40	40	An Act relating to counties and county officers;
41	41	amending 19 O.S. 2021, Section 215.20, which relates
42	42	to election of district attorney; di recting for
43	43	nonpartisan elections of district attorneys; amending
44	44	19 O.S. 2021, Section 510, which relates to
45	45	qualifications of county sheriff; directing for
46	46	nonpartisan elections of county sheriffs; and
47	47	providing an effective date.

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 19 O.S. 2021, Section 215.20, is
54	54	amended to read as follows:
55	55	Section 215.20. A. At the primaries and general elections held
56	56	in 1966, and each four (4) years thereaf ter, there shall be
57	57	nominated and elected in each and every district attorney 's district
58	58	in the State of Oklahoma, a district attorney, who shall hold office
59	59	for a term of four (4) years, beginning on the first Monday of
60	60	January following his their election, and until his their successor
61	61	is elected and qualified.
62	62	B. District attorney elections shall be nonpartisan, and all
63	63	candidates shall file as independent candidates. No primary

90	90	elections shall be held in a nonpartisan election. Each candidate
91	91	shall appear on the ballot as an independent candidate without party
92	92	or other designation.
93	93	SECTION 2. AMENDATORY 19 O.S. 2021, Section 510, is
94	94	amended to read as follows:
95	95	Section 510. A. Any person, otherwise qualified, who has been
96	96	a resident of the State of Oklahoma for two (2) years, has been a
97	97	registered voter of the party whose nomination he or she seeks, or a
98	98	registered Independent, within the county from which such person
99	99	seeks election for the six (6) months next preceding the f irst day
100	100	of the filing period, is at least twenty -five (25) years of age next
101	101	preceding the date of filing for office, possesses at least a high
102	102	school education and has served as a duly certified peace officer,
103	103	in a full-time capacity, for a period of fou r (4) years or more
104	104	prior to the date of filing for the office of county sheri ff, shall
105	105	be eligible to hold the office of county sheriff or to file
106	106	therefor. Within twelve (12) months of taking office, all newly
107	107	elected or appointed sheriffs shall complet e a sheriff's
108	108	administrative school which has been developed by the Oklahoma
109	109	Sheriffs' Association and which has been approved by the Council on
110	110	Law Enforcement Education and Training (CLEET). Failure to complete
111	111	the sheriff's administrative school within the specified period
112	112	shall preclude the new sheriff from obtaining CLEET cert ification.
113	113	New sheriffs with prior CLEET certification, who fail to attend the

140	140	sheriff's administrative school, shall have their CLEET
141	141	certification revoked. Provided, however, the provisions of this
142	142	section relating to qualifications shall not apply to any person
143	143	serving as a county sheriff or to any person previously serving as
144	144	county sheriff prior to the adoption of this statute.
145	145	B. County sheriff elections shall be nonparti san, and all
146	146	candidates shall file as independent candidates. No primary
147	147	elections shall be held in a nonpartisan election. Each candidate
148	148	shall appear on the ballot as an independent candidate without party
149	149	or other designation.
150	150	C. For purposes of this section, "peace officer" shall mean a
151	151	full-time duly appointed or elected officer who is paid for working
152	152	more than twenty-five (25) hours per week and whose duties are to
153	153	preserve the public peace, protect life and property, prevent crime,
154	154	serve warrants, and enforce state, federal or military laws and
155	155	local ordinances of this sta te or any political subdivision thereof.
156	156	SECTION 3. This act shall become effective November 1, 2025.
