5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 22 O.S. 2021, Section 180, is
5454 amended to read as follows:
5555 Section 180. When, by the preceding sections of this chapter,
5656 the defendant is required to be taken before the magistrate who
5757 issued the warrant, he may the defendant shall, if the magistrate be
5858 absent or unable to act, be taken before the nearest or most
5959 accessible magistrate in the same county or nearest adjoining
6060 county, if necessary, no later than seventy -two (72) hours after
6161 arrest. The officer must shall, at the same time, deliver to the
6262 magistrate the warrant, with the return en dorsed and subscribed by
6363 him the officer.

9090 SECTION 2. AMENDATORY 22 O.S. 2021, Section 181, is
9191 amended to read as follows:
9292 Section 181. The defendant must shall, in all cases, be taken
9393 before the magistrate without unnecessary delay and no later than
9494 seventy-two (72) hours after arrest .
9595 SECTION 3. AMENDATORY 22 O.S. 2021, Section 1105, is
9696 amended to read as follows:
9797 Section 1105. A. Except as otherwise provided by this section,
9898 upon the allowance of bail and the execution of the requisite
9999 recognizance, bond, or undertaking to the state, the magistrate,
100100 judge, or court shall, if the defendant is in custody, make and sign
101101 an order for discharge no later than seventy -two (72) hours after
102102 arrest. The court, in its discretion, may prescribe by court rule
103103 the conditions under which the court clerk or deputy court clerk, or
104104 the sheriff or deputy sheriff, may prepare and execute an orde r of
105105 release on behalf of the court.
106106 B. No police officer or sheriff may rele ase a person arrested
107107 for a violation of an ex parte or final protective order as provided
108108 in Sections 60.2 and 60.3 of this title, or arrested for an act
109109 constituting domestic a buse as specified in Section 644 of Title 21
110110 of the Oklahoma Statutes, or arrested for any act constituting
111111 domestic abuse, stalking or harassment as defined by Section 60.1 of
112112 this title, or arrested for an act constituting domestic assault and
113113 battery or domestic assault and battery with a deadly weapon

140140 pursuant to Section 644 of Title 21 of the Oklahoma Statutes,
141141 without the violator appearing before a magistrate, judge or court.
142142 To the extent that any of the following information is available to
143143 the court, the magistrate, judge or court shall consider, in
144144 addition to any other circumstances, before determining bond and
145145 other conditions of release as necessary for the protection of the
146146 alleged victim, the following:
147147 1. Whether the person has a history o f domestic violence or a
148148 history of other violent acts;
149149 2. The mental health of the person;
150150 3. Whether the person has a history of violating the orders of
151151 any court or governmental entity;
152152 4. Whether the person is potentially a threat to any other
153153 person;
154154 5. Whether the person has a history of abusing alcohol or any
155155 controlled substance;
156156 6. Whether the person has access to deadly weapons or a history
157157 of using deadly weapons;
158158 7. The severity of the alleged violence that is the basis of
159159 the alleged offense including, but not limited to:
160160 a. the duration of the alleged violent inci dent,
161161 b. whether the alleged violent incident involved serious
162162 physical injury,

189189 c. whether the alleged violent incident involved sexual
190190 assault,
191191 d. whether the alleged violent in cident involved
192192 strangulation,
193193 e. whether the alleged violent incident involved abuse
194194 during the pregnancy of the alleged victim,
195195 f. whether the alleged violent incident involved the
196196 abuse of pets, or
197197 g. whether the alleged violent incident involved forcib le
198198 entry to gain access to the alleged victim;
199199 8. Whether a separation of the person from the alleged victim
200200 or a termination of the relationship between the person and the
201201 alleged victim has recently occurred or is pending;
202202 9. Whether the person has exh ibited obsessive or controlling
203203 behaviors toward the alleged victim including, but not limited to,
204204 stalking, surveillance, or isolation of the alleged victim;
205205 10. Whether the person has expressed suicidal or homicidal
206206 ideations; and
207207 11. Any information c ontained in the complaint and any police
208208 reports, affidavits, or other documen ts accompanying the complaint.
209209 C. A person arrested for:
210210 1. A violation of an ex parte or final protective order as
211211 provided in Sections 60.2 and 60.3 of this title;

238238 2. An act constituting domestic abuse, domestic assault and
239239 battery or domestic assault and battery with a deadly weapon as
240240 specified in Section 644 of Title 21 of the Oklahoma Statutes; or
241241 3. An act constituting domestic abuse, stalking or harassment
242242 as defined by Section 60.1 of this title,
243243 shall not be eligible for a personal recognizanc e bond pursuant to
244244 Section 1108.1 of this title.
245245 D. No police officer or sheriff may release a person arrested
246246 for any violation of subsection G of Section 2 -401 of Title 63 of
247247 the Oklahoma Statutes, without the violator appearing before a
248248 magistrate, judge, or court. In determining bond and other
249249 conditions of release, the magistrate, judge, or court shall
250250 consider any evidence that the person is in any manner dependent
251251 upon a controlled dangerous substance or has a pattern of regular,
252252 illegal use of any controlled dangerous substance. A rebuttable
253253 presumption that no conditions of release on bond would assure the
254254 safety of the community or any person therein shall arise if the
255255 state shows by clear and convincing evidence:
256256 1. The person was arrested for a violation of subsection G of
257257 Section 2-401 of Title 63 of the Oklahoma Statutes, relating to
258258 manufacturing or attempting to manufacture a controlled dangerous
259259 substance, or possessing any of the substances listed in subsection
260260 G of Section 2-401 of Title 63 of the Oklahoma Statutes with the
261261 intent to manufacture a controlled dangerous substance; and

288288 2. The person is in any manner dependent upon a controlled
289289 dangerous substance or has a pattern of regular illegal use of a
290290 controlled dangerous substance, and the violation referred to in
291291 paragraph 1 of this subsection was committed or attempted in order
292292 to maintain or facilitate the dependence or pattern of illegal use
293293 in any manner.
294294 SECTION 4. This act shall become effective November 1, 20 25.
