7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 3-9-101 of Title 27A, unless
8080 there is created a duplication in numbering, reads as follows:
8181 A. For the purposes of this section:
8282 1. “Kill zone” means the area within a twenty -five mile radius
8383 of the site of:
8484 a. the rupture of a carbon dioxide (CO2) pipeline, or
8585 b. the release of CO2 from a CO2 pipeline, facility, or
8686 sequestration site;

138138 2. “Owner” means any person that owns or operates a CO 2 pipeline
139139 or supplies CO 2 to a CO2 pipeline, facility, or sequestration site ;

141141 3. “Victim” means any person that files a financing statement
142142 for the purposes of perfecting a CO 2 victim lien.
143143 B. Any person residing, traveling through, visiting, or owni ng
144144 or leasing property, agriculture, equipment, livestock, or pets, or
145145 who is dependent on affected water sources located within the kill
146146 zone of a CO2 pipeline, facility, or sequestration site shall have
147147 claim to a CO2 victim lien. Such person shall have standing for
148148 compensation for all damages incurred or projected to be incurred by
149149 the person due to the rupture of a CO 2 pipeline or the release of CO 2
150150 from a CO2 pipeline, facility, or sequestration site . The lien shall
151151 include full compensatory and pun itive damages against all assets of
152152 the owner of a CO 2 pipeline or an owner supplying CO 2 to a CO2
153153 pipeline at the time of the release of CO 2 or the rupture of a CO 2
154154 pipeline or sequestration site , regardless of intent or liability.
155155 C. 1. To perfect a CO2 victim lien, a person shall file a UCC-1
156156 financing statement within one (1) y ear from the date of the release
157157 of CO2 or the rupture of a CO 2 pipeline or sequestration site with
158158 the county clerk’s office where the kill zone is located. A
159159 perfected lien shall have priority retroactive to the date that the
160160 CO2 was released or that the CO 2 pipeline or sequestration site
161161 ruptured or leaked and over any conflicting security interest or

213213 lien, including those perfected prior to the effective date of this
214214 act.
215215 2. A financing statement filed pursuant to this subsection
216216 shall indicate that t he statement is being filed to perfect a CO 2
217217 victim lien. The financing statement shall remain effective until a
218218 termination date is filed.
219219 D. A victim shall file a terminatio n statement within thirty
220220 (30) days from the date that the victim receives a written demand
221221 from an owner, or from the date that the owner performs all
222222 obligations of the lien, whichever is later. The victim shall also
223223 file a termination statement if the victim wishes to relinquish
224224 rights to the CO 2 victim lien.
225225 E. If any owner at the subject of a CO 2 victim lien is involved
226226 in bankruptcy or receivership, the trustee, conservator, or court
227227 responsible for reorganization or liquidation of the owner ’s assets
228228 shall hold the assets in trust for the benefit of potential CO 2
229229 victim lienholders for a period not to exceed one (1) year from the
230230 date of the owner’s last day of operating the CO 2 pipeline or the
231231 owner’s last day of creating CO 2 to be supplied to a CO 2 pipeline or
232232 facility.
233233 SECTION 2. This act shall become effect ive November 1, 2025.
