109+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
101110 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.16, as
102111 last amended by Section 140, Chapter 452, O.S.L. 2024 (63 O.S. Supp.
103112 2024, Section 427.16), is amended to read as follows:
104113 Section 427.16. A. There is hereby created a medical marijuana
105114 transporter license as a category of the medical marijuana business
106115 license.
107116 B. Pursuant to Section 424 of this title, the Oklahoma Medical
108117 Marijuana Authority shall issue a medical marijuana transporter
109118 license to licensed medical marijuana commercial growers, processors
110119 and dispensaries upon issuance of such licenses and upon each
111120 renewal. Medical marijuana transporter licenses shall also be
112121 issued to licensed medical marijuana research facilities, medical
113122 marijuana education facilities and medical marijuana testing
114123 laboratories upon issuance of such licenses and upon each renewal.
115124 C. A medical marijuana tr ansporter license may also be issued
116125 to qualifying applicants who are registered with the Secretary of
117126 State and otherwise meet the requirements for a medical marijuana
118127 business license set forth in the Oklahoma Medical Marijuana and
119128 Patient Protection Act and the requirements set forth in this
120129 section to provide logistics, distribution and storage of medical
121-marijuana, medical marijuana concentrate and medical marijuana
122-products.
123-D. A medical marijuana transporter license shall be valid for
124-one (1) year and shall not be transferred with a change of

159+D. A medical marijuana transporter license shall be valid for
160+one (1) year and shall not be transferred with a change of
151161 ownership. A licensed medical marijuana transporter shall be
152162 responsible for all medical marijuana, medical marijuana concentrate
153163 and medical marijuana products once the transporter takes control of
154164 the product.
155165 E. A transporter license shall be required for any person or
156166 entity to transport or transfer medical marijuana, medical marijuana
157167 concentrate or medical marijuana products from a licensed medical
158168 marijuana business to another medical marijuana business, or from a
159169 medical marijuana business to a medica l marijuana research facility
160170 or medical marijuana education facility.
161171 F. A medical marijuana transporter licensee may contract with
162172 multiple licensed medical marijuana businesses.
163173 G. A medical marijuana transporter may maintain a licensed
164174 premises to temporarily store medical marijuana, medical marijuana
165175 concentrate and medical marijuana products and to use as a
166176 centralized distribution point. A medical marijuana transporter may
167177 store and distribute medic al marijuana, medical marijuana
168178 concentrate and medical marijuana products from the licensed
169179 premises. The licensed premises shall meet all security
170180 requirements applicable to a medical marijuana business. The
171-Authority shall issue licenses upon proper application by a licensee
172-and determination by the Authority that the proposed site and
173-facility are physically and technically suitable.

208+Authority shall issue licenses upon proper application by a licensee
209+and determination by the Authority that the proposed site and
210+facility are physically and technically suitable.
200211 H. A medical marijuana transporter licensee shall use the seed -
201212 to-sale tracking system developed pursuant to the Oklah oma Medical
202213 Marijuana and Patient Protection Act to create shipping inventory
203214 manifests documenting the transport or temporary storage of medical
204215 marijuana, medical marijuana concentrate , and medical marijuana
205216 products throughout the state.
206217 I. A licensed medical marijuana transporter may maintain and
207218 operate one or more warehouses in the state to handle medical
208219 marijuana, medical marijuana concentrate and medical marijuana
209220 products, provided the licensed medical marijuana transporter
210221 possesses a valid, une xpired medical marijuana transporter license
211222 and has applied for and received a permit for each warehouse
212223 location. The Authority shall issue an annual permit for each
213224 warehouse location operated by a licensee that is tied to the annual
214225 medical marijuana transporter license term, and there shall be no
215226 limit to the number of permits issued under a medical marijuana
216227 transporter license. A permit shall be issued only upon proper
217228 application by a licensee and determination by the Authority that
218229 the proposed site and facility are physically and technically
219230 suitable. Upon a finding that a proposed warehouse location is not
220231 physically or technically suitable, the Authority shall deny the
221-permit. Each warehouse location shall be registered approved and
222-inspected by the Authority prior to its use. Medical marijuana

