40	40	An Act relating to railroads; defining terms;
41	41	providing for type of identification required to be
42	42	shown following a railroad accident or incident;
43	43	providing for codification; and declaring an
44	44	emergency.

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. NEW LAW A new section of law to be codified
52	52	in the Oklahoma Statutes as Section 104 of T itle 66, unless there is
53	53	created a duplication in numbering, reads as follows:
54	54	A. As used in this section:
55	55	1. "FRA Certified Conductor " means a conductor, switchman,
56	56	brakeman, trainman, or fireman licensed and certified by the Federal
57	57	Railroad Administration (FRA);
58	58	2. "FRA Certified Engineer " means an engineer licensed and
59	59	certified by the FRA ;
60	60	3. "Railroad accident or incident" means accidents occurring to
61	61	persons, including pedestrians, motor vehicles, and animals,

88	88	incidental to and as a consequence o f the flow of vehicles and
89	89	pedestrians along the railroads of Oklahoma; and
90	90	4. "Railroad management" means any rail employee overseeing and
91	91	assisting in the operation of rail transit.
92	92	B. For identification purposes, no railroad employee involved
93	93	in a railroad accident or incident shall be required to show his or
94	94	her driver license to law enforcement or other safety officer.
95	95	Railroad employees shall be allowed to show the following
96	96	identification:
97	97	1. A FRA Certified Conductor shall provide his or her FRA
98	98	certification;
99	99	2. A FRA Certified Engineer shall provide his or her FRA
100	100	certification; and
101	101	3. Railroad management shall provide his or her FRA
102	102	certification.
103	103	SECTION 2. It being immediately necessary for the preservation
104	104	of the public peace, health or safety, an emergency is hereby
105	105	declared to exist, by reason whereof this act shall take effect and
106	106	be in full force from and after its passage and approval.
