| 50 | 50 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

| 51 | 51 | | SECTION 1. AMENDATORY 21 O.S. 2021, Section 540, is |

| 52 | 52 | | amended to read as follows: |

| 53 | 53 | | Section 540. A. Any person who willfully delays or obstructs |

| 54 | 54 | | any public officer in the discharge or attempt to discharge any duty |

| 55 | 55 | | of his or her office , is, upon conviction, guilty of a misdemeanor. |

| 56 | 56 | | B. Nothing in this section shall preclude a person fro m |
|---|
| 57 | 57 | | recording the activity of law enforcement in a public area, as long |
|---|
| 58 | 58 | | as the recording activity does not delay or obstruct the law |
|---|
| 59 | 59 | | enforcement agent in his or her duties. |

| 60 | 60 | | C. Inquiries by a person being stopped, detained, or arrested |
|---|
| 61 | 61 | | by a law enforcement officer or by a bystander who is observing |
