116 | 125 | | to qualifying applicants who are registered with the Secretary of |
---|
117 | 126 | | State and otherwise meet the requirements for a medical marijuana |
---|
118 | 127 | | business license set forth in the Oklahoma Medical Marijuana and |
---|
119 | 128 | | Patient Protection Act and the requirements set forth in this |
---|
120 | 129 | | section to provide logistics, distribution and storage of medical |
---|
151 | 161 | | ownership. A licensed medical marijuana transporter shall be |
---|
152 | 162 | | responsible for all medical marijuana, medical marijuana concentrate |
---|
153 | 163 | | and medical marijuana products once the transporter takes control of |
---|
154 | 164 | | the product. |
---|
155 | 165 | | E. A transporter license shall be required for any person or |
---|
156 | 166 | | entity to transport or transfer medical marijuana, medical marijuana |

---|

161 | 171 | | F. A medical marijuana transporter licensee may contract with |

162 | 172 | | multiple licensed medical marijuana businesses. |
---|
163 | 173 | | G. A medical marijuana transporter may maintain a licensed |
---|
164 | 174 | | premises to temporarily store medical marijuana, medical marijuana |
---|
165 | 175 | | concentrate and medical marijuana products and to use as a |
---|
166 | 176 | | centralized distribution point. A medical marijuana transporter may |
---|
167 | 177 | | store and distribute medic al marijuana, medical marijuana |
---|
168 | 178 | | concentrate and medical marijuana products from the licensed |
---|
169 | 179 | | premises. The licensed premises shall meet all security |
---|
170 | 180 | | requirements applicable to a medical marijuana business. The |
---|
200 | 211 | | H. A medical marijuana transporter licensee shall use the seed - |
---|
201 | 212 | | to-sale tracking system developed pursuant to the Oklah oma Medical |
---|
202 | 213 | | Marijuana and Patient Protection Act to create shipping inventory |
---|
203 | 214 | | manifests documenting the transport or temporary storage of medical |
---|
204 | 215 | | marijuana, medical marijuana concentrate , and medical marijuana |
---|
205 | 216 | | products throughout the state. |
---|
206 | 217 | | I. A licensed medical marijuana transporter may maintain and |
---|
207 | 218 | | operate one or more warehouses in the state to handle medical |
---|
208 | 219 | | marijuana, medical marijuana concentrate and medical marijuana |
---|
209 | 220 | | products, provided the licensed medical marijuana transporter |
---|
210 | 221 | | possesses a valid, une xpired medical marijuana transporter license |
---|
211 | 222 | | and has applied for and received a permit for each warehouse |
---|
212 | 223 | | location. The Authority shall issue an annual permit for each |
---|
213 | 224 | | warehouse location operated by a licensee that is tied to the annual |
---|
214 | 225 | | medical marijuana transporter license term, and there shall be no |
---|
215 | 226 | | limit to the number of permits issued under a medical marijuana |
---|
216 | 227 | | transporter license. A permit shall be issued only upon proper |
---|
217 | 228 | | application by a licensee and determination by the Authority that |
---|
218 | 229 | | the proposed site and facility are physically and technically |
---|
219 | 230 | | suitable. Upon a finding that a proposed warehouse location is not |
---|
220 | 231 | | physically or technically suitable, the Authority shall deny the |
---|
250 | 262 | | Authority may temporarily store medical marijuana, medical marijuana |
---|
251 | 263 | | concentrates, and medical marijuana products, provided that all |
---|
252 | 264 | | temporary storage is documented, tracked, and traceable in the |
---|
253 | 265 | | state-mandated seed-to-sale tracking system. |
---|
254 | 266 | | J. With the exception of a lawful transfer between medical |
---|
255 | 267 | | marijuana businesses who are licensed to operate at the same |
---|
256 | 268 | | physical address, all medical marijuana, medical marijuana |
---|
257 | 269 | | concentrate and medical marijuana products shall be transported: |
---|
258 | 270 | | 1. In vehicles equipped with Global Positioning System (GPS) |
---|
259 | 271 | | trackers; |
---|
