99 | 99 | | 2. A municipality may adopt any ordinance: |
---|
100 | 100 | | a. relating to the discharge of firearm s within the |
---|
101 | 101 | | jurisdiction of the municipality, |
---|
102 | 102 | | b. allowing the municipality to issue a traffic citation |
---|
103 | 103 | | for transporting a firearm improperly as provided for |
---|
104 | 104 | | in Section 1289.13A of this title, provided, however, |
---|
105 | 105 | | that penalties contained for violation of any |
---|
106 | 106 | | ordinance enacted pursuant to the provisions of this |
---|
107 | 107 | | subparagraph shall not exceed the penalties |
---|
108 | 108 | | established in the Oklahoma Self -Defense Act, and |
---|
109 | 109 | | c. allowing the municipality to issue a citation to an |
---|
110 | 110 | | individual or the parent or guardian of a minor who |
---|
111 | 111 | | discharges an air powered pistol or air powered rifle |
---|
112 | 112 | | in an intentional or negligent manner which causes the |
---|
113 | 113 | | projectile to leave the intended premises. |
---|
114 | 114 | | 3. As provided in the pre emption provisions of this section, |
---|
115 | 115 | | the otherwise lawful carrying or possession of a firearm under the |
---|
116 | 116 | | provisions of Chapter 53 of this title shall not be punishable by |
---|

148 | 148 | | vehicle used by the school for purposes of transportation . |

149 | 149 | | B. No municipality, agency, or other political subdivision of |
---|
150 | 150 | | this state shall adopt any order, policy, ordinance, resolution, or |
---|
151 | 151 | | regulation concerning in any way the sale, purchase, purchase delay, |
---|
152 | 152 | | transfer, ownership, use, keeping, possession, carryin g, bearing, |
---|
153 | 153 | | transportation, licensing, permit, registration, taxation other th an |
---|
154 | 154 | | sales and compensating use taxes or other controls on firearms, |
---|
155 | 155 | | knives, firearm and ammunition components, ammunition and supplies. |
---|
156 | 156 | | C. Except as hereinafter provided, this se ction shall not |
---|
157 | 157 | | prohibit any order, policy, ordinance or regulation by any |
---|
158 | 158 | | municipality concerning the confiscation of property used in |
---|
159 | 159 | | violation of the ordinances of the municipality as provided for in |
---|
160 | 160 | | Section 28-121 of Title 11 of the Oklahoma Statutes. Provided, |
---|
161 | 161 | | however, no municipal ordinance relating to transporting a firearm |
---|
162 | 162 | | or knife improperly may include a provision for confiscation of |
---|
163 | 163 | | property. |
---|
164 | 164 | | D. When a person's rights pursuant to the protection of the |
---|
165 | 165 | | preemption provisions of this section have been violated by any |
---|
166 | 166 | | order, policy, ordinance, resolution, or regulation promulgated or |
---|

200 | 200 | | E. A court may require the person, municipality, agency or |
---|
201 | 201 | | political subdivision to pay reasonable expenses to the aggrieved |
---|
202 | 202 | | party in a civil action filed pursuant to the provisions of |
---|
203 | 203 | | subsection D of this section if: |
---|
204 | 204 | | 1. The aggrieved party first provides written notice of the |
---|
205 | 205 | | unlawful order, policy, ordinance, resolution or regulation by |
---|
206 | 206 | | certified, first-class mail or service of process to the clerk of |
---|
207 | 207 | | the municipality or to the designated agent of the municipality, |
---|
208 | 208 | | agency or political subdivision and allows the person, municip ality, |
---|
209 | 209 | | agency or political subdivision ninety (90) days to rescind, repeal |
---|
210 | 210 | | or otherwise abrogate the order, policy, ordinance, resolution or |
---|
211 | 211 | | regulation; and |
---|
212 | 212 | | 2. A court rules in favor of the aggrieved person whose rights |
---|
213 | 213 | | were violated and the issue in cont roversy is governed by previously |
---|
214 | 214 | | settled law. |
---|
215 | 215 | | If the person, municipality, ag ency or political subdivision |
---|
216 | 216 | | fails to rescind, repeal or otherwise abrogate the unlawful order, |
---|

249 | 249 | | F. As used in this section, air: |
---|
250 | 250 | | 1. "Air powered pistol" or "air powered rifle" is any pistol or |
---|
251 | 251 | | rifle that uses compressed air or other compressed gas to project |
---|
252 | 252 | | plastic BB-like or pellet-like projectiles at a speed not exceeding |
---|
253 | 253 | | 400 feet per second; and |
---|
254 | 254 | | 2. "Reasonable expenses" includes, but is not limited to, |
---|
255 | 255 | | attorney fees, expert witness fees, and court costs . |
---|
256 | 256 | | SECTION 2. It being immediately necessary for the preservation |
---|
257 | 257 | | of the public peace, health or safety, an emergency is hereby |
---|
258 | 258 | | declared to exist, by r eason whereof this act shall take effect and |
---|
259 | 259 | | be in full force from and after its passage and approval. |
