5353 SECTION 1. NEW LAW A new section of law to be codified
5454 in the Oklahoma Statutes as Section 3119.1 of Title 63, unless there
5555 is created a duplication in numbering, reads as follows:
5656 This act shall be known and m ay be cited as the "Oklahoma
5757 Respite Care Pilot Program for Seniors Act ".
5858 SECTION 2. NEW LAW A new section of law to be codified
5959 in the Oklahoma Statutes as Section 3119.2 of Title 63, unless there

6161 The purpose of this act is to establish pilot programs designed
6262 to provide respite care services for seniors in Oklahoma through

9292 unique needs of seniors. The ultimate goal is to reduce caregiver
9393 burnout, support working families, and improve the well -being of
9494 both seniors and their car egivers by offering flexible care options.
9595 SECTION 3. NEW LAW A new section of law to be codified
9696 in the Oklahoma Statutes as Section 3119.3 of Title 63, unless there
9797 is created a duplication in numbering, reads as follows:
9898 For purposes of this act:
9999 1. "Adult day center" means a licensed facility providing
100100 social, health-related, or personal care services in a protective
101101 setting during the day;
102102 2. "Respite care" means temporary relief for primary caregivers
103103 of seniors, providing sh ort-term care for seniors in appropriate
104104 settings;
105105 3. "Residential care facil ity" means a facility licensed to
106106 provide care services to seniors who do not require twenty-four-hour
107107 nursing care but need assistance with daily living activities;
108108 4. "Respite waiver" refers to financial assistance provided to
109109 eligible caregivers, ensuring access to respite care services at no
110110 or reduced cost; and
111111 5. "Voucher" means a payment issued to caregivers allowing them
112112 to obtain respite care services from participating care providers.

139139 SECTION 4. NEW LAW A new section of l aw to be codified
140140 in the Oklahoma Statutes as Section 3119.4 of Title 63, unless there
141141 is created a duplication in numbering, reads as follows:
142142 A. The Department of Human Servic es (DHS) is hereby authorized
143143 to establish and administer pilot programs for the provision of
144144 respite care vouchers or respite waivers to caregivers of seniors
145145 limited to designated counties, and within the designated counties,
146146 qualified facilities may opt into the pilot program .
147147 B. The pilot programs shall:
148148 1. Provide financial a ssistance in the form of vouchers or
149149 waivers for caregivers of seniors, enabling them to access care
150150 services outside traditional hours, including weekend and evening
151151 care;
152152 2. Prioritize caregivers who are employed in evening -hour or
153153 nontraditional work schedules, ensuring they have access to services
154154 when needed most; and
155155 3. Facilitate the participation of adult day centers,
156156 residential care facilities, and other licensed provi ders equipped
157157 to deliver care for seniors with various health and personal nee ds.
158158 SECTION 5. NEW LAW A new section of law to be codified
159159 in the Oklahoma Statutes as Section 3119.5 of Title 63, unless there
160160 is created a duplication i n numbering, reads as follows:
161161 A. To qualify for participation in the respite care pilot
162162 programs, applicants shall:

189189 1. Be primary caregivers of seniors aged sixty -five (65) years
190190 or older;
191191 2. Demonstrate employment in evening -hour jobs or
192192 nontraditional work schedules where traditional caregiving services
193193 are not sufficient; and
194194 3. Provide documentation demonstrating financial need for
195195 respite care assistance, as determined by the Department of Human
196196 Services (DHS).
197197 B. Applications for respite care vo uchers or waivers shall be
198198 made to (DHS), which will evaluate and approve applicants based on
199199 established criteria.
200200 SECTION 6. NEW LAW A new section of law to be codified
201201 in the Oklahoma Statutes as Section 3119.6 of Title 63, unles s there
202202 is created a duplication in numbering, reads as follows:
203203 A. Eligible providers for respite care services under this act
204204 shall include:
205205 1. Licensed adult day centers and residential care facilities;
206206 and
207207 2. Other licensed care agencies equipped to meet the unique
208208 needs of seniors.
209209 B. Providers shall be reimbursed by the state for services
210210 rendered under the voucher or waiver programs, based on rates
211211 established by the Department of Human Services ( DHS).

238238 SECTION 7. NEW LAW A new section of law to be codified
239239 in the Oklahoma Statutes as Section 3119.7 of Title 63, unless there
240240 is created a duplication in numbering, reads as follows:
241241 A. The respite care pilot programs established by this act
242242 shall be funded through multiple so urces, including but not limited
243243 to:
244244 1. Grants from federal, state, or private sources;
245245 2. Public-private partnerships designed to support caregiving
246246 and senior care; and
247247 3. Allocated state funds, subject to legislative
248248 appropriations.
249249 B. The Department of Human Services ( DHS) is authorized to seek
250250 and apply for available federa l and state funding to support the
251251 pilot programs, including funds under the Medicaid program and other
252252 relevant federal initiatives.
253253 SECTION 8. NEW LAW A new section of law to be codified
254254 in the Oklahoma Statutes as Section 3119.8 of Title 63, unless there
255255 is created a duplication in numbering, reads as follows:
256256 A. The Department of Human Services ( DHS) shall conduct an
257257 annual review and report to the Leg islature on the effectiveness of
258258 the respite care pilot programs, including:
259259 1. The number of caregivers served by the program s;
260260 2. Data on the utilization of care services during
261261 nontraditional hours; and

290290 B. The report shall include recommendations for expanding,
291291 modifying, or continuing the program s based on its performance and
292292 stakeholder feedback.
293293 SECTION 9. This act shall become effective November 1, 2025.
