4040 An Act relating to crimes and punishments; amending
4141 21 O.S. 2021, Section 1031, as last amended by
4242 Section 2, Chapter 267, O.S.L. 2024 (21 O.S. Supp.
4343 2024, Section 1031), which relates to the Oklahoma
4444 Law on Obscenity and Child Pornography; providing
4545 statutory reference for certain prostitution offense;

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
5353 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1031, as
5454 last amended by Section 2, Chapter 267, O.S.L. 2024 (21 O.S. Supp.
5555 2024, Section 1031), is amended to read as follows:
5656 Section 1031. A. Except as provided in subsecti on B, C, D, or
5757 E of this section, any person violating any of the provisions of
5858 paragraph 1, 2, 3, or 5 of subsection A of Section 1029 or Section
5959 1030 of this title shall, upon conviction, be guilty of a
6060 misdemeanor and shall be punished by imprisonment i n the county jail
6161 for not less than thirty (30) days nor more than one (1) yea r or by
6262 fines as follows: a fine not more than Two Thousand Five Hundred
6363 Dollars ($2,500.00) upon the first conviction for violation of any

9090 of such provisions, a fine not more t han Five Thousand Dollars
9191 ($5,000.00) upon the second conviction for violation of any of such
9292 provisions, and a fine not more than Seven Thousand Five Hundred
9393 Dollars ($7,500.00) upon the third or subsequent convictions for
9494 violation of any of such provisi ons, or by both such imprisonment
9595 and fine. In addition, the court may requir e a term of community
9696 service not less than forty (40) nor more than eighty (80) hours.
9797 The court in which any such conviction is had shall notify the
9898 county superintendent of p ublic health of such conviction.
9999 B. Any person who engages in an act of prostitution with
100100 knowledge that he or she is infected with the human immunodeficiency
101101 virus shall, upon conviction, be guilty of a felony punishable by
102102 imprisonment in the custody of the Department of Corrections for not
103103 more than five (5) years.
104104 C. Any person who engages in an act of child prostitution as
105105 defined in Section 1030 of this title shall, upon conviction, be
106106 guilty of a felony punishable by imprisonment in the custody of the
107107 Department of Corrections for not more than ten (10) years and by
108108 fines as follows: a fine not more than Five Thousand Dollars
109109 ($5,000.00) upon the first conviction, a fine not more than Ten
110110 Thousand Dollars ($10,000.00) upon the second conviction, an d a fine
111111 not more than Fifteen Thousand Dollars ($15,000.00) upon the third
112112 or subsequent convictions.

139139 D. Any person violating any of the provisions of Section 1029
140140 or 1030 of this title within one thousand (1,000) feet of a school
141141 or church shall, upon c onviction, be guilty of a felony and shall be
142142 punished by imprisonment in the custody of the Department of
143143 Corrections for not more than five (5) years or by fines as follows:
144144 a fine not more than Two Thousand Five Hundred Dollars ($2,500.00)
145145 upon the first conviction for violation of any of such provisions, a
146146 fine not more than Fi ve Thousand Dollars ($5,000.00) upon the second
147147 conviction for violation of any of such provisions, and a fine not
148148 more than Seven Thousand Five Hundred Dollars ($7,500.00) upon the
149149 third or subsequent convictions for violation of any of such
150150 provisions, or by both such imprisonment and fine. In addition, the
151151 court may require a term of community service not less than forty
152152 (40) nor more than eighty (80) hours. The court in whic h any such
153153 conviction is had shall notify the county superintendent of public
154154 health of such conviction.
155155 E. Any person violating paragraph 4 of subsection A of Section
156156 1029 of this title shall, upon conviction, be guilty of a felony and
157157 shall be punished in accordance with the provisions of paragraph 1
158158 of subsection B of Section 1040.57 of this title.
159159 SECTION 2. This act shall become effective November 1, 2025.
