4040 An Act relating to tourism; providing certain
4141 purchases by the Oklahoma Tourism and Recreation
4242 Departments are exempt from the Oklahoma Central
4343 Purchasing Act; providing for exempted purchases;
4444 defining term; providing limitation; providing for
4545 codification; and providing an effective date.

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law to be codified
5252 in the Oklahoma Statutes as Sectio n 2239.1 of Title 74, unless there
5353 is created a duplication in numbering, reads as follows:
5454 A. The following purchases by the Oklahoma Tourism and
5555 Recreation Department shall be exempt from the Oklahoma Central
5656 Purchasing Act:
5757 1. Merchandise for resale purchased for and sold over the
5858 Internet, in publications or through Department retail outlets, such
5959 as lodges, gift shops, golf course pro shops, restaurants , and other
6060 purchases made for the production of such merchandise; and
6161 2. Materials, supplies, and services necessary for the
6262 efficient and economical operation of revenue generating, Department

8989 operated facilities and programs , including those made to maintain
9090 or improve guest perception of quality and service including, but
9191 not limited to, mattresses, pillows, bed skirts, drapery, small
9292 appliances customary in hospitality spaces such as hotel or lodge
9393 rooms and cabins, pool equipment , and pool maintenance costs .
9494 B. For purposes of this section, "revenue generating" means a
9595 purchase that would affect the ability to generate revenue at a
9696 Department operated facility or program. Revenue generated by the
9797 agency is built into the Department 's budget to fund operational
9898 expenses and salaries. Loss of revenue will require the agency to
9999 reduce staff or seek additional funding to cover the loss created by
100100 delays in acquiring goods and services fundamental to generating
101101 this revenue.
102102 C. No exemption provided in this section shall be construed for
103103 the use of leasing or contracting for state -owned restaurants in
104104 Oklahoma state parks.
105105 SECTION 2. This act shall become effective November 1, 2025.
