46	46	promulgation of rules and procedures; creating the

50	50	codification; and providing an effective date .

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 5001 of Title 2, unless there is
57	57	created a duplication in numbering, reads as follows:
58	58	This act shall be known and may be cited as the "Expanding
59	59	Access to Local Foods Act of 2025 ".
60	60	SECTION 2. NEW LAW A new section of law to be codified
61	61	in the Oklahoma Statutes as Section 5002 of Title 2, unless there is
62	62	created a duplication in numbering, reads as follows:

89	89	A. As used in this act, "Market value" means the price that a
90	90	property would sell for in a competitive market under fair
91	91	conditions.
92	92	B. There is hereby created a program to purchase locally grown
93	93	fruits and vegetable s from small and underserved producers in
94	94	Oklahoma to be administered by the Oklahoma Department of
95	95	Agriculture, Food, and Forestry . to accomplish the goals of this
96	96	act, the Department is authorized to use the funds available in the
97	97	Expanding Access to Local Foods Program Revolving Fund established
98	98	in Section 3 of this act. The purpose of the program i s to maintain
99	99	and improve food and agricultural supply chain resiliency and expand
100	100	economic opportunities for small and underserved producers while
101	101	promoting food security .
102	102	C. The Department shall purchase at market value locally grown
103	103	fruits and vegetables from small and underserved producers in
104	104	Oklahoma and shall donate those fru its and vegetables to non -profits
105	105	in Oklahoma that distribute food within the state free of charge.
106	106	D. The Department shall promulgate rules and procedures to
107	107	effectuate the provisions of this act
108	108	SECTION 3. NEW LAW A new section of law to be codified
109	109	in the Oklahoma Statutes as Section 5007 of Title 2, unless there is
110	110	created a duplication in numbering, reads as follows:
111	111	There is hereby created in the Sta te Treasury a revolving fund
112	112	for the Oklahoma Department of Agriculture, Food, and Forestry to be

139	139	designated the "Expanding Access to Local Foods Program Revolving
140	140	Fund". The fund shall be a continuing fund, not subject to fiscal
141	141	year limitations, and sha ll consist of all monies received by the
142	142	Department from appropriations, federal grants or funds, municipal
143	143	contributions, private contributions, and any other sources,
144	144	including interest earned from the income in the fund, that are
145	145	designated for deposit to such fund or designated for duties
146	146	associated with this act. All monies accruing to the credit of said
147	147	fund are hereby appropriated and may be budgeted and expended by the
148	148	Oklahoma Department of Agriculture, Food, and Forestry to perform
149	149	the duties imposed on the Department by law. Expenditures from said
150	150	fund shall be made upon warrants issued by the State Treasurer
151	151	against claims filed as prescribed by law with the Director of the
152	152	Office of Management and Enterprise Services for approval and
153	153	payment.
154	154	SECTION 4. This act shall become effective November 1, 2025.
