4857 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4958 SECTION 1. NEW LAW A new section of l aw to be codified
5059 in the Oklahoma Statutes as Section 255.10 of Title 62, unless there
5160 is created a duplication in numbering, reads as follows:
5261 A. The Office of Management and Enterprise Services shall
5362 develop a form for use by each agency, board, commiss ion, department
5463 or other entity organized within the executive branch of state
5564 government for use by such governmental entity in identifying
5665 prospective vendors for contracts to manage federal funds if such
5766 funds management is permissible pursuant to the f ederal law enabling
58-and transferring such funds for expenditure by the state
59-governmental entity. Each such governmental entity shall complete
60-the form and submit it to the Office of Management and E nterprise

95+governmental entity. Each such governmental entity shall complete
96+the form and submit it to the Office of Management and Enterprise
8797 Services as required by the Office of Manageme nt and Enterprise
8898 Services.
8999 B. The form shall include, but shall not be limited to, the
90100 following:
91101 1. The legal name of the entity proposing to manage the federal
92102 funds pursuant to contract, including any trade name or similar name
93103 which is not the forma l legal name of the entity that will enter
94104 into the contract;
95105 2. The jurisdiction in which the prospective vendor entity was
96106 originally incorporated or otherwise created pursuant to the laws of
97107 the applicable jurisdiction;
98108 3. The legal names of the princ ipal officers of the prospective
99109 vendor entity which proposes to manage the federal funds, which may
100110 include, but shall not be limited to the chief executive officer,
101111 the chief financial officer, the chief information or technology
102112 officer and the chief op erating officer;
103113 4. A listing of the prior experience of the prospective vendor
104114 entity or its officers or employees with regard to the management of
105115 federal funds on behalf of any state or local government entity;
106116 5. The most recently completed financial audit of the books and
107117 records of the prospective vendor entity prior to the date as of
108-which the form prescribed pursuant to the provis ions of this section
109-is submitted to the Office of Management a nd Enterprise Services, in
110-cases involving a vendor with no prior experience in the management

145+which the form prescribed pursuant to the provisions of this section
146+is submitted to the Office of Management and Enterprise Services, in
147+cases involving a vendor with no prior experience in the management
137148 of federal funds. No vendor shall be required to disclose
138149 information which is proprietary or protected from disclosure by
139150 private agreement or that is considered to be a trade secret.
140151 6. Any and all pending civil c ases, whether in federal court,
141152 state court or the judicial system of any other country or nation
142153 which identifies the prospective vendor entity as a defendant in a
143154 proceeding related directly to the management of federal funds.
144155 SECTION 2. NEW LAW A new section of law to be codified
145156 in the Oklahoma Statutes as Section 255.11 of Title 62, unless there
146157 is created a duplication in numbering, reads as follows:
147158 The forms submitted to the Office of Management and Enterprise
148159 Servies as required by this act shall also be submitted to the
149160 Governor, the Speaker of the Oklahoma House of Representatives, the
150161 President Pro Tempore of the Oklahoma State Senate, and the Chairs
151162 and Vice-Chairs of the standing committees of both chambers of the
152163 Oklahoma Legislature responsible for appropriation and budget
153164 matters.
154165 SECTION 3. This act shall become effective November 1, 2025.
