4040 An Act relating to railroads; defining terms;
4141 providing for type of identification required to be
4242 shown following a railroad accident or incident;
4343 providing for codification; and declaring an
4444 emergency.

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law to be codified
5252 in the Oklahoma Statutes as Section 104 of T itle 66, unless there is
5353 created a duplication in numbering, reads as follows:
5454 A. As used in this section:
5555 1. "FRA Certified Conductor " means a conductor, switchman,
5656 brakeman, trainman, or fireman licensed and certified by the Federal
5757 Railroad Administration (FRA);
5858 2. "FRA Certified Engineer " means an engineer licensed and
5959 certified by the FRA ;
6060 3. "Railroad accident or incident" means accidents occurring to
6161 persons, including pedestrians, motor vehicles, and animals,

8888 incidental to and as a consequence o f the flow of vehicles and
8989 pedestrians along the railroads of Oklahoma; and
9090 4. "Railroad management" means any rail employee overseeing and
9191 assisting in the operation of rail transit.
9292 B. For identification purposes, no railroad employee involved
9393 in a railroad accident or incident shall be required to show his or
9494 her driver license to law enforcement or other safety officer.
9595 Railroad employees shall be allowed to show the following
9696 identification:
9797 1. A FRA Certified Conductor shall provide his or her FRA
9898 certification;
9999 2. A FRA Certified Engineer shall provide his or her FRA
100100 certification; and
101101 3. Railroad management shall provide his or her FRA
102102 certification.
103103 SECTION 2. It being immediately necessary for the preservation
104104 of the public peace, health or safety, an emergency is hereby
105105 declared to exist, by reason whereof this act shall take effect and
106106 be in full force from and after its passage and approval.
