40	40	An Act relating to marriage; authorizing courts to
41	41	order additional periods of possession or access to a
42	42	child under certain circumstances; directing courts
43	43	to order additional periods of possession or access;
44	44	establishing requirements for additional periods of
45	45	possession or access; making persons denied
46	46	possession or access entitled to determine times of
47	47	additional possession or access; pros cribing causes
48	48	of action against the Department of Human Services ;
49	49	providing for sovereign immunity; providing for
50	50	codification; and providing an effective date .

56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. NEW LAW A new section of law to be codified
58	58	in the Oklahoma Statutes as Section 107.5 of Title 43, unless there
59	59	is created a duplication in numbering, reads as follows:
60	60	A. Except as provided in paragraph 1 of this subsection, a
61	61	court may order addi tional periods of possession of or access to a
62	62	child to compensate for the den ial of court-ordered possession or
63	63	access.
64	64	1. Unless a party shows good cause why the order should not be
65	65	rendered, a court shall order additional periods of possession of or

92	92	access to a child to compensate for a denial of court -ordered
93	93	possession or access that resulted from an investigation by the
94	94	Department of Human Services that did not result in a finding of
95	95	abuse or neglect.
96	96	2. The additional periods of possession or acces s:
97	97	a. shall be of the same type and duration of the
98	98	possession or access that was denied,
99	99	b. may include weekend, holiday, and summer possession or
100	100	access, and
101	101	c. shall occur on or before the second anniversary of the
102	102	date the court finds that court -ordered possession or
103	103	access has been denied.
104	104	B. The person denied possession or access is entitled to decide
105	105	the time of the additional possession or access, subject to the
106	106	provisions of paragraph 2 of subsection A of this section.
107	107	C. Paragraph 1 of subsectio n A of this section shall not:
108	108	1. Create a cause of action against the Depart ment of Human
109	109	Services; or
110	110	2. Waive sovereign immunity to suit or liability.
111	111	SECTION 2. This act shall become effective November 1, 2025.
