45	46		An Act relating to state agencies; defining terms;
46	47		prohibiting state agencies from taking certain
47	48		actions relating to diversity, equity, and inclusion;
48	49		providing for implementation and enforcement;

55	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56	57		SECTION 1. NEW LAW A new section of law to be codified
57	58		in the Oklahoma Statutes as Section 9300 of Title 74, unless there
58	59		is created a duplication in numbering, reads a s follows:
59	60		A. As used in this section:
60	61		1. “Diversity, equity, and inclusion ” means any program, class,
61	62		system, curriculum, hiring practice, training, department, survey,
62	63		verbal or written directive or memo, or contract which uses
63	64		discrimination through e quity action plans, forced compulsion from
64	65		constitutional freedoms of speech, expression, religion, or any
65		-	other freedom expressed in the U nited States Constitution, fails to

	92	+	other freedom expressed in the U nited States Constitution, fails to
93	93		protect every person with equal dignity and respect , or is meant to
94	94		indoctrinate or intimidate a person in any way into discrimination
95	95		of any kind;
96	96		2. “Indoctrinate” means to force or compel endorsement,
97	97		adoption, acceptance, or affirmation of any belief system, ideology,
98	98		theory, lifestyle, religion, non -religion, or philosophy by any
99	99		action, curriculum, training or instruction by using either directly
100	100		or commingling any taxpayer funds for these items; and
101	101		3. “State agency” means any board, commission, department,
102	102		office, or other instrumentality of the state supported in whole or
103	103		in part by public funds or entrusted with the expenditure of public
104	104		funds or administering or operating public property. The term shall
105	105		include the Oklahoma State Regents for Higher Education.
106	106		B. No state agency shall:
107	107		1. Grant or support any diversity, eq uity, and inclusion
108	108		positions, departments, activities, procedures, or programs to the
109	109		extent that they grant preferential treatment based on the
110	110		particular race, color, sex, ethnicity, or national origin of one
111	111		person over another;
112	112		2. Require any person to participate in, listen to, or receive
113	113		any education, training, activity, procedure, or programming to the
114	114		extent such education, training, activity, procedure, or programming
115		-	grants preferential treatment based on the particular race, color,
116		-	sex, ethnicity, or national origin of one person over another;

	141	+	grants preferential treatment based on the particular race, color,
	142	+	sex, ethnicity, or national origin of one person over another;
144	143		3. Require any person to swear, certify , or agree to any
145	144		loyalty oath that favors or prefers one particular race, color, sex,
146	145		ethnicity, or national origin over another;
147	146		4. Require any person to certify or declare agreement with,
148	147		recognition of, or adherence to any particular political,
149	148		philosophical, religious, or other ideological viewpoint; or
150	149		5. Require any applicant for employment to provide a diversity,
151	150		equity, and inclusion statement or give any applicant for employment
152	151		preferential consideration based on the provision of such a
153	152		diversity, equity, and inclusion statement.
154	153		C. The Office of the Attorney General shall enforce and may
155	154		promulgate rules to implement the provisions of this section. Upo n
156	155		the finding of a violation of this section, the Attorney General
157	156		shall report the details of the violation to the Governor, the
158	157		President Pro Tempore of the Senate, the Speaker of the House of
159	158		Representatives, and the chairs of the Senate and House of
160	159		Representatives appropriations committees.
161	160		D. Upon receipt of a report pursuant to subsection C of this
162	161		section, the Legislature shall reduce the appropriation to the state
163	162		agency by one percent (1%) in the following fiscal year ’s general
164	163		appropriations bill, if the agency receives appropriations from the
165	164		Legislature. If the agency does not regularly receive
166		-	appropriations from the Legislature, the agency shall increase the

	191	+	appropriations from the Legislature, the agency shall increase the
194	192		amount the agency deposits into the General Revenue Fund by one
195	193		percent (1%).
196	194		SECTION 2. This act shall become effective November 1, 2025.