259+permit. Each warehouse location shall be registered approved and
260+inspected by the Authority prior to its use. Medical marijuana
261+transporter warehouses that are licensed and approved by the
250262 Authority may temporarily store medical marijuana, medical marijuana
251263 concentrates, and medical marijuana products, provided that all
252264 temporary storage is documented, tracked, and traceable in the
253265 state-mandated seed-to-sale tracking system.
254266 J. With the exception of a lawful transfer between medical
255267 marijuana businesses who are licensed to operate at the same
256268 physical address, all medical marijuana, medical marijuana
257269 concentrate and medical marijuana products shall be transported:
258270 1. In vehicles equipped with Global Positioning System (GPS)
259271 trackers;
260272 2. In a locked container and clearly labeled “Medical Marijuana
261273 or Derivative”; and
262274 3. In a secured area of the vehicle that is not accessibl e by
263275 the driver during transit.
264276 K. A transporter agent may possess marijuana at any location
265277 while the transporter agent is transferring marijuana to or from a
266278 licensed medical marijuana business, licensed medical marijuana
267279 research facility or licensed m edical marijuana education facility.
268280 The Authority shall administer the provisions of this section and
269281 the Authority, the Oklahoma State Bureau of Narcotics and Dangerous
270282 Drugs Control, the Oklahoma State B ureau of Investigation, and the
271-Attorney General shall have the authority to en force the provisions
272-of this section concerning transportation.

310+Attorney General shall have the authority to enforce the provisions
311+of this section concerning transportation.
299312 L. The Authority shall issue a transporter agent license to
300313 individual agents, employees, officers or owners of a transporter
301314 license in order for the individual to qualify to transport medical
302315 marijuana, medical marijuana concentrate or medical marijuana
303316 products.
304317 M. The annual fee for a transporter agent license shall be
305318 Twenty-five Dollars ($25.00) and shall be paid by the transporter
306319 license-holder or the individual applicant. Transporter agent
307320 license reprints shall be Twenty Dollars ($20.00).
308321 N. The Authority shall issue each transporter agent a registry
309322 identification card within thirty (30) days of receipt of:
310323 1. The name, address and date of birth of t he person;
311324 2. Proof of current state residency;
312325 3. Proof of identity as required for a medical marijuana
313326 business license;
314327 4. Possession of a valid state -issued driver license;
315328 5. Verification of employm ent with a licensed transporter;
316329 6. The application and affiliated fee; and
317330 7. A copy of the criminal background check conducted by the
318331 Oklahoma State Bureau of Investigation, paid for by the applicant.
319-O. If the transporter agent application is denied, the
320-Authority shall notify the transporter in writing of the reason for
321-denying the registry identification card.

359+O. If the transporter agent application is denied, the
360+Authority shall notify the transporter in wr iting of the reason for
361+denying the registry identification card.
348362 P. A registry identification card for a transporter shall
349363 expire one (1) year after the date of issuance or upon notification
350364 from the holder of the transporter license that the transporter
351365 agent ceases to work as a transporter.
352366 Q. The Authority may revoke the registry identification card of
353367 a transporter agent who knowingly violates any provision of this
354368 section, and the transporter is subject to any other penalties
355369 established by law for the violation.
356370 R. The Authority may revoke or suspend the transporter license
357371 of a transporter that the Authority determines knowingly aided or
358372 facilitated a violation of any provision of this section, and the
359373 license holder is subject to any other penalt ies established in law
360374 for the violation.
361375 S. Vehicles used in the transport of medical marijuana or
362376 medical marijuana product shall be:
363377 1. Insured at or above the legal requirements in this state;
364378 2. Capable of securing medical marijuana during transpor t; and
365379 3. In possession of a shipping container as defined in Section
366380 427.2 of this title capable of securing all transported products.
367381 T. Prior to the transport of any medical marijuana, medical
368382 marijuana concentrate or medical marijuana products, an in ventory
369-manifest shall be prep ared at the origination point of the medical
370-marijuana. The inventory manifest shall include the following

