4040 An Act relating to high-speed vehicular pursuits;
4141 directing law enforcement agencies to adopt certain
4242 policies and procedures; requiring policies and
4343 procedures to include specific requirements for motor
4444 vehicle pursuits, fleeing felons , and misdemeanants;
4545 providing restrictions when engaging in vehicular
4646 pursuits; providing for codification; and providing
4747 an effective date.

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. NEW LAW A new section of law to be codified
5454 in the Oklahoma Statutes as Section 34.6 of Title 22, unless there
5555 is created a duplication in numbering, reads as follows:
5656 A. Each state, county, and local law enforcement agency shall
5757 adopt written policies and procedures concerning the high -speed
5858 pursuit of fleeing suspects. All high -speed pursuit policies and
5959 procedures created or adopted by a law enforcement agency shall
6060 address situations in which high -speed pursuits cross over into
6161 other jurisdictions. The policies and procedures shall also include
6262 the following:

9090 a. prohibiting or limiting high -speed pursuits in densely
9191 populated areas,
9292 b. prohibiting the shooting of firearms at moving
9393 vehicles,
9494 c. other standards consistent with public policy that aim
9595 to protect innocent persons when pursuing alleged
9696 violent criminals,
9797 d. requiring prior supervisory approval before initiating
9898 high-speed pursuits, and
9999 e. emphasizing alternative methods of pursuit includi ng,
100100 but not limited to, aircraft support via helicopters,
101101 unmanned aircraft systems or drones, or Global
102102 Positioning System (GPS) trackers;
103103 2. As it relates to the pursuit of al leged felons, regardless
104104 of the manner of pursuit:
105105 a. requiring that law enforcement officers pursue a
106106 person only when there is a reasonable certainty that
107107 apprehension of the person will prevent further
108108 physical harm to other individuals or the officer,
109109 b. requiring that a pursuit end if significant property
110110 damage or harm to indi viduals seems probable, and
111111 c. prohibiting shooting at a fleeing individual who
112112 presents no immediate harm to an officer or any other
113113 person; and

140140 3. As it relates to the pursuit of alleged misdemeanants, the
141141 person may only be pursued if the officer is reasonably certain to
142142 apprehend the person without damage to public property or harm to
143143 innocent persons.
144144 B. No state, county, or local law enforcement agency shall
145145 authorize the engagement of a high -speed vehicular pursuit unless
146146 probable cause exists to b elieve that the person being pursued
147147 committed, or is committing:
148148 1. Murder;
149149 2. Aggravated assault and battery;
150150 3. Kidnapping, false imprisonment, or a related offense;
151151 4. Rape;
152152 5. Armed robbery; or
153153 6. Any other offense that creates an immediate threat of death
154154 or serious bodily injury to another person or a substantial threat
155155 to the safety of another person.
156156 SECTION 2. This act shall become effective Novemb er 1, 2025.