260 | 272 | | 2. In a locked container and clearly labeled “Medical Marijuana |
---|
261 | 273 | | or Derivative”; and |
---|
262 | 274 | | 3. In a secured area of the vehicle that is not accessibl e by |
---|
263 | 275 | | the driver during transit. |
---|
264 | 276 | | K. A transporter agent may possess marijuana at any location |
---|
265 | 277 | | while the transporter agent is transferring marijuana to or from a |
---|
266 | 278 | | licensed medical marijuana business, licensed medical marijuana |
---|
267 | 279 | | research facility or licensed m edical marijuana education facility. |
---|
268 | 280 | | The Authority shall administer the provisions of this section and |
---|
269 | 281 | | the Authority, the Oklahoma State Bureau of Narcotics and Dangerous |
---|
270 | 282 | | Drugs Control, the Oklahoma State B ureau of Investigation, and the |
---|
299 | 312 | | L. The Authority shall issue a transporter agent license to |
---|
300 | 313 | | individual agents, employees, officers or owners of a transporter |
---|
301 | 314 | | license in order for the individual to qualify to transport medical |
---|
302 | 315 | | marijuana, medical marijuana concentrate or medical marijuana |
---|
303 | 316 | | products. |
---|
304 | 317 | | M. The annual fee for a transporter agent license shall be |
---|
305 | 318 | | Twenty-five Dollars ($25.00) and shall be paid by the transporter |
---|
306 | 319 | | license-holder or the individual applicant. Transporter agent |
---|
307 | 320 | | license reprints shall be Twenty Dollars ($20.00). |
---|
308 | 321 | | N. The Authority shall issue each transporter agent a registry |
---|
309 | 322 | | identification card within thirty (30) days of receipt of: |
---|
310 | 323 | | 1. The name, address and date of birth of t he person; |
---|
311 | 324 | | 2. Proof of current state residency; |
---|
312 | 325 | | 3. Proof of identity as required for a medical marijuana |
---|
313 | 326 | | business license; |
---|
314 | 327 | | 4. Possession of a valid state -issued driver license; |
---|
315 | 328 | | 5. Verification of employm ent with a licensed transporter; |
---|
316 | 329 | | 6. The application and affiliated fee; and |
---|
317 | 330 | | 7. A copy of the criminal background check conducted by the |
---|
318 | 331 | | Oklahoma State Bureau of Investigation, paid for by the applicant. |
---|
348 | 362 | | P. A registry identification card for a transporter shall |
---|
349 | 363 | | expire one (1) year after the date of issuance or upon notification |
---|
350 | 364 | | from the holder of the transporter license that the transporter |
---|
351 | 365 | | agent ceases to work as a transporter. |
---|
352 | 366 | | Q. The Authority may revoke the registry identification card of |
---|
353 | 367 | | a transporter agent who knowingly violates any provision of this |
---|
354 | 368 | | section, and the transporter is subject to any other penalties |
---|
355 | 369 | | established by law for the violation. |
---|
356 | 370 | | R. The Authority may revoke or suspend the transporter license |
---|
357 | 371 | | of a transporter that the Authority determines knowingly aided or |
---|
358 | 372 | | facilitated a violation of any provision of this section, and the |
---|
359 | 373 | | license holder is subject to any other penalt ies established in law |
---|
360 | 374 | | for the violation. |
---|
361 | 375 | | S. Vehicles used in the transport of medical marijuana or |
---|
362 | 376 | | medical marijuana product shall be: |
---|
363 | 377 | | 1. Insured at or above the legal requirements in this state; |
---|
364 | 378 | | 2. Capable of securing medical marijuana during transpor t; and |
---|
365 | 379 | | 3. In possession of a shipping container as defined in Section |
---|
366 | 380 | | 427.2 of this title capable of securing all transported products. |
---|
367 | 381 | | T. Prior to the transport of any medical marijuana, medical |
---|
368 | 382 | | marijuana concentrate or medical marijuana products, an in ventory |
---|
398 | 413 | | 1. For the origination point of the medical marijuana: |
---|
399 | 414 | | a. the licensee number for the commercial grower, |
---|
400 | 415 | | processor or dispensary, |
---|
401 | 416 | | b. address of origination of transport, and |
---|