411+marijuana. The inventory manifest shall include the following
412+information:
398413 1. For the origination point of the medical marijuana:
399414 a. the licensee number for the commercial grower,
400415 processor or dispensary,
401416 b. address of origination of transport, and
402417 c. name and contact information for the originating
403418 licensee;
404419 2. For temporary storage at a medical marijuana transporter
405420 licensed premises or warehouse location that is licensed and
406421 approved by the Authority:
407422 a. the license number for the commercial medical
408423 marijuana grower, medical marijuana processor, or
409424 medical marijuana dispensary,
410425 b. the address of origination of transport,
411426 c. the name and contact information for the originating
412427 licensee, and
413428 d. the license number, physical address, and name and
414429 contact information of the medical marijuana
415430 transporter licensed premises or warehouse location
416431 and notation that the medical marijuana, med ical
417432 marijuana concentrates, and medical marijuan a products
418433 are being temporarily stored;
419-3. For the end recipient license holder of the medical

461+3. For the end recipient license holder of the medical
462+marijuana:
447463 a. the license number for the dispensary, commercial
448464 grower, processor, research facility or education
449465 facility destination,
450466 b. address of the desti nation, and
451467 c. name and contact information for the destination
452468 licensee;
453469 3. 4. Quantities by weight or unit of each type of medical
454470 marijuana product contained in transport;
455471 4. 5. The date of the transpor t and the approximate time of
456472 departure;
457473 5. 6. The arrival date and estimated time of arrival;
458474 6. 7. Printed names and signatures of the personnel
459475 accompanying the transport; and
460476 7. 8. Notation of the transporting licensee.
461477 U. 1. A separate inventory manifest shall be prepared for each
462478 licensee receiving the medical marijuana.
463479 2. The transporter agent shall provide the other medical
464480 marijuana business with a copy of the inventory manifest at the time
465481 the product changes hands and after the other licen see prints his or
466482 her name and signs the inventor y manifest.
467-3. A receiving licensee shall refuse to accept any medical
468-marijuana, medical marijuana concentrate or medical marijuana
469-products that are not accompanied by an inventory manifest.

510+3. A receiving licensee shall refuse to accept any medical
511+marijuana, medical marijuana concentrate or medical marijuana
512+products that are not accompanied by an inventory manifest.
496513 4. Originating and receiving licensees , including medical
497514 marijuana transporter warehouses temporarily storing medical
498515 marijuana, medical marijuana concentrates, and medical marijuana
499516 products, shall maintain copies of inventory manifests and logs of
500517 quantities of medical marijuana received for seven (7) years from
501518 date of receipt.
502519 SECTION 2. AMENDATORY Section 1, Chapter 381, O.S.L.
503520 2024 (63 O.S. Supp. 2024, Section 427.27), is amended to read as
504521 follows:
505522 Section 427.27. A. The Oklahoma Medical Marijuana Authority
506523 shall require owners of medical marijuana facilities to submit their
507524 fingerprints to the Oklahoma State Bureau of Investigation (OSBI)
508525 for the purpose of conducting a state and federal fingerprint -based
509526 criminal background check.
510527 B. The Authority may require that such fingerprin t submissions
511528 be made as part of a medical marijuana facility application, a
512529 medical marijuana facility renewal application, or an individual
513530 application for a license or permit authorizing that individual to
514531 be an owner of a medical marijuana facility.
515532 C. Fingerprint cards and any required fees shall be sent to the
516533 OSBI central repository. The fingerprint records shall be used for
517-searching the state criminal records repository and shall also be
518-forwarded to the Federal Bureau of Investigation for a federal
519-criminal record search as provided in Section 150.9 of Title 74 of

563+criminal record search as provided in Section 150.9 of Title 74 of
546564 the Oklahoma Statutes. The OSBI shall notify the Authority of any
547565 criminal history record information or lack of criminal history
548566 record information discovered on the submitting indivi dual.
549567 Notwithstanding the provisions of Section 150.9b of Title 74 of the
550568 Oklahoma Statutes, all records related to any criminal history
551569 information discovered shall be accessible and available to the
552570 Authority.
553571 D. As used in this section:
554572 1. “Medical marijuana facility” means an entity licensed or
555573 certified by the Authority to acquire, cultivate, process,
556574 manufacture, test, store, sell, transport, or deliver medical
557575 marijuana; and
558576 2. “Owner” means a direct beneficial owner including , but not
559577 limited to, all persons or entities, as follows:
560578 a. all shareholders owning an interest of a corporate
561579 entity and all officers of a corporate entity,
562580 b. all partners of a general partnership,
563581 c. all general partners a nd all limited partners that own
564582 an interest in a limited partnership,
565583 d. all members that own an interest in a limited
566584 liability company,
567-e. all beneficiaries that hold a beneficial interest in a
568-trust and all trustees of a trust,

