5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 10 O.S. 2021, Section 405.4, is
5252 amended to read as follows:
5353 Section 405.4. A. Any person with a bachelor 's degree or
5454 postgraduate degree shall be considered as having met the
5555 educational requirements for a director of a full -time child care
5656 center required by the Department of Human Services , and any person
5757 with four (4) years' experience working as a full -time child care
5858 employee or eight (8) years' experience working as a part -time child
5959 care employee and who meets all other requirements, pursuant to this
6060 title and the Oklahoma Administrative Code shall be considered as
6161 having met the educational requirements for a director of a full -
6262 time child care center required by the Department of Human Services.

8989 Nothing in this section shall be construed as to affect annual
9090 continuing education requirements. The director of a chil d care
9191 center may also qualify as a master teacher for children of all
9292 ages.
9393 B. Any person replacing a master teacher at a child care center
9494 shall be granted a one -year probationary period to fulfill the
9595 educational qualifications required by the Departme nt for a master
9696 teacher. The Department may extend the probationary period an
9797 additional year as long as the person is actively pursuing that
9898 goal.
9999 C. Licensed child care facilities opened or expanded before
100100 November 1, 2016, shall have thirty -five (35) square feet of floor
101101 area per infant in rooms occupied only by infants. New construction
102102 and existing space not previously licensed for child care after
103103 November 1, 2016, shall have forty (40) square feet of floor area
104104 per infant in rooms occupied only by infants.
105105 SECTION 2. This act shall become effective November 1, 2025.