461 | 477 | | U. 1. A separate inventory manifest shall be prepared for each |
---|
462 | 478 | | licensee receiving the medical marijuana. |
---|
463 | 479 | | 2. The transporter agent shall provide the other medical |
---|
464 | 480 | | marijuana business with a copy of the inventory manifest at the time |
---|
465 | 481 | | the product changes hands and after the other licen see prints his or |
---|
466 | 482 | | her name and signs the inventor y manifest. |
---|
496 | 513 | | 4. Originating and receiving licensees , including medical |
---|
497 | 514 | | marijuana transporter warehouses temporarily storing medical |
---|
498 | 515 | | marijuana, medical marijuana concentrates, and medical marijuana |
---|
499 | 516 | | products, shall maintain copies of inventory manifests and logs of |
---|
500 | 517 | | quantities of medical marijuana received for seven (7) years from |
---|
501 | 518 | | date of receipt. |

502 | 519 | | SECTION 2. AMENDATORY Section 1, Chapter 381, O.S.L. |
---|
503 | 520 | | 2024 (63 O.S. Supp. 2024, Section 427.27), is amended to read as |

507 | 524 | | fingerprints to the Oklahoma State Bureau of Investigation (OSBI) |

508 | 525 | | for the purpose of conducting a state and federal fingerprint -based |

510 | 527 | | B. The Authority may require that such fingerprin t submissions |
---|
511 | 528 | | be made as part of a medical marijuana facility application, a |

512 | 529 | | medical marijuana facility renewal application, or an individual |
---|
513 | 530 | | application for a license or permit authorizing that individual to |
---|
514 | 531 | | be an owner of a medical marijuana facility. |
---|
515 | 532 | | C. Fingerprint cards and any required fees shall be sent to the |
---|
516 | 533 | | OSBI central repository. The fingerprint records shall be used for |
---|
546 | 564 | | the Oklahoma Statutes. The OSBI shall notify the Authority of any |
---|
547 | 565 | | criminal history record information or lack of criminal history |
---|
548 | 566 | | record information discovered on the submitting indivi dual. |
---|
549 | 567 | | Notwithstanding the provisions of Section 150.9b of Title 74 of the |
---|
550 | 568 | | Oklahoma Statutes, all records related to any criminal history |
---|
551 | 569 | | information discovered shall be accessible and available to the |
---|
552 | 570 | | Authority. |

553 | 571 | | D. As used in this section: |
---|
554 | 572 | | 1. “Medical marijuana facility” means an entity licensed or |
---|
555 | 573 | | certified by the Authority to acquire, cultivate, process, |
---|
556 | 574 | | manufacture, test, store, sell, transport, or deliver medical |
---|
557 | 575 | | marijuana; and |
---|
558 | 576 | | 2. “Owner” means a direct beneficial owner including , but not |
---|
559 | 577 | | limited to, all persons or entities, as follows: |
---|
560 | 578 | | a. all shareholders owning an interest of a corporate |
---|
561 | 579 | | entity and all officers of a corporate entity, |
---|
562 | 580 | | b. all partners of a general partnership, |
---|
563 | 581 | | c. all general partners a nd all limited partners that own |
---|
564 | 582 | | an interest in a limited partnership, |
---|
565 | 583 | | d. all members that own an interest in a limited |
---|
566 | 584 | | liability company, |
---|
595 | 614 | | f. all persons or entities that own interest in a joint |
---|
596 | 615 | | venture, |
---|
597 | 616 | | g. all persons or entities that own an interest in an |
---|
598 | 617 | | association, |
---|
599 | 618 | | h. the owners of any other type of legal entity, and |

