4040 An Act relating to crimes and punishments; amending
4141 21 O.S. 2021, Section 540, which relates to
4242 obstruction of justice; clarifying scope of certain
4343 prohibited act; providing an exception; and providing

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 21 O.S. 2021, Section 540, is
5252 amended to read as follows:
5353 Section 540. A. Any person who willfully delays or obstructs
5454 any public officer in the discharge or attempt to discharge any duty
5555 of his or her office , is, upon conviction, guilty of a misdemeanor.
5656 B. Nothing in this section shall preclude a person fro m
5757 recording the activity of law enforcement in a public area, as long
5858 as the recording activity does not delay or obstruct the law
5959 enforcement agent in his or her duties.
6060 C. Inquiries by a person being stopped, detained, or arrested
6161 by a law enforcement officer or by a bystander who is observing
6262 another person being stopped, detai ned, or arrested by a law

8989 enforcement officer, shall not be deemed obstruction of justice ,

9191 intended to hinder, d elay, or obstruct the authority of the law
9292 enforcement officer in discharging his or her duties .
9393 SECTION 2. This act shall become effective November 1, 2025.
