4040 An Act relating to firearms; amending 21 O.S. 2021,
4141 Section 1289.24, which relates to the Oklahoma
4242 Firearms Act of 1971; expanding scop e of state
4343 preemption provision to include firearm and
4444 ammunition components; prohibiting the adoption of
4545 policies or resolutions that violate state preemption
4646 provision; clarifying procedures that authorize the
4747 filing of civil actions; providing for the p ayment of
4848 reasonable expenses under certain circumstances;
4949 allowing aggrieved persons to retain standing under
5050 certain circumstances; defining term; and declaring
5151 an emergency.

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1289.24, is
6060 amended to read as follows:
6161 Section 1289.24.
6262 FIREARM REGULATION – STATE PREEMPTION
6363 A. 1. The State Legislature hereby occupies and preempts the
6464 entire field of legislation in this stat e touching in any way
6565 firearms, air powered pistols, air powered rifles, knive s, firearm
6666 and ammunition components, ammunition and supplies to the complete

9393 exclusion of any order, policy, ordinance, resolution, or regulation
9494 by any municipality, agency, or other political subdivision of this
9595 state. Any existing or future orders, policies, ordinances,
9696 resolutions, or regulations in this field, except as provided for in
9797 paragraph 2 of this subsection and subsection C of this section, are
9898 null and void.
9999 2. A municipality may adopt any ordinance:
100100 a. relating to the discharge of firearm s within the
101101 jurisdiction of the municipality,
102102 b. allowing the municipality to issue a traffic citation
103103 for transporting a firearm improperly as provided for
104104 in Section 1289.13A of this title, provided, however,
105105 that penalties contained for violation of any
106106 ordinance enacted pursuant to the provisions of this
107107 subparagraph shall not exceed the penalties
108108 established in the Oklahoma Self -Defense Act, and
109109 c. allowing the municipality to issue a citation to an
110110 individual or the parent or guardian of a minor who
111111 discharges an air powered pistol or air powered rifle
112112 in an intentional or negligent manner which causes the
113113 projectile to leave the intended premises.
114114 3. As provided in the pre emption provisions of this section,
115115 the otherwise lawful carrying or possession of a firearm under the
116116 provisions of Chapter 53 of this title shall not be punishable by

143143 any municipality, agency, or other political subdivision of this
144144 state as disorderly co nduct, disturbing the peace or similar offense
145145 against public order.
146146 4. A public or private school may create a policy regulating
147147 the possession of knives on school property or in any school bus or
148148 vehicle used by the school for purposes of transportation .
149149 B. No municipality, agency, or other political subdivision of
150150 this state shall adopt any order, policy, ordinance, resolution, or
151151 regulation concerning in any way the sale, purchase, purchase delay,
152152 transfer, ownership, use, keeping, possession, carryin g, bearing,
153153 transportation, licensing, permit, registration, taxation other th an
154154 sales and compensating use taxes or other controls on firearms,
155155 knives, firearm and ammunition components, ammunition and supplies.
156156 C. Except as hereinafter provided, this se ction shall not
157157 prohibit any order, policy, ordinance or regulation by any
158158 municipality concerning the confiscation of property used in
159159 violation of the ordinances of the municipality as provided for in
160160 Section 28-121 of Title 11 of the Oklahoma Statutes. Provided,
161161 however, no municipal ordinance relating to transporting a firearm
162162 or knife improperly may include a provision for confiscation of
163163 property.
164164 D. When a person's rights pursuant to the protection of the
165165 preemption provisions of this section have been violated by any
166166 order, policy, ordinance, resolution, or regulation promulgated or

193193 enforced by any person, municipality, agency or other political
194194 subdivision of the state , the person so violated shall have the
195195 right to bring a civil action against th e persons person, government
196196 employee if the government employee was acting be yond the scope of
197197 employment, municipality, and agency, or political subdivision
198198 jointly and severally for injunctive relief or monetary damages or
199199 both.
200200 E. A court may require the person, municipality, agency or
201201 political subdivision to pay reasonable expenses to the aggrieved
202202 party in a civil action filed pursuant to the provisions of
203203 subsection D of this section if:
204204 1. The aggrieved party first provides written notice of the
205205 unlawful order, policy, ordinance, resolution or regulation by
206206 certified, first-class mail or service of process to the clerk of
207207 the municipality or to the designated agent of the municipality,
208208 agency or political subdivision and allows the person, municip ality,
209209 agency or political subdivision ninety (90) days to rescind, repeal
210210 or otherwise abrogate the order, policy, ordinance, resolution or
211211 regulation; and
212212 2. A court rules in favor of the aggrieved person whose rights
213213 were violated and the issue in cont roversy is governed by previously
214214 settled law.
215215 If the person, municipality, ag ency or political subdivision
216216 fails to rescind, repeal or otherwise abrogate the unlawful order,

243243 policy, ordinance, resolution or regulation within ninety (90) days
244244 of required notice, as provided in paragraph 1 of this subsection
245245 and the order, policy, ordinance, resolution or regulation is
246246 subsequently rescinded, repealed or otherwise abrogated after the
247247 aggrieved party files suit, the aggrieved party shall retain
248248 standing in the suit and may recover damages or reasonable expenses.
249249 F. As used in this section, air:
250250 1. "Air powered pistol" or "air powered rifle" is any pistol or
251251 rifle that uses compressed air or other compressed gas to project
252252 plastic BB-like or pellet-like projectiles at a speed not exceeding
253253 400 feet per second; and
254254 2. "Reasonable expenses" includes, but is not limited to,
255255 attorney fees, expert witness fees, and court costs .
256256 SECTION 2. It being immediately necessary for the preservation
257257 of the public peace, health or safety, an emergency is hereby
258258 declared to exist, by r eason whereof this act shall take effect and
259259 be in full force from and after its passage and approval.
