54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1290.8, as
56	56	amended by Section 4, Chapter 160, O.S.L. 2023 (21 O.S. Supp. 2024,
57	57	Section 1290.8), is amended to read as follows:
58	58	Section 1290.8.
59	59	POSSESSION OF LICENSE REQUIRED
60	60	NOTIFICATION TO POLICE OF GUN
61	61	A. Except as otherwise prohibited by law, an eligible person
62	62	shall have authority to carry a concealed or unconcealed firea rm in
63	63	this state when:

90	90	1. The person is in compliance with the provisions of the
91	91	Oklahoma Self-Defense Act; or
92	92	2. The person is authorized pursuant to the provisions of
93	93	Section 1272 of this title.
94	94	B. A person in possession of a valid state photo identif ication
95	95	card, driver license, or valid handgun license or who presents a
96	96	valid military identification card and is in compliance with the
97	97	provisions of the Oklahoma Self -Defense Act shall be authorized to
98	98	carry such concealed or unconcealed firearm while s couting as it
99	99	relates to hunting or fishing or while hunting or fishing.
100	100	C. The person shall be required to have possession of his or
101	101	her valid handgun license, valid military identification card, valid
102	102	driver license, or state photo identification card a t all times when
103	103	in possession of a firearm. The person shall display either a valid
104	104	handgun license, valid military identification card, valid driver
105	105	license, or valid state photo identification card as provided for
106	106	qualified persons in this section on d emand of a law enforcement
107	107	officer during an arrest or routine traffic stop ; provided, however,
108	108	that in the absence of reasonable and articulable suspicion of other
109	109	criminal activity, an individual carrying an unconcealed or
110	110	concealed firearm or other lawful firearm shall not be disarmed or
111	111	physically restrained unless the individual fails to display one of
112	112	the following:
113	113	1. A valid handgun license;

140	140	2. A valid military identification card;
141	141	3. A valid driver license; or
142	142	4. A valid state photo identificat ion card,
143	143	as provided for qualified persons in this section in response to
144	144	that demand. Any violation of the provisions of this subsection may
145	145	be punishable as a criminal offense as authorized by Section 1272 of
146	146	this title or pursuant to any other applica ble provision of law.
147	147	Upon the arrest of any person for a violation of the provisions
148	148	of this subsection, the person may show proof to the court that a
149	149	valid handgun license, a valid military identification card, a valid
150	150	driver license, or a valid state ph oto identification card has been
151	151	issued to such person and the person may stat e any reason why the
152	152	valid handgun license, valid military identification card, valid
153	153	driver license, or valid state photo identification card as provided
154	154	for qualified persons i n this section was not carried by the person
155	155	as required by the Oklahoma Self -Defense Act. The court shall
156	156	dismiss an alleged violation of Section 1272 of this title upon
157	157	payment of court costs, if proof of a valid handgun license, a valid
158	158	military identification card, a valid driver license, or valid state
159	159	photo identification car d is shown to the court within ten (10) days
160	160	of the arrest of the person.
161	161	D. It shall be unlawful for any person to fail or refuse to
162	162	identify the fact that the person is in act ual possession of a
163	163	concealed or unconcealed firearm pursuant to the authority of the

190	190	Oklahoma Self-Defense Act during the course of any arrest ,
191	191	detainment, or routine traffic stop. Said identification shall be
192	192	required upon demand by the law enforcement officer. No person
193	193	shall be required to identify himself or herself as lawful ly in
194	194	possession of any other firearm if the law enforcement officer does
195	195	not demand the information. No person shall be required to identify
196	196	himself or herself as being in poss ession of a firearm when no
197	197	firearm is in the possession of the person or in any vehicle in
198	198	which the person is driving or is a passenger. Any violator of the
199	199	provisions of this subsection may be issued a citation for an amount
200	200	not exceeding One Hundred D ollars ($100.00).
201	201	E. Any law enforcement officer coming in contact with a per son
202	202	whose handgun license is suspended or revoked, or who is in
203	203	possession of a handgun license which has not been lawfully issued
204	204	to that person, shall confiscate the license an d return it to the
205	205	Oklahoma State Bureau of Investigation for appropriate
206	206	administrative proceedings against the licensee when the license is
207	207	no longer needed as evidence in any criminal proceeding.
208	208	F. Nothing in this section shall be construed to authori ze a
209	209	law enforcement officer to inspect any weapon properly concealed or
210	210	unconcealed without probable cause that a crime has been committed.
211	211	SECTION 2. This act shall become effective November 1, 2025.
