40	40	An Act relating to tourism; providing certain
41	41	purchases by the Oklahoma Tourism and Recreation
42	42	Departments are exempt from the Oklahoma Central
43	43	Purchasing Act; providing for exempted purchases;
44	44	defining term; providing limitation; providing for
45	45	codification; and providing an effective date.

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. NEW LAW A new section of law to be codified
52	52	in the Oklahoma Statutes as Sectio n 2239.1 of Title 74, unless there
53	53	is created a duplication in numbering, reads as follows:
54	54	A. The following purchases by the Oklahoma Tourism and
55	55	Recreation Department shall be exempt from the Oklahoma Central
56	56	Purchasing Act:
57	57	1. Merchandise for resale purchased for and sold over the
58	58	Internet, in publications or through Department retail outlets, such
59	59	as lodges, gift shops, golf course pro shops, restaurants , and other
60	60	purchases made for the production of such merchandise; and
61	61	2. Materials, supplies, and services necessary for the
62	62	efficient and economical operation of revenue generating, Department

89	89	operated facilities and programs , including those made to maintain
90	90	or improve guest perception of quality and service including, but
91	91	not limited to, mattresses, pillows, bed skirts, drapery, small
92	92	appliances customary in hospitality spaces such as hotel or lodge
93	93	rooms and cabins, pool equipment , and pool maintenance costs .
94	94	B. For purposes of this section, "revenue generating" means a
95	95	purchase that would affect the ability to generate revenue at a
96	96	Department operated facility or program. Revenue generated by the
97	97	agency is built into the Department 's budget to fund operational
98	98	expenses and salaries. Loss of revenue will require the agency to
99	99	reduce staff or seek additional funding to cover the loss created by
100	100	delays in acquiring goods and services fundamental to generating
101	101	this revenue.
102	102	C. No exemption provided in this section shall be construed for
103	103	the use of leasing or contracting for state -owned restaurants in
104	104	Oklahoma state parks.
105	105	SECTION 2. This act shall become effective November 1, 2025.
