77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
78	78	SECTION 1. NEW LAW A new section of law to be codif ied
79	79	in the Oklahoma Statutes as Section 5028.2 of Title 63, unless there
80	80	is created a duplication in numbering, reads as follows:
81	81	As used in this section :
82	82	1. “Individualized ed ucation program” or “IEP” means, in
83	83	accordance with the Individuals with Disabilities Education Act, a
84	84	specially designed instruction for the individual child to access
85	85	classroom instruction and activities to receive a free and
86	86	appropriate public education (FAPE) in the least restrictive
87	87	environment for the individual child. The IEP shall contain goals
88	88	with short term objectives, and each shall have objective means of

140	140	measuring. As provided by the Individuals with Disabilities
141	141	Education Act:
142	142	a. any related service identified as therapy such as
143	143	physical therapy, occupational therapy, speech
144	144	language therapy, behavioral therapy, and
145	145	psychological therapy is considered medical and
146	146	therefore shall not be written into the IEP,
147	147	b. medically necessary related ser vices, accommodations,
148	148	modifications, and assistive technology shall be
149	149	attached to the IEP, and
150	150	c. only medically necessary related services that are
151	151	educationally necessary for the child to access
152	152	classroom instruction to make sure the child receives
153	153	a Free and Appropriate Public Education (FAPE) may be
154	154	written into the IEP.
155	155	Related services, medical, assistive technology, modifications,
156	156	and accommodations shall be attached to the child’s Individualized
157	157	Educational Plan, not written in the IEP;
158	158	2. “School-based services” means specially designed instruction
159	159	and services that are ed ucationally necessary for the eligible
160	160	student to receive a free and appropriate public education. This
161	161	excludes medically necessary services that are not included within
162	162	the definition of “educationally necessary ” under the Individuals
163	163	with Disabilities Education Act , such as non-educational health-

215	215	related and rehabilitative services including, but not limited to,
216	216	health examinations, immunizations, flu vaccines, eye examinatio ns,
217	217	speech and language therapy, physical therapy, occupational therapy,
218	218	social work services, and psychological and counseling services.
219	219	These services are not the responsibility of the Oklahoma K -12
220	220	public schools and shall be the responsibility of the parents or
221	221	guardians to provide for their children off campus and after school
222	222	hours.
223	223	B. The state Medicaid program may cover educationally -necessary
224	224	school-based services in accordance with this section. The Oklahoma
225	225	Health Care Authority shall not:
226	226	1. Define school-based services more broadly than defined under
227	227	this section or the Individuals with Disabilities Education Act; or
228	228	2. Cover school-based health care that is not educationally
229	229	necessary under this section or the Individuals with Disabilities
230	230	Education Act.
231	231	C. School-based services may be provided only by a qualified
232	232	school provider to a student under twenty -one (21) years of age
233	233	pursuant to an individualized education program (IEP), in accordance
234	234	with the Individuals with Disabilities Educat ion Act. Payment may
235	235	be made only to qualified school providers for delivery o f school-
236	236	based services, provided that such services are educationally
237	237	necessary to receive a free and appropriate public education , and
238	238	sufficiently supported by appropriate documentation.

290	290	SECTION 2. This act shall become effective July 1, 2025.
291	291	SECTION 3. It being immediately necessary for the preservation
292	292	of the public peace, health or safety, an emergency is hereby
293	293	declared to exist, by reaso n whereof this act shall take effect and
294	294	be in full force from and after its pa ssage and approval.