661 | 681 | | b. samples, trains, or educates on behalf of or for a |
---|
662 | 682 | | licensed medical marijuana education or research |
---|
663 | 683 | | facility, |
---|
664 | 684 | | c. disposes of or transports medical marijuana, medical |
---|
665 | 685 | | marijuana products, and med ical marijuana waste on |
---|
694 | 715 | | d. tests and conducts research on medical marijuana and |

696 | 717 | | medical marijuana licensed testing laboratory, |

702 | 723 | | into the state inventory tracking system on behalf of |

703 | 724 | | or for a licensed medical marijuana commercial license |
---|
704 | 725 | | holder, or |
---|
705 | 726 | | g. conducts any other additional business for the benefit |
---|
706 | 727 | | of a medical marijuana commercial license holder as |
---|
707 | 728 | | authorized by rules promulgated by the Executive |
---|
708 | 729 | | Director of the Authority, with the excepti on of |
---|
709 | 730 | | professional services not involved in the handling of |
---|
710 | 731 | | medical marijuana, medical marijuana products, or |
---|
711 | 732 | | medical marijuana concentrates ; and |
---|
712 | 733 | | 2. “Medical marijuana facility” means an entity licensed or |
---|
713 | 734 | | certified by the Authority to acquire, cultivate, process, |
---|
714 | 735 | | manufacture, test, store, sell, transport, or deliver medical |
---|
715 | 736 | | marijuana. |
---|
744 | 766 | | Section 431.1. A. Upon the effective date of this act, all |
---|
745 | 767 | | medical marijuana flower, trim, shake, kief, medical marijuana |
---|
746 | 768 | | product, excluding drinks, or other flower-based product not defined |
---|
747 | 769 | | as a concentrate, shall be sold by lic ensed medical marijuana |
---|
748 | 770 | | processors and licensed m edical marijuana commercial growers to |
---|
749 | 771 | | licensed medical marijuana dispensaries only in pre -packaged form in |
---|
750 | 772 | | package sizes weighing not less than one -half (1/2) of one (1) gram |
---|
751 | 773 | | to not more than three (3) ounces. The Oklahoma Medical Marijuana |
---|
752 | 774 | | Authority shall be authorized to promulgate rules regarding the pre - |
---|
753 | 775 | | packaging of medical marijuana products as provided for in the |
---|
754 | 776 | | provisions of this section. |
---|
755 | 777 | | B. Nonopaque materials may be used when packaging medical |
---|
756 | 778 | | marijuana flower, provided all other packaging and labeling |
---|
757 | 779 | | requirements for medical marijuana products sold in this state are |
---|
758 | 780 | | met and it is placed in an opaque container before leaving a |
---|
759 | 781 | | licensed medical marijuana dispensary. |
---|
760 | 782 | | C. The display and smelling of medical marijuana shall be |
---|
761 | 783 | | allowed pursuant to Section 421 of Title 63 of the Oklahoma |
---|
762 | 784 | | Statutes. |
---|
763 | 785 | | D. The Oklahoma Medical Marijuana Authority shall promulgate |
---|
764 | 786 | | rules necessary to allow for products to be returned to the licensed |
---|
765 | 787 | | medical marijuana dispensa ry when found defective or hazardous to |
---|
794 | 817 | | medical marijuana products from a licensed medical marijuana |
---|
795 | 818 | | dispensary to a licensed medical marijuana processor or licensed |
---|
796 | 819 | | medical marijuana commercial grower, from a licensed medical |
---|
797 | 820 | | marijuana processor to a licensed medical marijuana commercial |
---|
798 | 821 | | grower, or from any other licensed entity that transferred medical |
---|
799 | 822 | | marijuana products to another licensed entity. |
---|
800 | 823 | | SECTION 5. This act shall become effective June 1, 2025. |
---|
801 | 824 | | SECTION 6. It being immediately necessary for the preservation |
---|
802 | 825 | | of the public peace, health or safety, an emergency is hereby |
---|
803 | 826 | | declared to exist, by reason whereof this act shall take effe ct and |
