4040 A Joint Resolution directing the Secretary of State

5454 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
5555 1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
5656 SECTION 1. The Secretary of State shall refer to the people for
5757 their approval or rejection, as and in the manner provided by law,
5858 the following proposed amendment to Section 8 E of Article X of the
5959 Constitution of the State of Oklahoma to read as follows:

6161 A. Despite any provision to the contrary, beginning January 1,
6262 2006 2026, each head of household who has been honorably discharged
6363 from active service in an y branch of the Armed Forces of the United
6464 States or Oklahoma National Guard and who has been certified by the

9191 United States Department of Veterans Affairs or its suc cessor to
9292 have a one hundred percent (100%) permanent disability sustained
9393 through military action or accident or resulting from disease
9494 contracted while in such active service or the surviving spouse of
9595 such head of household shall be entitled to claim an exemption for
9696 the full amount of the fair cash value of the homestead . as follows:
9797 1. A twenty-five-percent exemption on the amount of the fair
9898 cash value of the homestead when the head of household has a
9999 disability rating at or between ten percent (10%) and twenty-nine
100100 percent (29%);
101101 2. A fifty-percent exemption on the amount of the fair cash
102102 value of the homestead when the head of household has a disability
103103 rating at or between thirty percent (30%) and forty -nine percent
104104 (49%);
105105 3. A seventy-five-percent exemption on the amount of the fair
106106 cash value of the homestead when the head of househ old has a
107107 disability rating at or between fifty percent (50%) and sixty -nine
108108 percent (69%); and
109109 4. A one-hundred-percent exemption on the amount of the fair
110110 cash value of the homestead when the head of household has a
111111 disability rating at or between seventy percent (70%) and one
112112 hundred percent (100%).
113113 B. In order to be eligible for the exemption authorized by this
114114 section, the individual shall be required to prove r esidency within

141141 the State of Oklahoma and must have previously qualified for the
142142 homestead exemption authorized by law or be eligible for the
143143 homestead exemption pursuant to law.
144144 C. If a homestead otherwise eligible for the exemption
145145 authorized by this se ction is transferred on or after January 1 of a
146146 calendar year, another homestead property acquired by the qualifying
147147 head of household or by the surviving spouse of such qualifying head
148148 of household shall be exempt to the same extent as the homestead
149149 property previously owned by such person or persons for the year
150150 during which the new homestead is acquired and, subject to the
151151 requirements of this section, for each year thereafter.
152152 SECTION 2. The Ballot Title for the proposed Constitutional
153153 amendment as set forth in SECTION 1 of this resolution shall be in
154154 the following form:

157157 THE GIST OF THE PROPOSITION IS AS FOLLOWS:
158158 This measure amends Section 8 E of Article 10 of the Oklahoma
159159 Constitution. This measure would allow for veterans who have a
160160 disability rating rang ing from ten percent (10%) to one hundred
161161 percent (100%) to be eligible for the exemption on the amount of
162162 the fair cash value of the homestead for purposes of ad valorem
163163 taxation. The amount of the fair cash value of the homestead
164164 that is exempted from ad valorem taxation is dependent on the

193193 disability rating to potentially qualify for the exemption of the
194194 fair cash value of the homestead for purposes of ad valorem
