40	49		Services; requiring certain form for use in contracts
41	50		related to management of federal funds; prescribing

48	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	58		SECTION 1. NEW LAW A new section of l aw to be codified
50	59		in the Oklahoma Statutes as Section 255.10 of Title 62, unless there
51	60		is created a duplication in numbering, reads as follows:
52	61		A. The Office of Management and Enterprise Services shall
53	62		develop a form for use by each agency, board, commiss ion, department
54	63		or other entity organized within the executive branch of state
55	64		government for use by such governmental entity in identifying
56	65		prospective vendors for contracts to manage federal funds if such
57	66		funds management is permissible pursuant to the f ederal law enabling
58		-	and transferring such funds for expenditure by the state
59		-	governmental entity. Each such governmental entity shall complete
60		-	the form and submit it to the Office of Management and E nterprise

	94	+	and transferring such funds for expenditure by the state
	95	+	governmental entity. Each such governmental entity shall complete
	96	+	the form and submit it to the Office of Management and Enterprise
87	97		Services as required by the Office of Manageme nt and Enterprise
88	98		Services.
89	99		B. The form shall include, but shall not be limited to, the
90	100		following:
91	101		1. The legal name of the entity proposing to manage the federal
92	102		funds pursuant to contract, including any trade name or similar name
93	103		which is not the forma l legal name of the entity that will enter
94	104		into the contract;
95	105		2. The jurisdiction in which the prospective vendor entity was
96	106		originally incorporated or otherwise created pursuant to the laws of
97	107		the applicable jurisdiction;
98	108		3. The legal names of the princ ipal officers of the prospective
99	109		vendor entity which proposes to manage the federal funds, which may
100	110		include, but shall not be limited to the chief executive officer,
101	111		the chief financial officer, the chief information or technology
102	112		officer and the chief op erating officer;
103	113		4. A listing of the prior experience of the prospective vendor
104	114		entity or its officers or employees with regard to the management of
105	115		federal funds on behalf of any state or local government entity;
106	116		5. The most recently completed financial audit of the books and
107	117		records of the prospective vendor entity prior to the date as of
108		-	which the form prescribed pursuant to the provis ions of this section
109		-	is submitted to the Office of Management a nd Enterprise Services, in
110		-	cases involving a vendor with no prior experience in the management

	145	+	which the form prescribed pursuant to the provisions of this section
	146	+	is submitted to the Office of Management and Enterprise Services, in
	147	+	cases involving a vendor with no prior experience in the management
137	148		of federal funds. No vendor shall be required to disclose
138	149		information which is proprietary or protected from disclosure by
139	150		private agreement or that is considered to be a trade secret.
140	151		6. Any and all pending civil c ases, whether in federal court,
141	152		state court or the judicial system of any other country or nation
142	153		which identifies the prospective vendor entity as a defendant in a
143	154		proceeding related directly to the management of federal funds.
144	155		SECTION 2. NEW LAW A new section of law to be codified
145	156		in the Oklahoma Statutes as Section 255.11 of Title 62, unless there
146	157		is created a duplication in numbering, reads as follows:
147	158		The forms submitted to the Office of Management and Enterprise
148	159		Servies as required by this act shall also be submitted to the
149	160		Governor, the Speaker of the Oklahoma House of Representatives, the
150	161		President Pro Tempore of the Oklahoma State Senate, and the Chairs
151	162		and Vice-Chairs of the standing committees of both chambers of the
152	163		Oklahoma Legislature responsible for appropriation and budget
153	164		matters.
154	165		SECTION 3. This act shall become effective November 1, 2025.
