55	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56	51		SECTION 1. AMENDATORY 74 O.S. 2021, Section 62.3, is
57	52		amended to read as follows:
58	53		Section 62.3. A. The Director of the Office of Management and
59	54		Enterprise Services shall promulgate rules for use by state agencies
60	55		and the Office of Management and Enterprise Services to dispose of
61	56		surplus property. The rules shall include standards for
62	57		recordkeeping, methods for removal or disposal of surplus property,
63	58		and acquisition by state agencies and authorized entities of surplus
64	59		property, and for Office management of surplus property programs.

92	86		B. A state agency selling, trading, redistributing or otherwise
93	87		disposing of surplus property shall comply with the rules
94	88		promulgated by the Director.
95	89		C. The Office shall make surplus property available to state
96	90		agencies and authorized entities, which shall include political
97	91		subdivisions, school districts, and nonprofit entities of this
98	92		state.
99	93		D. The provisions of the Oklahoma Surplus Property Act shall
100	94		not apply to institutions of higher education in this state, the
101	95		Oklahoma Historical Society, the University Hospitals Authority or
102	96		University Hospitals Trust or the Northeast Oklahoma Public
103	97		Facilities Authority. The Grand River Dam Au thority shall be exempt
104	98		from the provisions of the Oklahoma Surplus Property Act for any
105	99		surplus property disposed of prior to November 1, 2006. CompSource
106	100		Oklahoma shall be exempt from the provisions of the Oklahoma Surplus
107	101		Property Act if CompSource Okl ahoma is operating pursuant to a pilot
108	102		program authorized by Sections 3316 and 3317 of this title.
109	103		E. Notwithstanding the provisions of the Oklahoma Surplus
110	104		Property Act, the Oklahoma State Bureau of Investigation may,
111	105		pursuant to rules promulgated by the Oklahoma State Bureau of
112	106		Investigation Commission for that purpose, donate any surplus
113	107		property, as defined in Section 62.2 of this title, to any law
114	108		enforcement agency of any political subdivision of the State of
115	109		Oklahoma. The use of such donated equipm ent shall be limited to

143	136		valid and authorized law enforcement efforts by the receiving
144	137		agency.
145	138		F. Notwithstanding the provisions of the Oklahoma Surplus
146	139		Property Act, the Oklahoma Highway Patrol may, pursuant to rules
147	140		promulgated by the Director of the Off ice of Management and
148	141		Enterprise Services, donate surplus Oklahoma Highway Patrol vehicles
149	142		driven over ninety thousand (90,000) miles to any law enforcement
150	143		agency of any political subdivision of the State of Oklahoma in a
151	144		county with a population of no mo re than one hundred thousand
152	145		(100,000) residents. The use of such donated vehicles shall be
153	146		limited to valid and authorized law enforcement efforts by the
154	147		receiving agency.
155	148		SECTION 2. This act shall become effective November 1, 2025.