597616 g. all persons or entities that own an interest in an
598617 association,
599618 h. the owners of any other type of legal entity, and
600619 i. any other person holding an interest or convertible
601620 note in any entity, which owns, operates , or manages a
602621 licensed medical marijuana facilit y.
603622 SECTION 3. AMENDATORY Section 2, Chapter 381, O.S.L.
604623 2024 (63 O.S. Supp. 2024, Section 427.28), is amended to read as
605624 follows:
606625 Section 427.28. A. The Oklahoma Medical Marijuana Authority
607626 shall require all employees of medical marijuana facilities to
608627 submit their fingerprints to the Oklahoma State Bureau of
609628 Investigation (OSBI) for the purpose of conducting a state and
610629 federal fingerprint-based criminal background check.
611630 B. The Authority may require that such fingerprint submi ssions
612631 be made as part of an individual’s application for a license,
613632 permit, identification card, or credential authorizing that
614633 individual to be an employee of a medical marijuana facility.
615634 C. Fingerprint cards and any required fees shall be sent to the

657677 manufactures, creates, or packages medical marijuana,
658678 medical marijuana products, or medical marijuana waste
659679 on behalf of or for a licensed medical marijuana
660680 commercial grower, processor, or d ispensary,
661681 b. samples, trains, or educates on behalf of or for a
662682 licensed medical marijuana education or research
663683 facility,
664684 c. disposes of or transports medical marijuana, medical
665685 marijuana products, and med ical marijuana waste on
666-behalf of or for a licensed medical marijuana waste

701722 f. tracks, traces, reports, and inputs any information
702723 into the state inventory tracking system on behalf of
703724 or for a licensed medical marijuana commercial license
704725 holder, or
705726 g. conducts any other additional business for the benefit
706727 of a medical marijuana commercial license holder as
707728 authorized by rules promulgated by the Executive
708729 Director of the Authority, with the excepti on of
709730 professional services not involved in the handling of
710731 medical marijuana, medical marijuana products, or
711732 medical marijuana concentrates ; and
712733 2. “Medical marijuana facility” means an entity licensed or
713734 certified by the Authority to acquire, cultivate, process,
714735 manufacture, test, store, sell, transport, or deliver medical
715736 marijuana.

764+SECTION 4. AMENDATORY Section 1, Chapter 95, O.S.L. 2024
765+(63 O.S. Supp. 2024, Section 431.1), is amended to read as follows:
744766 Section 431.1. A. Upon the effective date of this act, all
745767 medical marijuana flower, trim, shake, kief, medical marijuana
746768 product, excluding drinks, or other flower-based product not defined
747769 as a concentrate, shall be sold by lic ensed medical marijuana
748770 processors and licensed m edical marijuana commercial growers to
749771 licensed medical marijuana dispensaries only in pre -packaged form in
750772 package sizes weighing not less than one -half (1/2) of one (1) gram
751773 to not more than three (3) ounces. The Oklahoma Medical Marijuana
752774 Authority shall be authorized to promulgate rules regarding the pre -
753775 packaging of medical marijuana products as provided for in the
754776 provisions of this section.
755777 B. Nonopaque materials may be used when packaging medical
756778 marijuana flower, provided all other packaging and labeling
757779 requirements for medical marijuana products sold in this state are
758780 met and it is placed in an opaque container before leaving a
759781 licensed medical marijuana dispensary.
760782 C. The display and smelling of medical marijuana shall be
761783 allowed pursuant to Section 421 of Title 63 of the Oklahoma
762784 Statutes.
763785 D. The Oklahoma Medical Marijuana Authority shall promulgate
764786 rules necessary to allow for products to be returned to the licensed
765787 medical marijuana dispensa ry when found defective or hazardous to
766-the health of the patient. The Authori ty shall further promulgate

798821 grower, or from any other licensed entity that transferred medical
799822 marijuana products to another licensed entity.
800823 SECTION 5. This act shall become effective June 1, 2025.
801824 SECTION 6. It being immediately necessary for the preservation
802825 of the public peace, health or safety, an emergency is hereby
803826 declared to exist, by reason whereof this act shall take effe ct and
804827 be in full force from and after its passage and approval.
