4040 An Act relating to marriage; authorizing courts to

4242 child under certain circumstances; directing courts
4343 to order additional periods of possession or access;
4444 establishing requirements for additional periods of
4545 possession or access; making persons denied
4646 possession or access entitled to determine times of
4747 additional possession or access; pros cribing causes
4848 of action against the Department of Human Services ;
4949 providing for sovereign immunity; providing for
5050 codification; and providing an effective date .

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new section of law to be codified
5858 in the Oklahoma Statutes as Section 107.5 of Title 43, unless there
5959 is created a duplication in numbering, reads as follows:
6060 A. Except as provided in paragraph 1 of this subsection, a
6161 court may order addi tional periods of possession of or access to a
6262 child to compensate for the den ial of court-ordered possession or
6363 access.
6464 1. Unless a party shows good cause why the order should not be
6565 rendered, a court shall order additional periods of possession of or

9292 access to a child to compensate for a denial of court -ordered
9393 possession or access that resulted from an investigation by the
9494 Department of Human Services that did not result in a finding of
9595 abuse or neglect.
9696 2. The additional periods of possession or acces s:
9797 a. shall be of the same type and duration of the
9898 possession or access that was denied,
9999 b. may include weekend, holiday, and summer possession or
100100 access, and
101101 c. shall occur on or before the second anniversary of the
102102 date the court finds that court -ordered possession or
103103 access has been denied.
104104 B. The person denied possession or access is entitled to decide
105105 the time of the additional possession or access, subject to the
106106 provisions of paragraph 2 of subsection A of this section.
107107 C. Paragraph 1 of subsectio n A of this section shall not:
108108 1. Create a cause of action against the Depart ment of Human
109109 Services; or
110110 2. Waive sovereign immunity to suit or liability.
111111 SECTION 2. This act shall become effective November 1, 2025.
