42	42	Care Facilities Licensing Act; mo difying requirements

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 10 O.S. 2021, Section 405.4, is
52	52	amended to read as follows:
53	53	Section 405.4. A. Any person with a bachelor 's degree or
54	54	postgraduate degree shall be considered as having met the
55	55	educational requirements for a director of a full -time child care
56	56	center required by the Department of Human Services , and any person
57	57	with four (4) years' experience working as a full -time child care
58	58	employee or eight (8) years' experience working as a part -time child
59	59	care employee and who meets all other requirements, pursuant to this
60	60	title and the Oklahoma Administrative Code shall be considered as
61	61	having met the educational requirements for a director of a full -
62	62	time child care center required by the Department of Human Services.

89	89	Nothing in this section shall be construed as to affect annual
90	90	continuing education requirements. The director of a chil d care
91	91	center may also qualify as a master teacher for children of all
92	92	ages.
93	93	B. Any person replacing a master teacher at a child care center
94	94	shall be granted a one -year probationary period to fulfill the
95	95	educational qualifications required by the Departme nt for a master
96	96	teacher. The Department may extend the probationary period an
97	97	additional year as long as the person is actively pursuing that
98	98	goal.
99	99	C. Licensed child care facilities opened or expanded before
100	100	November 1, 2016, shall have thirty -five (35) square feet of floor
101	101	area per infant in rooms occupied only by infants. New construction
102	102	and existing space not previously licensed for child care after
103	103	November 1, 2016, shall have forty (40) square feet of floor area
104	104	per infant in rooms occupied only by infants.
105	105	SECTION 2. This act shall become effective November 1, 2025.
