5051 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5152 SECTION 1. AMENDATORY Section 1, Chapter 297, O.S.L.
52-2024 (70 O.S. Supp. 2024, Section 6-401), is amended to read as

5455 Section 6-401. A. As used in this section:
5556 1. "Electronic or digital communication " includes, but is not
5657 limited to, emails, text messages, instant messages, direct
5758 messages, social media messages, messages sent through software
5859 applications, and any other electronic or digital means of
5960 communication; and
60-2. "School personnel" means teachers, coaches, administrators,
61-school bus drivers, or any other persons employed full -time or part-
62-time by a public school or charter school.

87+2. "School personnel" means teachers, coaches, administrators,
88+school bus drivers, or any other persons employed full -time or part-
89+time by a public school or charter school.
8990 B. School personnel engaging in el ectronic or digital
9091 communication with an individual student shall include the student 's
9192 parent or legal guardian in any electronic or digital communication,
9293 unless such:
9394 1. Such communication is on a school -approved platform and
9495 related to school and academic communications ; or
9596 2. The student's parent or legal guardian opted out of being
9697 included in the electronic or digital communication. A student's
9798 parent or legal guardian shall be able to opt out at any time and
9899 identify which types o f electronic or digital communication to opt
99100 out of.
100101 C. Exceptions to the requirement in subsection B of this
101102 section may be made in case of an emergency, subject to subsequent
102103 notification to the parent or legal guardian. School personnel
103104 shall make reasonable efforts to use school -approved platforms,
104105 systems, or applications that allow automatic inclusion of parents
105106 or legal guardians in communications with students.
106107 D. Schools shall provid e training, developed by the State
107108 Department of Education, for school personn el on the student
108109 communication requirements of this section.
109-E. Any school personnel who is reported to be in violation of
110-subsection B of this section shall be put on administ rative leave
111-while the school district investigates the incident and notifies the
112-board of education. If the investigation finds that no misconduct

136+E. Any school personnel who is reported to be in violation of
137+subsection B of this section shall be put on administ rative leave
138+while the school district investigates the incident and notifies the
139+board of education. If the investigation finds that no misconduct
139140 occurred, the school personnel shall be reinstated and the incident
140141 shall be noted in the school personnel 's employee file. If the
141142 investigation finds misconduct occurred, the school p ersonnel shall
142143 be disciplined according to the school district board of education 's
143144 policy, up to and including termination of employment, and the
144145 incident shall be reported to l aw enforcement pursuant to Section
145146 1210.163 of Title 70 of the Oklahoma Statutes this title.
146147 SECTION 2. This act shall become effective July 1, 2025.
147148 SECTION 3. It being immediately necessary for the preservation
148149 of the public peace, health or safety, an emergency is hereby
149150 declared to exist, by rea son whereof this act shall take effect and
150151 be in full force from and after its passage and approval.
