7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
7878 SECTION 1. NEW LAW A new section of law to be codif ied
7979 in the Oklahoma Statutes as Section 5028.2 of Title 63, unless there
8080 is created a duplication in numbering, reads as follows:
8181 As used in this section :
8282 1. “Individualized ed ucation program” or “IEP” means, in
8383 accordance with the Individuals with Disabilities Education Act, a
8484 specially designed instruction for the individual child to access
8585 classroom instruction and activities to receive a free and
8686 appropriate public education (FAPE) in the least restrictive
8787 environment for the individual child. The IEP shall contain goals
8888 with short term objectives, and each shall have objective means of

140140 measuring. As provided by the Individuals with Disabilities
141141 Education Act:
142142 a. any related service identified as therapy such as
143143 physical therapy, occupational therapy, speech
144144 language therapy, behavioral therapy, and
145145 psychological therapy is considered medical and
146146 therefore shall not be written into the IEP,
147147 b. medically necessary related ser vices, accommodations,
148148 modifications, and assistive technology shall be
149149 attached to the IEP, and
150150 c. only medically necessary related services that are
151151 educationally necessary for the child to access
152152 classroom instruction to make sure the child receives
153153 a Free and Appropriate Public Education (FAPE) may be
154154 written into the IEP.
155155 Related services, medical, assistive technology, modifications,
156156 and accommodations shall be attached to the child’s Individualized
157157 Educational Plan, not written in the IEP;
158158 2. “School-based services” means specially designed instruction
159159 and services that are ed ucationally necessary for the eligible
160160 student to receive a free and appropriate public education. This
161161 excludes medically necessary services that are not included within
162162 the definition of “educationally necessary ” under the Individuals
163163 with Disabilities Education Act , such as non-educational health-

215215 related and rehabilitative services including, but not limited to,
216216 health examinations, immunizations, flu vaccines, eye examinatio ns,
217217 speech and language therapy, physical therapy, occupational therapy,
218218 social work services, and psychological and counseling services.
219219 These services are not the responsibility of the Oklahoma K -12
220220 public schools and shall be the responsibility of the parents or
221221 guardians to provide for their children off campus and after school
222222 hours.
223223 B. The state Medicaid program may cover educationally -necessary
224224 school-based services in accordance with this section. The Oklahoma
225225 Health Care Authority shall not:
226226 1. Define school-based services more broadly than defined under
227227 this section or the Individuals with Disabilities Education Act; or
228228 2. Cover school-based health care that is not educationally
229229 necessary under this section or the Individuals with Disabilities
230230 Education Act.
231231 C. School-based services may be provided only by a qualified
232232 school provider to a student under twenty -one (21) years of age
233233 pursuant to an individualized education program (IEP), in accordance
234234 with the Individuals with Disabilities Educat ion Act. Payment may
235235 be made only to qualified school providers for delivery o f school-
236236 based services, provided that such services are educationally
237237 necessary to receive a free and appropriate public education , and
238238 sufficiently supported by appropriate documentation.

290290 SECTION 2. This act shall become effective July 1, 2025.
291291 SECTION 3. It being immediately necessary for the preservation
292292 of the public peace, health or safety, an emergency is hereby
293293 declared to exist, by reaso n whereof this act shall take effect and
294294 be in full force from and after its pa ssage and approval.
