40	40	An Act relating to law enforcement officers; stating
41	41	membership requirements for government entities that
42	42	establish citizen review boards ; requiring majority
43	43	vote when making findings or recommendations;
44	44	providing procedures when membership requirements are
45	45	not met; providing exemptions; stating findings of
46	46	the Legislature; providing for codification; and
47	47	providing an effective date.

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 34.6 of Title 22, unless there
55	55	is created a duplication in numbering, reads as follo ws:
56	56	A. When a government entity establishes a citizen review board
57	57	to investigate an allegation of misconduct by a law enforcement
58	58	officer, at least two -thirds (2/3) of the committee, board, agency,
59	59	department, office or entity that makes a recommendation or imposes
60	60	disciplinary action shall be composed of law enforcement officers
61	61	certified by the Council on Law Enforcement Education and Training.

88	88	B. Any findings or recommendations from any committee, board,
89	89	agency, department, office or entity shall requ ire a majority vote
90	90	to do any of the following:
91	91	1. Investigate law enforcement officer misconduct;
92	92	2. Influence the conduct of or certify law enforcement officer
93	93	misconduct investigations;
94	94	3. Recommend disciplinary actions for law enforcement officer
95	95	misconduct; or
96	96	4. Impose discipline for law enforcement officer misconduct.
97	97	C. If the person or committee, board, agency, department,
98	98	office or entity does not meet the two -thirds (2/3) requirement
99	99	prescribed in subsection A of this section, a supervisor, a
100	100	department or an agency head that supervises a law enforcement
101	101	officer may investigate and impose discipline for the law
102	102	enforcement officer's misconduct if the supervisor, department or
103	103	agency head acts independently of the person, committee, board,
104	104	agency, department, office or entity.
105	105	D. This section shall not apply to any of the following:
106	106	1. A person or a committee, board, agency, department, office,
107	107	civil service board or entity that only reviews the actions
108	108	described in subsection A of this secti on and does not determine the
109	109	initial level of discipline or have the authority to increase the
110	110	severity of the disciplinary action;

137	137	2. The Council on Law Enforcement Education and Training
138	138	(CLEET);
139	139	3. A multijurisdictional law enforcement agency or task force
140	140	or a similar entity that is charged with investigating the use of
141	141	force by law enforcement officers, if at least two -thirds (2/3) of
142	142	the membership of the multijurisdictional law enforcement agency or
143	143	task force or the similar entity consists of law enforcement
144	144	officers who are certified by CLEET;
145	145	4. An entity that investigates federal employment
146	146	discrimination; and
147	147	5. The Oklahoma State Bureau of Investigation.
148	148	E. The Legislature finds that setting and maintaining standards
149	149	of professionalism and integrity of law enforcement officers in this
150	150	state are of statewide concern.
151	151	SECTION 2. This act shall become effective November 1, 202 5
