

147142 B. 1. Each health spa shall have at least one automated
148143 external defibrillat or on the premises.
149144 2. The defibrillator shall at all times be placed in the
150145 location that best provides accessibility to staff, members, and
151146 guests.
152147 3. An unstaffed health spa shall have on the premises:
153148 a. a telephone for 9-1-1 telephone call access, and
154149 b. in plain view:
155150 (1) a sign indicating the location of the automated
156151 external defibrillator, and
157152 (2) a sign providing instruction in the use of the
158153 automated external defibrillator and in
159154 cardiopulmonary resuscitation.
160155 C. No cause of action against a health spa or its employees may
161156 arise in connection with the use or nonuse of an automated external
162157 defibrillator unless the health spa has:
163158 1. Failed to purchase an automated external defibrillator as
164159 required under this section; or
165160 2. Acted with gross negligence in the use of an automated
166161 external defibrillator.

194188 D. If a health spa does not comply with this section, any
195189 contract for health spa services shall be voidable at the option of
196190 the buyer.
197191 SECTION 3. This act shall become effect ive November 1, 2025.
