40	40	An Act relating to marriage; amending 43 O.S. 2021,
41	41	Section 105, which relates to dissolution of
42	42	marriage; directing the Oklahoma Bar Ass ociation to
43	43	prepare standard forms; directing the Administrative
44	44	Office of the Courts to provide access to forms;
45	45	providing that standardized forms are not required;

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
53	53	SECTION 1. AMENDATORY 43 O.S. 2021, Section 105, is
54	54	amended to read as follows:
55	55	Section 105. A. A proceeding for dissolution of marriage, an
56	56	annulment of a marriage, or a legal separation shall be titled "In
57	57	re the Marriage of _______ and ______ ".
58	58	B. The initial pleading in all proceedings under this title
59	59	shall be denominated a petition. The person filing the petition
60	60	shall be called the petitioner. A responsive pleading shall be
61	61	denominated a response. The person f iling the responsive pleading
62	62	shall be called the respondent. Other pleadings shall be

89	89	denominated as provided in the Rules of Civil Procedure, except as
90	90	otherwise provided in this section.
91	91	C. The petition must be verified as true, by the affidavit of
92	92	the petitioner.
93	93	D. A summons may issue thereon, and shall be served, or
94	94	publication made, as in other civil cases.
95	95	E. Wherever it occurs in this title or in any other title of
96	96	the Oklahoma Statutes or in any forms or court documents prepared
97	97	pursuant to the provisions of the Oklahoma Statutes, the term
98	98	"divorce" shall mean and be de emed to refer to a "dissolution of
99	99	marriage" unless the context or subject matter otherwise requires.
100	100	F. Standard forms sufficient to meet the statutory requirements
101	101	of this section and any other relevant sections in this title to
102	102	complete a divorce proceeding shall be prepared by the Oklahoma Bar
103	103	Association in plain and understandable language. The
104	104	Administrative Office of the Courts shall provide public access to
105	105	the forms by providing a link on the Oklahoma State Courts Network.
106	106	Such standardized forms shall not be required to be used in any
107	107	proceeding.
108	108	SECTION 2. This act shall become effective November 1, 2025.
