52 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

53 | 53 | | SECTION 1. AMENDATORY 22 O.S. 2021, Section 180, is |
---|
54 | 54 | | amended to read as follows: |

55 | 55 | | Section 180. When, by the preceding sections of this chapter, |
---|
56 | 56 | | the defendant is required to be taken before the magistrate who |
---|

150 | 150 | | 3. Whether the person has a history of violating the orders of |
---|
151 | 151 | | any court or governmental entity; |
---|
152 | 152 | | 4. Whether the person is potentially a threat to any other |
---|
153 | 153 | | person; |
---|
154 | 154 | | 5. Whether the person has a history of abusing alcohol or any |
---|
155 | 155 | | controlled substance; |
---|
156 | 156 | | 6. Whether the person has access to deadly weapons or a history |
---|
157 | 157 | | of using deadly weapons; |
---|
158 | 158 | | 7. The severity of the alleged violence that is the basis of |
---|
159 | 159 | | the alleged offense including, but not limited to: |

160 | 160 | | a. the duration of the alleged violent inci dent, |

---|
201 | 201 | | alleged victim has recently occurred or is pending; |
---|
202 | 202 | | 9. Whether the person has exh ibited obsessive or controlling |
---|
203 | 203 | | behaviors toward the alleged victim including, but not limited to, |
---|
204 | 204 | | stalking, surveillance, or isolation of the alleged victim; |
---|
205 | 205 | | 10. Whether the person has expressed suicidal or homicidal |
---|
206 | 206 | | ideations; and |
---|
207 | 207 | | 11. Any information c ontained in the complaint and any police |
---|
208 | 208 | | reports, affidavits, or other documen ts accompanying the complaint. |
---|
209 | 209 | | C. A person arrested for: |

210 | 210 | | 1. A violation of an ex parte or final protective order as |
---|
211 | 211 | | provided in Sections 60.2 and 60.3 of this title; |

245 | 245 | | D. No police officer or sheriff may release a person arrested |
---|
246 | 246 | | for any violation of subsection G of Section 2 -401 of Title 63 of |
---|
247 | 247 | | the Oklahoma Statutes, without the violator appearing before a |
---|
248 | 248 | | magistrate, judge, or court. In determining bond and other |
---|
249 | 249 | | conditions of release, the magistrate, judge, or court shall |
---|
250 | 250 | | consider any evidence that the person is in any manner dependent |
---|
251 | 251 | | upon a controlled dangerous substance or has a pattern of regular, |
---|
252 | 252 | | illegal use of any controlled dangerous substance. A rebuttable |
---|
253 | 253 | | presumption that no conditions of release on bond would assure the |
---|
254 | 254 | | safety of the community or any person therein shall arise if the |
---|
255 | 255 | | state shows by clear and convincing evidence: |
---|
256 | 256 | | 1. The person was arrested for a violation of subsection G of |
---|
257 | 257 | | Section 2-401 of Title 63 of the Oklahoma Statutes, relating to |
---|
258 | 258 | | manufacturing or attempting to manufacture a controlled dangerous |
---|
259 | 259 | | substance, or possessing any of the substances listed in subsection |
---|
260 | 260 | | G of Section 2-401 of Title 63 of the Oklahoma Statutes with the |
---|
261 | 261 | | intent to manufacture a controlled dangerous substance; and |
---|
